Alka Rao\n                               v.\n                   State of Rajasthan &amp; Ors.\n\n       Date of Order<\/a>              ::          17 th October, 2008\n\n\n              HON'BLE MR.JUSTICE GOVIND MATHUR\n\nMr. Girish Sankhla, for the petitioner.\nMr. B.L.Bhati, for the respondents.\n                         ....\n\n\n\n            By an order dated 16.6.2008, the petitioner\n\nwas    transferred        from     Government         Senior     Secondary\n\nSchool, Posalia to Government Girls Senior Secondary\n\nSchool,     Sheoganj.       Her        transfer       from     Posalia    to\n\nSheoganj    was    made    at     her       own    request.    The   Deputy\n\nDirector,     Secondary         Education,         Jodhpur      passed   an\n\nanother     order       dated      28.6.2008          transferring       the\n\npetitioner       from   Government           Girls    Senior     Secondary\n\nSchool,     Sheoganj       to     Government          Senior     Secondary\n\nSchool, Sheoganj and by the same order one Harun Khan\n\nChhipa     was      transferred             from     Government      Senior\n\nSecondary     School,       Sheoganj          to     Government      Senior\n\nSecondary School, Posalia.\n\n\n\n            A challenge is given by the petitioner to\n\nthe order dated 28.6.2008 on the count that she has\n\nbeen     transferred        from           Government    Girls       Senior\n\nSecondary     School,       Sheoganj          to     Government      Senior\n\nSecondary School, Sheoganj to accommodate respondent\n\nNo.4 Narayan Lal Khandelwal at Government Girls Higher\n                                   2\n\nSecondary    School,   Sheoganj,       who    is    working        at   the\n\nschool concern from last number of years.\n\n\n\n            A reply to the writ petition has been filed\n\non behalf of the respondents stating therein that the\n\npetitioner was transferred from Posalia to Sheoganj at\n\nher own request, however, at Government Girls Senior\n\nSecondary School,      Sheoganj       due to       excess     of   Senior\n\nTeachers in the subject of Maths the petitioner was\n\naccommodated in    the     same   town       at   Government Senior\n\nSecondary School and as such the order impugned was\n\npassed in administrative exigency. It is also pointed\n\nout that only with a view to adjust the petitioner in\n\nSheoganj one Harun Khan Chhipa was transferred from\n\nGovernment    Senior     Secondary       School,          Sheoganj       to\n\nGovernment Senior Secondary School Posalia.\n\n\n\n            In view of the factual position above stated\n\nby the respondents, it is apparent that the transfer\n\nof   the      petitioner      was        made       absolutely           in\n\nadministrative    exigency    and      not    for       any   extraneous\n\nconsideration.    This      Court      was        not     required       to\n\ninterfere with an order of transfer unless that is in\n\nviolation of a statute or is an out come of malafides.\n\nNo such exigency exists in present case.
