 State P.P. for the State praying that this Horfble Court may<\/p>\n
be pleased to grant leave to \ufb01le an appeal against the
\nJudgment dated 17.02.2004 passed by the R0,, Fast Track
\nCourt-II, Mandya, in S.C.No.30\/97, acquitting the<\/p>\n
\/\/A7′:\n<\/p>\n
respondent~accused for the offences punishable  :3:<\/p>\n
307 of IPC. The appellant\/State prays that theWa’ooVea.’order<\/p>\n
may be set aside.  2<\/p>\n

\nat Mandya in S.C.No.3G} respondent for
\nthe offence     State has filed this
\nappeal. I  1 1 A 3 <\/p>\n
 I . The .\u00bbthe prosecution is that on<\/p>\n
14.1_l.199t3~. in the–.nig,_ht about 2’0 clock the resondent is<\/p>\n
 ‘~  A  .haveA’varo–:1gful1y con\ufb01ned CW1 — Prema locking the<\/p>\n
‘ :front the house where she was sleeping with CW2 —<\/p>\n
.Mo1lAegoW’d5al..and CW3 – Puttamma and thereby he has<\/p>\n
 corhmitted an offence U \/ s.342 of IPC.<\/p>\n
 3. It is further alleged against the respondent as on<\/p>\n
  .. ___the said date, place and time, he removed the tiles of the<\/p>\n
house where CW1 to CW3 were sleeping and with the help of<\/p>\n
torch light, he poured kerosene on CW} and threw a burning<\/p>\n
Q’<\/p>\n
\/\/5′<\/p>\n
match stick on her with an intention or knowledge that if by
\nthat act he had caused the death of CW1 he wouid have<\/p>\n
been guilty of murder and thereby committed :’0.f_t’e.I_1ce<\/p>\n
U\/s.3(}7 of IPC. The prosecution in order <\/p>\n
has examined PW1 to PW11 and; got rnar’ked’-iE::st;}?1″to  <\/p>\n
and produced M.Os.1 to 9. After hearing. ‘arid<\/p>\n
the defence. which is one oftttctal denial. the’v:tria1…C9u.:rt <\/p>\n
acquitted the respondent of  oifencesgtcharged against
\nhim. Hence, the State  tiled <\/p>\n
 I .  thejinjured Prema and she has stated
\nbefore the Court that. marriage has taken place about<\/p>\n
13 years prio’r.t_othe date of incident and they have got a son<\/p>\n
   m;_ed–lock and he is aged about 11 years and his<\/p>\n
A  ‘V  and the accused treated her well for two<\/p>\n
yearsthe marriage and her son was born during that<\/p>\n
 up period… and after the birth of her son the accused started<\/p>\n
  “E-ivihg at Bangalore. Thereafter, there was dispute between<\/p>\n
them and therefore, the respondent started iiving separately.<\/p>\n
It is alleged that she had filed O.S.No.153\/ 1994 on the file of<\/p>\n
Munsiff. Nagamangala and the court has directed the<\/p>\n
V’<\/p>\n
\/X<\/p>\n
respondent to pay monthly maintenance of Rs.400\/-to PW1.<\/p>\n
During the pendency of the suit, on <\/p>\n
complainant attended the court along with her  :’.1_”11e’\u00bb.’<\/p>\n
respondent was also present before the  d’-a.y.u’<\/p>\n
The court had directed the respondent   <\/p>\n
towards conveyance of acctised  it<\/p>\n
After they came horne; at  2,00  all the
\nmembers of the family\u00abwere:sleeping:”in”the house, she saw<\/p>\n
the respondentr.remoyingthe ‘itiiestt  ‘roof at the place<\/p>\n
Wherettshe “poured kerosene on her using
\ntorchvv\ufb02lightt “~Sh\ufb01:diliillediately Woke up and saw
\nrespondent dpo-uringiker-‘esene from the terrace and she cried<\/p>\n
  her AAclotht.si’were damped with kerosene. In this<\/p>\n
‘ v:,connection.s’t1e had filed complaint before the police on the<\/p>\n
7′,’1.e’:~2t  is the complaint.\n<\/p>\n
it ..  V PW2 is the father of PW1. He has stated that his<\/p>\n
‘ ‘~ daughter was deserted by the respondent and she is living in<\/p>\n
“Bangalore and he has stated that as on the date of the<\/p>\n
 offence, they had gone to the Court and on the night at 2’0<\/p>\n
clock, he came to know through PW} that the respondent<\/p>\n
P<\/p>\n
\/\/7’<\/p>\n
had poured kerosene on her through terrace by removing
\ntiles and thereafter he came out from the hougse, and<\/p>\n
subsequently lodged the complaint against the…r\u00a7s;\u00a7\u00a7\ufb01a\u00a2r;:p.<\/p>\n
PW3 — Puttaswamygowda is a neighbour.   q <\/p>\n
has turned hostile to the case e5fmthe\u00abprose;cuticn,_VP;W4”.~–<\/p>\n
Jayaramu is also another neighhourgvvhotttlias <\/p>\n
noise in the house of PW1 and.._vvhen he went.n_eai’=Vthe house. V<\/p>\n
he saw accused getting..down”‘f1’o;ni the roof of~M’ol1egowda’s<\/p>\n
house. Immediately, “‘h:;mse1r\u00a7’i’\u00bb  and others<\/p>\n
surroundedZifimdu”caughtgwhiin and at that time, they
\nobserved.’ .people*V:’.”gathered:”‘there broke open the door by
\nbreakingwtthe iockanti ttthetreafter they observed that kerosene<\/p>\n
 dropped fr”0rn…_th’e terrace of the house of Mollegowda.<\/p>\n
‘  PWI were also damped with kerosene. There<\/p>\n
“Was kerosene lamp near the scene of occurrence. PW5 is<\/p>\n
Boregowdhax, signatory to Ex.P.2 seizing torch light, plastic<\/p>\n
2  A’ and match box. PW6 is another eyewitness who<\/p>\n
ta’-corroborates the evidence of PW1 and PW2. PW?’ has turned<\/p>\n
‘uthostile to the case of the prosecution. PW8 is the relative of<\/p>\n
PW}. She has stated that she heard that accused poured<\/p>\n
kerosene on PW1, however she has turned hostile to thiei.case<\/p>\n
of the prosecution.  ” t t<\/p>\n
6. PW9 has also not supported <\/p>\n
‘case dot” the V’ <\/p>\n
prosecution. PWIO is the Circlednspector ,:w:;IVi’O b<\/p>\n
registered the case in Crime  the <\/p>\n
U\/s.3-42 and 307 of IPC a11d””~transniitted_:the”–.i5IR to the”<\/p>\n
Court. He has conducted investigation inhthe znatter and
\nafter receiving necessaiy handed over further
\ninvestigation to’P__SI   the PSI who has<\/p>\n
co:mp.,iete_d–  and filed charge sheet against
\nthe respondent;.  consideration of evidence of all these<\/p>\n
witpnesspes, .the_:1earned Sessions Judge has found that the<\/p>\n
  notmguiity for the offence for which he was<\/p>\n
   the respondent.\n<\/p>\n
 p   Heard Sri P.M. Nawaz, learned SPP and<\/p>\n
  ” S..’\u00a3\u00a7.Venkatareddy learned counsel for the respondent.<\/p>\n
8. On careful scrutiny of the papers produced by<\/p>\n
the prosecution, it is seen that the version of PW} in so far<\/p>\n
as incident is concerned, has not been properiy supported by<\/p>\n
other circumstances of the case. FIR has been_..lodged<\/p>\n
belatedly while the incident has taken place at 2. on<\/p>\n
14.11.1995 and the police station is at the distance’, <\/p>\n
and the complaint has been lodged. in th_e.lpolice\u00bb  <\/p>\n
5.30 pm. almost after about 15  from  :.tin.ie-i_of<\/p>\n
occurrence. If at all, the ‘heinouvs ioffencel <\/p>\n
by the respondent, she Wouldyhayer.imrnediatelyflodged the
\nFIR in the early  ‘Uh’-nder;htlic;-cit’cumstance, delay of<\/p>\n
15 hours to lodge  Police is fatal to<\/p>\n
the case lithe:f?.;prols’ecution..””Further, there is no injury
\ncaused  “has not been examined by any
\ndoctor to”gsh’ow that injuries are caused on her. The<\/p>\n
 neihgl1b.o.urvers PW1, PW3 and PW? and PW9 have<\/p>\n
‘ snot,  the case of the prosecution. The Witnesses<\/p>\n
” Wlilo hav\u00e9\u00e9j supported the prosecution version are only parents<\/p>\n
and relatives.\n<\/p>\n
On re–appreciation of the entire materials on record,<\/p>\n
we hold that the prosecution has not been successful in<\/p>\n
bringing home the guilt of the accused. Therefore, we do not<\/p>\n
‘a<\/p>\n
