Justice V.GIRI\n\n Dated :14\/01\/2008\n\n O R D E R\n                                V.GIRI, J\n\n                              -------------------\n\n                             R.P.1229\/2007\n\n                              --------------------\n\n           Dated this  the  14th  day of January, 2008\n\n\n                              JUDGMENT\n<\/pre>\n<p>       The   operative   direction   in   the   judgment     dated<\/p>\n<p>7.9.2007     to   the   respondents   is   only   to   disburse   the<\/p>\n<p>amount found    due  and admissible by way of DCRG   and<\/p>\n<p>arrears   of   salary.     Exts.P4     and   P6     orders     referred   to<\/p>\n<p>therein   shows   the petitioner as     Sub   Registrar.   R.P is<\/p>\n<p>filed only on two aspects.   Firstly   liability as regards the<\/p>\n<p>petitioner   is   concerned   is   yet   to   be   finalized.     Secondly<\/p>\n<p>though     the   petitioner   had   been   retired   as   Head   Clerk,<\/p>\n<p>this aspect was  not noticed in Exts.P4 and P6.<\/p>\n<p>2.     In   so   far   as   the   first   aspect   is   concerned,   direction<\/p>\n<p>was  only   to  disburse   the  amount   which   is   found   due   and<\/p>\n<p>admissible   provided   there   is   no   liability     fixed   on   the<\/p>\n<p>petitioner.     This   means   that   if   liability   is   fixed,   disbursal<\/p>\n<p>can only be   of the   amount due and admissible as DCRG<\/p>\n<p>less the amount fixed  as liability.  No further  clarification<\/p>\n<p>is necessary  in this regard.\n<\/p>\n<p>\nR.P.1229\/2007<\/p>\n<p><span class=\"hidden_text\">                                      2<\/span><\/p>\n<p>        In so far as  the  contention that Ext.P4 and P6  did<\/p>\n<p>not   reflect     the   petitioner&#8217;s     status     as   Head   Clerk,   is<\/p>\n<p>concerned,     I   am   of   the   view,     that   this   could   only   be<\/p>\n<p>treated   as   an   error     that     would   be   amenable   to<\/p>\n<p>correction     by   the   appropriate   authority.
