Justice V.GIRI\n\n Dated :21\/01\/2009\n\n O R D E R\n                  J.B.KOSHY, Ag.CJ &amp; V.GIRI, J.\n                  ===========================\n                       W.A.No.61 of 2007\n               ===============================\n            Dated this the 21st day of January, 2009.\n\n                        J U D G M E N T\n<\/pre>\n<p>Koshy, Ag.CJ.\n<\/p>\n<p>      According to the appellant, his property was sold while<\/p>\n<p>recovering amounts due to the bank under the Securitisation and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of Security<\/p>\n<p>Interest Act, 2002. He contends that the above action is without<\/p>\n<p>notice and without jurisdiction and the amount realised from the<\/p>\n<p>sale proceedings was meagre and has no reflection to the market<\/p>\n<p>value. The learned Single Judge directed the petitioner to avail<\/p>\n<p>remedies under the Securitisation and Reconstruction of Financial<\/p>\n<p>Assets and Enforcement of Security Interest Act, 2002 and the<\/p>\n<p>writ petition was not maintainable.      We see no ground to<\/p>\n<p>interfere in the impugned judgment.      Appellant has to file an<\/p>\n<p>application under Section 17 of the Act before the Debt Recovery<\/p>\n<p>Tribunal. However, we give three weeks&#8217; time to the appellant to<\/p>\n<p>file an application under Section 17 of the Securitisation and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of Security<\/p>\n<p>W.A.No.61 of 2007<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Interest Act, 2002 before the Debt Recovery Tribunal.
