DAVE\n\t\t\n\t\n\n \n\nDate\n: 22\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\n\tapplication is preferred against a well reasoned and considered<br \/>\n\torder passed by the Trial Court denying bail in exercise of powers<br \/>\n\tu\/s. 439 of the Code of Criminal Procedure, 1973 (in short &#8216;the<br \/>\n\tCode&#8217;) to the accused who is involved in<br \/>\n\tconnection with First Information Report registered as I-C.R.<br \/>\n\tNo.20\/2011 with Sector 7 Police Station, Gandhinagar for the<br \/>\n\toffences punishable u\/s. 323, 342, 364(A), 365, 387, 395, 504,<br \/>\n\t506(2) and 120(B) of the Indian Penal Code, u\/s. 25(1)B.A. of the<br \/>\n\tArms Act and u\/s. 135 of the Bombay Police Act.\n<\/p>\n<p>\tLearned<br \/>\n\tCounsel Mr. Adil Mehta appearing for the applicant would submit that<br \/>\n\tthe case of prosecution falls apart on the ground that the<br \/>\n\tidentification parade held by the investigating agency is farce and<br \/>\n\tthe manner in which the identification parade is held would not<br \/>\n\treveal an iota of material implicating the applicant accused with<br \/>\n\tthe crime. Besides, some statements recorded about the incidents of<br \/>\n\tcrime are also based on methods adopted by the police authority.
