P (C) No. 25311 of 2008\n               =-=-=-=-=-=-=-=-=--=-=-=-=-=-=-=-=-=\n                  Dated this, the   28th August, 2008.\n\n                            J U D G M E N T\n<\/pre>\n<p>      The petitioner&#8217;s father obtained a housing loan from the Kerala<\/p>\n<p>State Housing Board, repayment of which is in arrears.              The<\/p>\n<p>petitioner&#8217;s father is no more. Now the petitioner is required to pay<\/p>\n<p>the amounts. The petitioner seeks the benefit of one time settlement.<\/p>\n<p>In the above circumstances, I directed the standing counsel to obtain<\/p>\n<p>instructions as to for what amount the Housing Board is prepared to<\/p>\n<p>settle the loan account.\n<\/p>\n<p>      2. The standing counsel today submits that the total amount<\/p>\n<p>due from the petitioner would come to Rs. 1,23,015\/- and the Housing<\/p>\n<p>Board is willing to settle the account by accepting an amount of Rs.<\/p>\n<p>81,171\/- in full and final settlement of the loan account.   Counsel for<\/p>\n<p>the petitioner seeks permission to pay the amount in instalments.<\/p>\n<p>Having    heard both sides, I dispose of this writ petition with the<\/p>\n<p>following directions:\n<\/p>\n<p>      The petitioner shall pay an amount of Rs. 81,171\/- in five equal<\/p>\n<p>instalments payable on 1-9-2008, 3-10-2008, 1-11-2008, 1-12-2008<\/p>\n<p>and 31-12-2008. If the petitioner pays the instalments without any<\/p>\n<p>default on the due dates, further coercive proceedings for recovery<\/p>\n<p>shall be kept in abeyance. However, if the petitioner commits default<\/p>\n<p>in payment of any one instalment, it would be open to the respondents<\/p>\n<p>to recover the full amount of Rs. 1,23,015\/- in a lump sum with<\/p>\n<p>interest thereon without having to issue any fresh notice or<\/p>\n<p>proceedings in that regard.\n<\/p>\n<\/p>\n<p>                                          Sd\/- S.
