Muneshwari Kuwar\n                                         Versus\n                                  Hira Muni Devi\n                            ----------------------------------\n<\/pre>\n<p>8   13-9-2011            I.A.No. 4410 of 2011<\/p>\n<p>                          This Interlocutory application has been filed on<\/p>\n<p>                behalf of the petitioner praying for stay of the further<\/p>\n<p>                proceeding in T.S.No. 1 of 2005 pending in the court of<\/p>\n<p>                Subordinate Judge III, Buxar, till the disposal of this<\/p>\n<p>                revision application. However, with the consent of the<\/p>\n<p>                parties this revision application itself is being finally<\/p>\n<p>                disposed of at this stage.\n<\/p>\n<p>                          The Title Suit No. 1 of 2005 has been filed by the<\/p>\n<p>                plaintiff-opposite party for specific performance of contract<\/p>\n<p>                . The defendant-petitioner appeared and filed the written<\/p>\n<p>                statement contesting the claim of the plaintiff on various<\/p>\n<p>                grounds including the enforceability of the agreement for<\/p>\n<p>                sale, relied upon by the plaintiff, for want of registration.<\/p>\n<p>                From the impugned order it appears that the issues in the<\/p>\n<p>                suit have been framed on 13-2-2007 which also include the<\/p>\n<p>                issue regarding the maintainability of the suit. A<\/p>\n<p>                supplementary affidavit has been filed on behalf of the<\/p>\n<p>                petitioner wherein it has been stated that the evidence of the<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>plaintiff was closed on 3-1-2011 and the evidence of the<\/p>\n<p>defendant was closed before 10-8-2011. It has been further<\/p>\n<p>stated that the proceeding had been adjoured for argument<\/p>\n<p>to 8-9-2011. The learned counsel appearing on behalf of the<\/p>\n<p>opposite party has informed that as per his instruction the<\/p>\n<p>next date for argument has been fixed to 23-9-11 in the suit.<\/p>\n<p>          Both the parties have agreed that this revision<\/p>\n<p>application be disposed of with a direction to the court<\/p>\n<p>below to consider the objection raised by the petitioner in<\/p>\n<p>his petition dated 7-5-2007.\n<\/p>\n<p>          In view of the aforesaid facts, particularly the fact<\/p>\n<p>that the hearing of the suit has reached to a very advanced<\/p>\n<p>stage where only the argument is to be done by the parties,<\/p>\n<p>it would be just and proper that the learned court below be<\/p>\n<p>directed to consider the objections raised by the petitioner in<\/p>\n<p>his petition dated 7-5-2007 at the time of hearing the<\/p>\n<p>argument and delivering the judgment.This Court directs<\/p>\n<p>accordingly.\n<\/p>\n<p>          With these directions this revision application is<\/p>\n<p>disposed of.\n<\/p>\n<p>          It may be recorded that this Court has not<\/p>\n<p>expressed any opinion on the merits of the objections raised<br \/>\n<span class=\"hidden_text\">                         3<\/span><\/p>\n<p>      by the defendant-petitioner in his petition dated 7-5-2007<\/p>\n<p>      and those objections shall be considered and decided by the<\/p>\n<p>      court below in accordance with law without being<\/p>\n<p>      prejudiced by this order.\n<\/p>\n<\/p>\n<p>                                      ( V.
