No.57\/7, Srigandhadakavai--- Ah'?\/\"'i!1age,Vdfeshiyaijitiripdurp\n\nHobii, Bangalore North Taluihza'secoridnoti\ufb01clation dated\n17.6.2005 by the   theivpurpose of\nacquiring the said 1and..to_'-eridaloilpe  of a ring road\n\nand   the Government and yet\n11.4.2009 issued under section\n\n17[1j. gf  Bangalore'bevelopment Authority Act, 1976\n\ntheiitiangalorevvbeyeloprnent Authority, for the purpose\n\ni\"~of'~form-at-i.or1-router ring road and the petitioner claiming\n\novviiership.  all to an extent of 33 guntas of this survey\n\n  ' nurr1be1* in terms of a sale deed said to have been executed\n\n   \/by-Channa Narasimaiah on 19.8.1980. $\/\/ _\n\n\n\n4\n\n2. The contention of the petitioner is that his\nownership of an extent of 3 guntas of land in  said\n\nsurvey number has been unauthorizedly encroaefhed Iupon\n\nby the officials of the Bruhat Bangal.oreA4_:'fMahanagafad \n\nPalike for the purpose of deVelo:p4ing-..a.lto ''\nprocess sewerage flowing'  l \nBangalore city, but have  the\npetitioner for utilizatiorrof  land, but more\nimportantly ha'v'--eV_h Corrie' writ petition\nNo.15\"\/64 of    of 12 guntas of\nland  for a good measure\nhas sought   the Bangalore Development\n\nAuthorityh-.to \u00bb aliotil._a1t.e.rnative land in favour of the\n\n  petitioner of an \"ext.ent of 75% of the land in the ownership\n\nof the-.g'pe'titioner which has been acquired by the\n\nS2.ngaloreV'VdI)e{\/elopment Authority.\n\n Notices had been issued to the respondents.<\/pre>\n

Sri Muralidhar, learned counsel, and has filed its<\/p>\n
statement of objections.\n<\/p>\n
5. Similar is the stand taken by the
\nMahanagara Palike in WP No. l5764–.of
\npetitioner has contended that
\nhis ownership has also  rnisusedl  \u00e9ruhat
\nBangalore Mahanaga.rfa..y_    Bangalore
\nMahanagara Palike in such misuse,
\nbut asserting”:’that   was in the
\nownershgpilgf  and had been handed
\nover   Palike by the
\nofficials” etca: l  Bangalore Mahanagara<\/p>\n
Paliljie has eneroached on any part of the land in the<\/p>\n
 any belonging to the petitioner.\n<\/p>\n
 didV\\fhile’j__V..e:snbmission of Sri Guruprasad, learned<\/p>\n
l’V.,peounselifor the third respondent ~– Bangalore Developrneigt<\/p>\n
“:l:V’_Ant.h_ority in WP No.15764 of 2009 is that the authority<\/p>\n
  h\ufb01ad compensated the petitioner in a sum of ? 22,17,294\/–<\/p>\n
towards the industrial shed and has remained blissfully<\/p>\n

silent about other prayer sought for by the petitioner,
\nnamely, for providing an alternative site to the petitioner
\nin lieu of his land acquired for the purpose____ of the<\/p>\n
Bangalore Development Authority.\n<\/p>\n
7. Likewise in WP NO22748 or2oo9_,.\n<\/p>\n
counsel for the third respondent;  :4′
\nAuthority, while submits th’at_V.she”*i,_sdnot
\nregard to the possibility of  anaiternative site to
\nthe petitioner, subxnviggi\ufb01otl  relief regarding<\/p>\n
direction to conduct a,~joi1it”psurv’ey etc, “is concerned, such<\/p>\n
relief    before the civil court and<\/p>\n
not before \ufb01ns’   <\/p>\n
  8.  Iihave heard__..Sri Karan Boraiah, learned counsel for<\/p>\n
 Vthe”pe’t.itiori\u00bber–and other counsel who have appeared for<\/p>\n
the llresponi\u00e9ielnts.\n<\/p>\n
 9.  Karan Boraiah, learned Counsel for the petitioner<\/p>\n
 submit that while the petitioner is not provided<\/p>\n
   _y_Cfompensation in respect of the land portion, but has only<\/p>\n
been compensated with building area in 10 guntas of land<\/p>\n

acquired by the Bangalore Development Authority in the
\nyear 2005 and therefore writ of mandamus should be
\nissued to the authority to compensate the petitioner for
\nthe value of the land, insofar as silence of the aujtiiofritygpfor<\/p>\n
granting an alternative site is concerned, subi’nits:’that”_the. 4_<\/p>\n

10. Sri iiieiarned counsel appearing for the<\/p>\n
 authority points. that it is not a resolution, but a note<\/p>\n
  Assistant Executive Engineer of the<\/p>\n
 is neither a resolution nor binding on the<\/p>\n
 authorityl\u00e9but some note put up by some lower level<\/p>\n
A  does not have much signi\ufb01cance to bind the<\/p>\n
  authority etc..\n<\/p>\n

ll. Insofar as the quantum of compensation is
\nconcerned, while a writ of mandamus is not sought for, for
\ncompensating the petitioner on the premise that no award<\/p>\n
is passed etc., if the award is passed in fa\\rour”‘p:\u00abof*,,’the
\npetitioner, it is open to the petitioner to execute
\nand realize the amount in acCo1’da11c.e’   1′.
\ncourt cannot be made use of  <\/p>\n
as executing court to implenientypthehxawardsif\n<\/p>\n
12. Insofar as the prayer “‘or,V_i*eguest .. for allotment of<\/p>\n
alternative site is concerned,  3W1=itvviofimandarnus cannot<\/p>\n
be issued for-the simple reason that the
\npetitionler hasno’  to seek for such allotment of<\/p>\n
alternative site in the absence of any enabling statutory<\/p>\n
 13L___   for argument sake, the authority has<\/p>\n
passed-..’a iesolution to this effect. this court will not issue<\/p>\n
  a wifit of. mandamus to compel the authority to implement<\/p>\n
 the resolutions as the resolutions may be passed by<\/p>\n

the authority for whatever purpose and reasons, but it
\ndoes not have a statutory effect.\n<\/p>\n
14. In any View of the matter, none of prayers sought for
\nin the two writ petitions can be granted by thi-sj.enor
\npetitioner is entitled for seeking such
\ntouchstone of any statutory or constitutiona.l  it if\n<\/p>\n
15. It is therefore, while
\ndismissed, petitioner is  out his
\nother rights and remedies aac’cor’dance with<\/p>\n
law.\n<\/p>\n
16.  in which the officials of the<\/p>\n
Bangalore,__4I)eye1oprnent_.’e~ Authority appear to have paid<\/p>\n
 compensation’ ‘in_a____s1_.1rn of ? 22,17,294\/– in favour of the<\/p>\n
 ‘pVetition_ere infterms of the award appears to be a suspect<\/p>\n
payment \u00abfor reason that industry or shed said to have<\/p>\n
been yfaloufed at this amount is one on the bank of<\/p>\n
A “:tf”‘frushabhavati river and there cannot be any private<\/p>\n
  ownership of lands in the vicinity of a river and if at all the<\/p>\n
river and the surrounding land will be in the ownership of<\/p>\n

the State Government and not in any private ownership.
\nThe figuring of the petitioner’s name in the ‘lrevenule
\nrecords is the only basis for either
\nCommissioner or the land acquisition
\nthe Bangalore Development   l’

\ncollusive developments for petitioner
\nand even to allot  in favour of the
\nDetitioner in   to have been
\nacquired     the basis of the
\nentriesin.  or not, the lands
\norigina1,ly”  petitioner, but Claiming<\/p>\n
ownershipgnder stale”  of the year 1980 and even as<\/p>\n
 __to  the “vendor himself had such title to the land<\/p>\n
 are all”triatters–.which are suspicious and requires further<\/p>\n
and for such purpose, the matter is referred<\/p>\n
