SIRI JAGAN, J.\n                   -----------------------------------\n                      W.P.(C) No.3758 OF 2008\n                 ---------------------------------------\n           Dated this the 15th day of December, 2010\n\n                                JUDGMENT\n<\/pre>\n<p>     The learned counsel for the petitioner has filed a memo to<\/p>\n<p>the following effect:<\/p>\n<blockquote><p>        &#8220;The above writ petition is filed seeking a declaration that<br \/>\n        petitioner is entitled to be considered as an employee who<br \/>\n        exercised option to become a member of the Fund<br \/>\n        constituted under the State Bank of Travancore (Employees)<br \/>\n        Pension Regulations 1995.       The above writ petition was<br \/>\n        admitted on 11.02.2008 and by an interim order the 3rd<br \/>\n        respondent    was    directed  to   disburse  the  employees<br \/>\n        contribution due to the petitioner. Now the 1st respondent by<br \/>\n        Circular No.21\/10 dated 17.09.2010 extended another option<br \/>\n        for pension in lieu of contributory Provident Fund to the non-<br \/>\n        optees, who were in service prior to 26.03.1996. However,<br \/>\n        the bank insists the withdrawal of the above writ petition as<br \/>\n        a precondition for accepting the option. In view of the above<br \/>\n        writ petition may be permitted to be withdrawn.&#8221;<\/p><\/blockquote>\n<p>     In view of the same, the writ petition is dismissed as<\/p>\n<p>withdrawn.\n<\/p>\n<\/p>\n<p>                                             S.
