(J)\n\nCITATION:\n JT 1996 (2)   358\t  1996 SCALE  (2)215\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t       O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     Application for impleadment is rejected.<br \/>\n     We\t have  heard  Shri  Venugopals\tlearned\t senior<br \/>\ncounsel\t   for\tthe  appellant\tand  also  the\tlearned<br \/>\ncounsel,  Shri\t Vaidyanathan,\t on   behalf   of   the<br \/>\nintervenor-said to  be devotee.\t The Division  Bench of<br \/>\nthe Kerala  High Court in the impugned order has stated<br \/>\nthat on\t November 2,  1995, the Court had chalked out a<br \/>\nprogramme to  conduct the  examinations and  interviews<br \/>\nfor  selection\tof  the\t candidates  to\t the  posts  of<br \/>\nlower\/upper division  clerks in Guruvayoor Dewaswom and<br \/>\nthe C.M.P.  has been filed for direction to entrust the<br \/>\nduty of setting out and printing of the question papers<br \/>\nfor the\t written test.\tAfter hearing  the counsel, the<br \/>\nCourt was  of the  view that  the  said\t responsibility<br \/>\ncould safely  be  entrusted  to\t the  Administrator  or<br \/>\nGuruvayoor Devaswom.  Accordingly the Administrator was<br \/>\ndirected to  get the  question paper  set by  competent<br \/>\npersons with  utmost secrecy.  The Court  also directed<br \/>\nthe Administrator  to get them printed for distribution<br \/>\nonly at\t the examination  center on  the  date\tof  the<br \/>\nwritten test.  Subsequently, on\t November  2,  1995  it<br \/>\ndirected the  conduct  of  interviews  by  a  committee<br \/>\nconsisting of  the Chairman,  the Administrator and Mr.<br \/>\nM. Gopalan,  member  of\t Guruvayoor  Devaswom  Managing<br \/>\nCommittee and  a practicing advocate of the High Court.<br \/>\nThe Director of Training, High Court was directed to be<br \/>\nas observer  in the  interview In  the\timpugned  order<br \/>\ndated 2.11.1995, the High Court has replaced Gopalan as<br \/>\nmember of  the committee  and ordered that the Director<br \/>\nshould be  one of  the members\tof the\tCommittee. This<br \/>\nlater order is now impugned in this appeal.\n<\/p>\n<p>     When the  matter had  come\t up  on\t 12.1.1996  for<br \/>\nadmission, the devotee sought to intervene. We directed<br \/>\nhim to\tfile an\t affidavit whether any allegations have<br \/>\nbeen made  against Mr.\tGopalan in  the High  Court for<br \/>\nbeing replaced with the Director and accordingly he had<br \/>\ntaken time.  Today, we\tare  informed  that  though  an<br \/>\naffidavit has  been prepared, that is not reflective of<br \/>\ncorrect facts and counsel had some contra<br \/>\ncoral instructions. We deprecate this tendency to file<br \/>\nan affidavit and to give oral contra instructions.Party<br \/>\nmust state  true and correct facts in the affidavit and<br \/>\nshould stand  by them  and take\t orders from the Court.<br \/>\nObviously, Shri\t Vaidyanathan has  correctly taken  the<br \/>\nresponsibility in  not filing  that affidavit  which is<br \/>\ninconsistent with  the oral  instructions. The\tdevotee<br \/>\ndoes not  have the  courage to make allegations against<br \/>\nGopalan. Under\tthese circumstances,  we proceed on the<br \/>\nfooting that  no allegations  have  been  made\tagainst<br \/>\nGopalan for  his being\treplaced with  the Director,  a<br \/>\nJudicial offence.\n<\/p>\n<p>     Shri Venugopal is right in his contention\tthat it<br \/>\nwould  be  salutary  to\t leave\tthe  selection\tto  the<br \/>\nSelection committee  constituted to conduct the written<br \/>\ntest  and  interview  of  the  candidates  without  any<br \/>\ninvolvement or active participation by the judicial arm<br \/>\nof the\tCourt in  the process  of selection.  It is not<br \/>\nproper for  the Court to associate itself with the said<br \/>\nprocess of  conducting the  examinations by  nominating<br \/>\nits judicial  officer  in  the\tprocess\t of  selection.<br \/>\nOtherwise, the\tCourt itself  would come into criticism<br \/>\nfor associating\t its officers  with  selection\tof  the<br \/>\ncandidates, in\tthe event  of allegations  made against<br \/>\nthe  said  selections.\tWe  find  great\t force\tin  the<br \/>\ncontention   of\t   Shri\t   Venugopal.\t Under\t  those<br \/>\ncircumstances, associating  a judicial officer with the<br \/>\nselection is  not conducive  and proper. In the absence<br \/>\nof any allegation against Gopalan and any indication to<br \/>\nthat effect  in the  order of  the High Court, we think<br \/>\nthat the  High Court  was not justified in removing him<br \/>\nfrom the Committee.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed,  but\tin  the<br \/>\ncircumstances. without costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Guruvayoor Devaswom Managing &#8230; vs Chairman, Guruvayoor &#8230; on 19 January, 1996 Equivalent citations: JT 1996 (2), 358 1996 SCALE (2)215 Author: K Ramaswamy Bench: Ramaswamy, K.
