Suit No.37 of 1993 on the grounds set out<br \/>\n\tin the present Revision Application inter alia contending that both<br \/>\n\tthe Courts below have erred in holding that the applicant has<br \/>\n\tacquired suitable accommodation at Vishram Park. Similarly, both the<br \/>\n\tCourts below have erred in holding that the applicant-defendant is<br \/>\n\tnot using the rented premises for residential purpose and both the<br \/>\n\tCourts below have failed to appreciate the comparative hardships.\n<\/p>\n<p>Learned<br \/>\n\tcounsel, Mr.Nilesh Pandya referred to the both impugned Judgments of<br \/>\n\tboth the Courts below delivered in Civil Appeal No.89 of 1999 as<br \/>\n\twell as H.R.P. Suit No.37 of 1993. Referring to the material and<br \/>\n\tevidence and the discussion made in the impugned orders, he<br \/>\n\tsubmitted that the Courts below have committed an error in<br \/>\n\tappreciating the evidence while deciding about non-user as the<br \/>\n\telectricity consumption has been shown and the average, which has<br \/>\n\tnot taken, is not proper and the gas cylinder and the postal<br \/>\n\tcommunication are also received at the said address. He, therefore,<br \/>\n\tsubmitted that the ground of non-user by the applicant-original<br \/>\n\tdefendant-tenant has not been established and the Courts below have<br \/>\n\tcommitted an error.\n<\/p>\n<p>He<br \/>\n\talso submitted referring to the grounds mentioned in the Appeal<br \/>\n\tfiled before the lower appellate court, particularly, ground (e) and<br \/>\n\talso referring to the report of the Court Commissioner that it has<br \/>\n\tbeen wrongly exhibited and it could not have been relied upon. He<br \/>\n\thas referred to other grounds including ground (k) to emphasize that<br \/>\n\tthere is a discrepancy with regard to the area.\n<\/p>\n<p>He<br \/>\n\talso submitted that the family of the respondent-original<br \/>\n\tplaintiff-landlord of the present applicant is almost same and both<br \/>\n\tare having similar hardship, which  has not been appreciated. He,<br \/>\n\ttherefore, submitted that the present application may be allowed.\n<\/p>\n<p>Though<br \/>\n\tthe submissions have been made referring to these aspects, the<br \/>\n\tdetailed discussion by both the Courts below clearly establish about<br \/>\n\tthe fact that the applicant-original defendant-tenant was having<br \/>\n\talternate premises at Vishram Park, which has been established by<br \/>\n\tthe documentary evidence. Not only that, but there is some kind of<br \/>\n\tipse dixit of the respondent-tenant in making a proper<br \/>\n\tdisclosure, which has also been noted for the purpose of considering<br \/>\n\tthe conduct. Further, as could be seen while referring to the<br \/>\n\tdiscussion that the consumption for the electricity has been<br \/>\n\tconsidered for February, 1992 to December, 1994. Admittedly, the<br \/>\n\tvoters&#8217; list, Exh.27 for the Ellisbridge division shows the name of<br \/>\n\tthe members of the family of the applicant having residential<br \/>\n\tpremises at Vishram Park Society. There are other evidence also and<br \/>\n\ton the basis of such evidence, conclusion has been arrived at by<br \/>\n\tboth the Courts below about the non-user of the premises and<br \/>\n\tacquisition of the suitable accommodation by the applicant-tenant.\n<\/p>\n<p>Further,<br \/>\n\tthe submission made by the learned counsel, Mr.Pandya referring to<br \/>\n\tground (e) before the lower Court that the report of the Court<br \/>\n\tCommissioner has wrongly been exhibited cannot be accepted. The<br \/>\n\tlower appellate court has also considered this aspect and in any<br \/>\n\tview of the matter, as could be seen from the judgment of the lower<br \/>\n\tappellate court that the applicant had in fact chosen not to remain<br \/>\n\tpresent to protract litigation. The submission made by the learned<br \/>\n\tcounsel, Mr.Pandya that the Court Commissioner is not examined and,<br \/>\n\ttherefore, the evidence or the reliance placed on the report of the<br \/>\n\tCourt Commissioner could not have been made also cannot be accepted.<br \/>\n\tAs admittedly, the report has been made by the Court Commissioner,<br \/>\n\twhich has been exhibited and such contention does not appear to have<br \/>\n\tbeen taken before the lower appellate court. Therefore, other<br \/>\n\tcontentions also cannot be permitted. Moreover, ground of the<br \/>\n\tcomparative hardship and equal number of members is also<br \/>\n\tmisconceived as both the Courts below have considered the<br \/>\n\tcomparative hardship.\n<\/p>\n<p>Therefore,<br \/>\n\tmoot question, which is required to be considered is that when<br \/>\n\tadmittedly the applicant-tenant is having alternate accommodation,<br \/>\n\twhich he has been using and rented premises is not used, the decree<br \/>\n\tpassed by the lower Court in H.R.P. Suit No.37 of 1993 for eviction,<br \/>\n\twhich has been confirmed by the lower appellate court in Civil<br \/>\n\tAppeal calls for any interference in exercise of revisional<br \/>\n\tjurisdiction.  It cannot be said that the findings and conclusion<br \/>\n\tarrived at are perverse or based on extraneous consideration<br \/>\n\tresulting into miscarriage of justice. Therefore, in exercise of<br \/>\n\trevisional jurisdiction, it does not call for any interference with<br \/>\n\tthe impugned order considering the limited scope of revisional<br \/>\n\tjurisdiction.\n<\/p>\n<p>A<br \/>\n\tuseful reference can be made to the observation made by the Hon&#8217;ble<br \/>\n\tApex Court in a judgment reported in AIR 2008 SC 2607 in case<br \/>\n\tof Yunis Ali (Dead) Thru his L. Rs. V\/s Khursheed Akram,<br \/>\n\twherein it has been observed referring to the scope of exercise of<br \/>\n\tdiscretion under Section 115 of the Indian Penal Code as under :-\n<\/p>\n<p>\t&#8220;It<br \/>\n\tis well-settled position in law that under Section 115 of the Code<br \/>\n\tof Civil Procedure the High Court cannot re-appreciate the evidence<br \/>\n\tand cannot set aside the concurrent findings of the Courts below by<br \/>\n\ttaking a different view of the evidence. The High Court is empowered<br \/>\n\tonly to interfere with the findings of fact if the findings are<br \/>\n\tperverse or there has been a non-appreciation or non-consideration<br \/>\n\tof the material evidence on record by the courts below. Simply<br \/>\n\tbecause another view of the evidence may be taken is no ground by<br \/>\n\tthe High Court to interfere in its revisional jurisdiction.&#8221;\n<\/p>\n<p>Therefore,<br \/>\n\tin view of the findings given by both the Courts below, this Court<br \/>\n\tis not inclined to interfere with the impugned order and, hence, the<br \/>\n\tpresent Civil Revision Application deserves to be dismissed.\n<\/p>\n<p>Accordingly,<br \/>\n\tSecond Appeal stands dismissed.\n<\/p>\n<p>After<br \/>\n\tthe order was dictated, learned counsel, Mr.Pandya for the applicant<br \/>\n\thas requested for the stay of the order to enable applicant to<br \/>\n\tapproach the Hon&#8217;ble Apex Court. Therefore, the operation of the<br \/>\n\torder is stayed to enable the applicant to approach the Higher Forum<br \/>\n\tfor three weeks.
