This
\n\twrit petition has been preferred by petitioner with a prayer to
\n\tdirect respondents to consider his case  as physical handicap person
\n\tand give the PH Merit Number as per the Rules and Regulations of the
\n\tAdmission Committee.\n<\/p>\n
Grievance
\n\tof the petitioner is that the petitioner is having more than 40 per
\n\tcent disability due to Polio but the Board for deciding eligibility
\n\tand suitability for admission against reserved seats for disabled
\n\tcandidates has shown him 35 per cent disability and thereby
\n\tdisentitled petitioner to claim benefit of disability in the matter
\n\tof admission in medical course and  reshuffling in the course.\n<\/p>\n
It
\n\tis submitted that the finding of the Board for deciding eligibility
\n\tand suitability for admission with regard to disability is wrong and
\n\tcontrary to decision of Civil Surgeon and its committee which found
\n\tpetitioner disable to the extent of 40 per cent due to polio.\n<\/p>\n
Case
\n\twas taken up on 4th August, 2011 and having noticed
\n\taforesaid, following order was passed:\n<\/p>\n
”\tFrom
\n\tthe certificate granted by the office of the Civil Surgeon under the
\n\tletterhead of Sheth N.L. General Hospital, Patan (N.G.) dated
\n\t17.5.2011, it appears that the petitioner has been found to be 40%
\n\tdisabled.  Similar certificate has been granted earlier on 22.9.2010
\n\tfrom the said hospital.  However, when he has been verified by the
\n\tBoard for Deciding the eligibility and suitability for admissions
\n\tagainst reserved seats for loco-motor disabled candidates C\/o Dean,
\n\tB.J.Medical College, Ahmedabad, the disability has been found to be
\n\t35%.\n<\/p>\n
\tAs
\n\twe found that there are two conflicting reports and one report is
\n\tgiven from the Government Hospital and other report is by the Board
\n\twhich is also constituted by the State Government, we are of the
\n\tview that third report should be obtained from another board chaired
\n\tby the Orthopaedic. We
\n\taccordingly direct the Civil Surgeon, Civil Hospital, Ahmedabad to
\n\tconstitute the board consisting of experts of Orthopaedic, Physician
\n\tand expert of the subject of which the petitioner is physically
\n\tdisabled and submit the report before this Court by the next date.
\n\tThe petitioner should appear with a copy of this order before the
\n\tCivil Surgeon, Civil Hospital, Ahmedabad, who will constitute such
\n\tboard and call the petitioner within 72 hours (three days) to get
\n\thim physically checked up and submit the report before this Court
\n\timmediately.\n<\/p>\n
\tLet
\n\ta copy of this order be handed over to learned AGP Mr.Pranav Dave
\n\tfor information to the Civil Surgeon, Civil Hospital, Ahmedabad.
\n\tThe petitioner be also provided with a copy of this order.\n<\/p>\n
\tPost
\n\tthe matter along with the report, if any submitted, on 10th
\n\tAugust 2011 within ten cases.\n<\/p>\n
\tDirect
\n\tservice is permitted today.”\n<\/p>\n
Pursuant
\n\tto Court’s order,  respondents have submitted reply. Board
\n\tconstituted by Civil Surgeon, Civil Hospital, Ahmedabad with expert
\n\tof Orthopedic Physician and expert on the subject have found
\n\tpetitioner 40 per cent disabled and in their reply, respondent has
\n\tstated as under in para 4 :\n<\/p>\n
“4.\tI
\n\tsubmit that therefore now it is accepted that the petitioner is
\n\thaving 40 % disability and and is eligibility for conditions of
\n\tadmission in the course wherein the petitioner is considered as a
\n\tdisabled candidate and is given Merit No. 10-A-2. In next
\n\treshuffling program admission committee will offer available seats
\n\tand branches in PH Category to the candidate according to his PH
\n\tMerit Number. And therefore, as already petitioner’s case considered
\n\tby the admission committee as eligible for the seat in the disabled
\n\tcategory petition would not survive and same may be disposed of
\n\taccordingly.”\n<\/p>\n
In
\n\tview of paragraph 4 of reply affidavit at page 35 and in view of
\n\tsuch stand taken by the respondents, we direct respondents to treat
\n\tpetitioner as disabled candidate and as per merit, his case be
\n\tconsidered in the next reshuffling programme  and offer him
\n\tavailable seat and branches in such category according to his Merit
\n\tNumber. It is expected that reshuffling will be completed within
\n\tfour to six weeks.\n<\/p>\n
Writ
\n\tpetition stands disposed of accordingly with the aforesaid
\n\tobservations and directions.\n<\/p>\n
