No.20784 of 2011\n\n                       Sudhir Kumar S\/O LATE HARI PRASAD R\/O\n                       MOHALLA-KATTHAKTAL, SHERSHAH ROAD, P.S\n                       ALAMGANJ, DISTRICT-PATNA.\n                                                  --PETITIONER\n                                      Versus\n\n                        The State Of Bihar                     --Opp.party\n\n2   19.07.2011<\/pre>\n<p>           Heard learned counsel for the petitioner and learned<\/p>\n<p>                 Additional Public Prosecutor for the State.<\/p>\n<p>                         Both the applications are taken together and they are<\/p>\n<p>                 being disposed of by this composite order.\n<\/p>\n<p>                         Petitioner Champa Devi is mother in law and<\/p>\n<p>                 petitioner Sudhir Kumar is the husband of the complainant<\/p>\n<p>                 and both are named in this case with allegation of demand of<\/p>\n<p>                 dowry, torture etc.    The husband has already filed one<\/p>\n<p>                 Matrimonial Case no. 104 of 2010        seeking restitution of<\/p>\n<p>                 conjugal rights before Principal Judge, Family Court, Patna<\/p>\n<p>                 and he intends to resume and continue the matrimonial life<\/p>\n<p>                 with the complainant with whom he had married after getting<\/p>\n<p>                 his earlier marriage dissolved vide order dated 29.04.2009 in<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          Matrimonial Case no. 277 of 2005 in the Court of Additional<\/p>\n<p>          Principal Judge, Family Court, Patna. In order to put force in<\/p>\n<p>          prayer for restitution further offer is made to pay Rs.500\/- per<\/p>\n<p>          month by way of interim maintenance by the husband subject<\/p>\n<p>          to any order by competent court.\n<\/p>\n<p>                  Considering the      facts and circumstances, the<\/p>\n<p>          petitioners, in the event of arrest or surrender within four<\/p>\n<p>          weeks of communication of the order,        are directed to be<\/p>\n<p>          enlarged on bail on furnishing bonds of Rs.10,000\/- (Rupees<\/p>\n<p>          ten thousand) with two sureties of the like amount each to the<\/p>\n<p>          satisfaction of Chief Judicial Magistrate, Patna, in Complaint<\/p>\n<p>          Case no. 193 of 2010, subject to the conditions laid down in<\/p>\n<p>          Section 438(2) of the Code of Criminal Procedure           with<\/p>\n<p>          additional condition that the husband shall pay Rs.500\/- per<\/p>\n<p>          month and shall remain present before both the courts below<\/p>\n<p>          on each and every date till disposal of the case.
