Deshpande, J. <\/p>\n<p> 1. Rule returnable forthwith. Taken up for final<br \/>\nhearing with the consent of the parties.\n<\/p>\n<p> 2. The Respondent No. 2 &#8211; Murlidhar Nagulwar,<br \/>\nmoved an application under Section 28 of the Maharashtra<br \/>\nRecognition of Trade Unions and Prevention of Unfair<br \/>\nLabour Practices Act, 1971, in Complaint ULP Case No.<br \/>\n1128 of 1990, alleging unfair labour practice on the part<br \/>\nof the present petitioners. This application was filed<br \/>\non October 30, 1990. During the pendency of the main<br \/>\nComplaint, an application was moved on September 8, 1998<br \/>\nat the instance of the respondent No. 2\/employee, seeking<br \/>\ncertain amendments, which was allowed by the learned<br \/>\nMember of the Industrial Court. However, subsequent<br \/>\napplication for amendment, which was moved on April 3,<br \/>\n2001, that was at the stage of evidence, appears to have<br \/>\nbeen rejected by the learned Member of the Industrial<br \/>\nCourt.\n<\/p>\n<p> 3. The evidence in the matter was recorded and it<br \/>\nwas over and the matter was closed for judgment on April<br \/>\n30, 2001. On the date when the Judgment was supposed to<br \/>\ncome out, the Respondent No. 2\/employee moved an application on the same day, again seeking an amendment as prayed for in the said application, as is clear from<br \/>\nthe record, which is definitely material and substantial,<br \/>\nto which the learned Member of the Industrial Court has<br \/>\nreferred to in para No. 1 of his order, which is under<br \/>\nchallenge.\n<\/p>\n<p> 4. The learned Member of the Industrial Court, in<br \/>\nspite of opposition by the petitioners, allowed the<br \/>\namendment application, observing that: if the amendment<br \/>\nwas not allowed, it would have resulted in<br \/>\nmultifariousness of the proceedings. The learned Member<br \/>\nof the Industrial Court further observed that:<br \/>\nAmendment, in ordinary course, should not be disallowed<br \/>\nonly on the ground of delay. He further observed that in<br \/>\nthe interest of justice, amendment could be allowed at<br \/>\nany stage and, therefore, allowing the amendment at the<br \/>\nstage of judgment or order could not be said to be wrong.<br \/>\nThe learned Member has referred to certain judgments<br \/>\ncited before him for reaching to the conclusion.\n<\/p>\n<p> 5. So far as regards proposition that amendment<br \/>\ncould be allowed at any stage is concerned, cannot be<br \/>\ndisputed. However, that would not mean that any type of<br \/>\namendment can be allowed at any stage. The presumption<br \/>\nis that, if an amendment has a direct nexus with the<br \/>\nresult of the case, then in that case, it could be said<br \/>\nthat the amendment could be allowed at any stage.<br \/>\nHowever, taking into consideration the present dispute,<br \/>\nit is absolutely clear that the reliefs under Item 9 of<br \/>\nSchedule IV of the MRTU and PULP Act, were not asked for<br \/>\nin the original Complaint. If the precise amendment is<br \/>\nread, it would show that amended portion is in prayer<br \/>\nclause 1, which is to the effect that: &#8221; allow the<br \/>\ncomplaint under Item 9 Schedule IV of the Maharashtra<br \/>\nRecognition of Trade Unions and Unfair Labour Practices<br \/>\nAct, as per Kalelkars Settlement Award,&#8221;. Besides this,<br \/>\nclause 5 is sought to be added by way of amendment, which<br \/>\nreads as under:\n<\/p>\n<p>  &#8220;The petitioner be converted as<br \/>\nKarkoon with effect from 1.5.1987<br \/>\nand difference of salary be<br \/>\nkindly allowed since 1.5.1987<br \/>\nonwards.&#8221;\n<\/p>\n<p> In the opinion of this Court, these are the precise<br \/>\namendments, as sought for by the respondent\/employee,<br \/>\nwhich definitely need a particular type of evidence to be<br \/>\nadduced by the parties, particularly when the original<br \/>\nprayer clause of the Complaint did not contain these<br \/>\nprayers, and further if the prayer clause is minutely<br \/>\nread, it would clearly show that but for seeking<br \/>\npromotion as Karkoon in a particular scale from lower<br \/>\nscale and that too from 23 April, 1990, is only asked for<br \/>\nwith difference in emoluments. In the opinion of this<br \/>\nCourt, amendment to clause 1 of the prayer clause, as<br \/>\nalso amendment to prayer clause 5, definitely would<br \/>\nchange the whole tenor of the dispute itself and such<br \/>\namendments at the belated stage of proceedings i.e.<br \/>\nvirtually at the time of pronouncement of the judgment,<br \/>\nshould not have been allowed.\n<\/p>\n<p> 6. It is well established principles of law that<br \/>\nthe present type of application could have been<br \/>\nentertained during the course of hearing of the matter.<br \/>\nHowever, when the matter having been closed for judgment,<br \/>\nafter adducing evidence by the parties concerned, and<br \/>\nparticularly, when the nature of the reliefs is being<br \/>\neither added or changed, for which there was no evidence<br \/>\nadduced by the parties, should not have been allowed by<br \/>\nthe learned Member of the Industrial Court.\n<\/p>\n<p> 7. In the circumstances, I see considerable<br \/>\nsubstance in this petition. The impugned order passed by<br \/>\nthe learned Member of the Industrial Court, allowing the<br \/>\namendment application, cannot be sustained in the eye of<br \/>\nlaw. In the opinion of this Court, it virtually amounted<br \/>\nto allowing the Complainant to fill in the lacunas which<br \/>\nwere already there in the original Complaint, that too<br \/>\nwhich is prejudicial to the interest of the present<br \/>\npetitioners.\n<\/p>\n<p> 8. In this view of the matter, the impugned order<br \/>\nof the learned Member of the Industrial Court is hereby<br \/>\nquashed and set aside. The learned Member of the<br \/>\nIndustrial Court shall proceed with the matter forgetting<br \/>\nthe amendments.\n<\/p>\n<p> 9.
