SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/07\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 227 of the Constitution of India,<br \/>\n\tthe petitioner has prayed for appropriate writ, order and\/or<br \/>\n\tdirection &#8211; husband has challenged the impugned order<br \/>\n\tdtd.17\/11\/2009 passed by the learned Family Court, Rajkot  in<br \/>\n\tCriminal Misc.  Application No.219 of  of 2008, by which the learned<br \/>\n\tJudge has partly allowed the said application submitted by the<br \/>\n\trespondent Nos.2 and 3, under<br \/>\n\tsection  125 of the Code of Criminal Procedure<br \/>\n\tfor maintenance, and has directed  the petitioner\n<\/p>\n<p>\t &#8211; husband  to pay a sum of Rs.2500\/- per month to the<br \/>\n\trespondent No.2 &#8211; wife and Rs.1300\/- per month to the<br \/>\n\trespondent No.3 minor child, who was aged about 10 months, towards<br \/>\n\tmaintenance.\n<\/p>\n<p>Having<br \/>\n\theard Mr.Vishal Mehta, learned advocate appearing for Mr.A.J.<br \/>\n\tShastri, learned advocate appearing on behalf of the petitioner\n<\/p>\n<p>\t &#8211; husband, Mr.Ashwin Patel, learned advocate appearing for<br \/>\n\tMr.Sandip Bhatt, learned advocate appearing on behalf of the<br \/>\n\trespondent Nos.2 and 3 &#8211; wife and minor child and Mr.L.B.<br \/>\n\tDabhi, learned advocate appearing on behalf of the respondent No.1 &#8211;<br \/>\n\tState and considering the impugned order and considerings the fact<br \/>\n\tthat  the admittedly the  petitioner<br \/>\n\t is doing masonry<br \/>\n\twork, and hence he can earn at least Rs.200\/- to 250\/-<br \/>\n\tper day, and looking to the age of the respondent No.3 minor, and<br \/>\n\tconsidering the price rise and inflation,  in these hard days,<br \/>\n\tawarding of maintenance by the learned Family Court at the rate of<br \/>\n\tRs.2500\/- to the respondent No.2 wife, per month and Rs.1300\/- per<br \/>\n\tmonth to the respondent No.3 minor, in all Rs.2500\/- cannot be said<br \/>\n\tto be too excessive. The impugned order is just, legal and proper<br \/>\n\tand no interference of this Court is called for in exercise of<br \/>\n\tpowers under Article 227 of the Constitution<br \/>\n\tof India.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above, there is no<br \/>\n\tsubstance in the present petition, and the same deserves  to be<br \/>\n\tdismissed and is accordingly dismissed.
