For the reasons mentioned in the application, the application is<\/p>\n<p>allowed and the delay of 258 in filing the appeal is condoned.<\/p>\n<p>2.     The application stands disposed of.\n<\/p>\n<p>LPA 2305\/2006 &amp; C.M. No. 16716\/2006 (stay)<\/p>\n<p>3.     This appeal challenges the order of the learned Single Judge<\/p>\n<p>dated 4th January, 2006.\n<\/p>\n<p>4.     The issue involved in the present appeal relates to unearned<\/p>\n<p>increase sought to be levied by the Union of India (for short &#8216;UOI&#8217;) on<\/p>\n<p><span class=\"hidden_text\">LPA No. 2035-06\/2006                                                Page 1 of 3<\/span><br \/>\n a transfer of property bequeathed by a father-in-law to a son-in-law by<\/p>\n<p>way of a Will. The relevant portions of the impugned judgment passed<\/p>\n<p>by the learned Single Judge holding against the UOI read as follows:-<\/p>\n<blockquote><p>              &#8221; 8. The same has been denied on the ground that<br \/>\n              the petitioner being outside the family of the<br \/>\n              recorded owner, transfer by and under the will<br \/>\n              attracts unearned increase and till the same is paid,<br \/>\n              transfer cannot be allowed.\n<\/p><\/blockquote>\n<blockquote><p>              9. Issue is squarely covered by the decision of the<br \/>\n              Hon&#8217;ble Supreme Court reported as 2003 7 (SCC)<br \/>\n              301 DDA Vs. Vijaya C.Gursahney. Their Lordships<br \/>\n              of the Supreme Court have held that where under a<br \/>\n              will property is bequeathed to a family member and<br \/>\n              on proof that the transfer is without consideration<br \/>\n              i.e., there is no inducement in the will and no money<br \/>\n              has flowed from the beneficiary under the will to the<br \/>\n              testator, property has to be mutated without<br \/>\n              charging unearned increase.\n<\/p><\/blockquote>\n<blockquote><p>              10. Petitioner is not a stranger to the recorded<br \/>\n              owner. He is the son-in- law of Munshi Ram Kapur.<br \/>\n              It cannot therefore be said that the will is,<br \/>\n              primafacie, tainted by consideration.\n<\/p><\/blockquote>\n<blockquote><p>              11. Writ petition accordingly stands disposed of with<br \/>\n              a direction to the respondent to consider the<br \/>\n              application filed by the petitioner on the basis of the<br \/>\n              will dated 2.7.1990 executed by Munshi Ram Kapur.<br \/>\n              Respondent would be permitted to hold an enquiry<br \/>\n              to ascertain whether any consideration passed<br \/>\n              between the petitioner and Munshi Ram Kapur<br \/>\n              during his life time. If it is found that the will is<br \/>\n              genuine and without any consideration, necessary<br \/>\n              mutation would be effected without charging any<br \/>\n              unearned increase. If it is found that the will is<br \/>\n              actually a sale and consideration passed between<br \/>\n              the petitioner and his father-in-law, respondent<br \/>\n              would be entitled to refuse mutation till unearned<br \/>\n              increase is paid.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">LPA No. 2035-06\/2006                                              Page 2 of 3<\/span><\/p>\n<p> 5.      We have noticed that the learned Single Judge has indeed given<\/p>\n<p>permission to the UOI to hold an enquiry to ascertain whether the Will<\/p>\n<p>was actually a sale and consideration passed between the petitioner and<\/p>\n<p>the father-in-law and in such a situation, the Appellants have been held<\/p>\n<p>entitled to refuse mutation till unearned increase was paid.<\/p>\n<p>6.     Mr. Sachdeva, learned counsel appearing for the Appellants has<\/p>\n<p>submitted that since a permission for sale was earlier sought and later<\/p>\n<p>on a Will was propounded, suggests that the Will was manufactured to<\/p>\n<p>avoid payment of unearned increase.\n<\/p>\n<p>7.     In our view, paragraph-11 of the impugned judgment sufficiently<\/p>\n<p>protects the interest of the UOI, which have been sought to be espoused<\/p>\n<p>by the learned counsel for the Appellant. Accordingly, we are satisfied<\/p>\n<p>that since the UOI has been given an opportunity to ascertain the<\/p>\n<p>motive and the bona fides of the transaction, the impugned judgment<\/p>\n<p>delivered by the learned Single Judge does not call for any interference<\/p>\n<p>by this Court.\n<\/p>\n<p>8.     The appeal and the pending C.M.
