SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/09\/2011 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Present<br \/>\n\tpetition under<br \/>\n\tsection  482 of the Code of Criminal Procedure<br \/>\n\thas been preferred by the petitioners   &#8211; original  accused  to<br \/>\n\tquash and set aside the impugned First Information Report being CR<br \/>\n\tNo.I-165 of 2004 filed by the respondent No.2 herein &#8211;<br \/>\n\toriginal complainant before the J.P. Road Police Station for the<br \/>\n\toffences punishable under sections 406, 420, 467, 468, 469, 120(B)<br \/>\n\tand 114 of Indian Penal Code.\n<\/p>\n<p>That<br \/>\n\tthe respondent No.2 &#8211; original complainant has filed the First<br \/>\n\tInformation Report being CR No.I-165 of 2004 before the J.P. Road<br \/>\n\tPolice Station against the petitioners   &#8211; original accused, for the<br \/>\n\toffences punishable under sections 406, 420, 467, 468, 469, 120(B)<br \/>\n\tand 114 of Indian Penal Code on 17\/4\/2004  alleging inter-alia that<br \/>\n\tthe petitioners have concocted and forged one relinquishment<br \/>\n\tdocument with respect to the property in question and used  the same<br \/>\n\tas true and correct  knowingfully well that the same is forged and<br \/>\n\tconcocted one and the alleged signature of the complainant on the<br \/>\n\tsaid relinquishment deed, which was produced by the petitioners<br \/>\n\tbefore the revisional authority is not of that of the complainant.\n<\/p>\n<p>Before<br \/>\n\tany investigation could be done by the investigating<br \/>\n\tofficer, petitioners   preferred present petition and stay is<br \/>\n\tgranted against further investigation.\n<\/p>\n<p>Mr.S.P.\n<\/p>\n<p>\tMajmudar, learned advocate<br \/>\n\tappearing on behalf of the petitioners has stated at the bar<br \/>\n\tthat though pleaded in the petition, the petitioners are not praying<br \/>\n\tto quash and set aside the impugned First Information Report on the<br \/>\n\tground that civil proceedings are pending with respect to the very<br \/>\n\tdocuments. It is submitted that the petitioners are praying for<br \/>\n\tquashing the impugned First Information Report solely on the ground<br \/>\n\tof delay. Mr.Majmudar, learned<br \/>\n\tadvocate appearing on behalf of the petitioners  has relied<br \/>\n\tupon the decision of the Hon&#8217;ble<br \/>\n\tSupreme Court  in the case of Kishan Singh (Dead) Through<br \/>\n\tLRs. Versus Gurpal Singh  and others,  reported in 2011<br \/>\n\t(1) GLR 894 in support of his above submission. It is submitted<br \/>\n\tby Mr.Majmudar, learned advocate<br \/>\n\tappearing on behalf of the petitioners that as observed by<br \/>\n\tthe Hon&#8217;ble Supreme Court<br \/>\n\twhen  First Information Report has been lodged belatedly and\/or<br \/>\n\tthere is delay in lodging the First Information Report, the same<br \/>\n\tdeserves to be quashed and set aside.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates appearing on behalf of the respective<br \/>\n\tparties, at the outset, it is required to be noted that the<br \/>\n\tallegations against the petitioners in the impugned First<br \/>\n\tInformation Report are with respect to forging the signature of the<br \/>\n\tcomplainant and creating forged document of relinquishment of right<br \/>\n\tby the complainant in the property in question and the same was<br \/>\n\tproduced before the revenue authorities as true one. The<br \/>\n\tinvestigation is yet to be carried out and completed and even the<br \/>\n\tdocument in question is required to be sent to the Forensic Science<br \/>\n\tLaboratory and  it is yet to be ascertained whether the alleged<br \/>\n\tsignature of the complainant on the said document is that of the<br \/>\n\tcomplainant or not. Therefore,  at present it cannot be said that<br \/>\n\tthe petitioners   have not committed any offence, as  alleged. It is<br \/>\n\trequired to be noted that the learned<br \/>\n\tadvocate appearing on behalf of the petitioners has stated<br \/>\n\tthat he is not praying to stay and\/or to quash and set aside the<br \/>\n\timpugned First Information Report on the ground that  civil<br \/>\n\tproceedings by way of First Appeal are pending before this Court.<br \/>\n\tHowever, it is to be noted that in the Civil Suit filed with respect<br \/>\n\tto the very property, which was filed for partition, a Preliminary<br \/>\n\tDecree has been drawn disbelieving the document in question. This<br \/>\n\tcourt is not considering the aforesaid aspect in detail, as the<br \/>\n\tlearned advocate appearing on<br \/>\n\tbehalf of the petitioners has not made any submission on the<br \/>\n\tsame. Suffice it to say that the investigation with respect to the<br \/>\n\tdocument in question, which is alleged to have been forged one,  is<br \/>\n\tyet to be conducted by the investigating<br \/>\n\tofficer  and therefore, solely on the ground of delay,  First<br \/>\n\tInformation Report is not required to be quashed and set aside at<br \/>\n\tthe threshhold without any investigation. If on investigation the<br \/>\n\tallegations found to be true  and it is found that the signature on<br \/>\n\tthe relinquishment deed is not that of the complainant and the same<br \/>\n\tis forged one, the petitioners can be prosecuted, otherwise,<br \/>\n\tappropriate order can be passed.  Under the circumstances, even<br \/>\n\tconsidering the decision of the<br \/>\n\tHon&#8217;ble Supreme Court  in the case of  Kishan Singh (Dead)<br \/>\n\tThrough LRs. (supra) when the investigation is yet to be carried<br \/>\n\tout, this court is of the opinion that this is not a fit case to<br \/>\n\texercise powers under sec.482 of the Code of Criminal Procedure  and<br \/>\n\tto quash and set aside the impugned First Information Report, where<br \/>\n\tthe investigation is yet to be carried out.\n<\/p>\n<p>In<br \/>\n\tview of the above, present petition under<br \/>\n\tsection  482 to quash and set aside the<br \/>\n\taforesaid impugned First Information Report at the threshhold fails<br \/>\n\tand is accordingly dismissed. Rule is discharged.
