Respondents\n\nPRAYER: Writ Petition came to be numbered by transfer of Original Application No.9625 of 1998 filed before the Tamil Nadu Administrative Tribunal, on abolition, transferred to this Court and renumbered as WP No. 37735 of 2006 to call for the records on the file of the Director of Technical Education in his proceedings Memo No.16390\/D5\/97, dated 16.12.97 and quash the same and direct the respondents to regularise the service of the applicant with effect from the date of initial appointment with all monetary and service benefits and with regular periodical increments and other benefits.  \n                              \n                    For Petitioner   \t  :  Mr.R. Sivashanmugam\n\t\t\t\t\t             Government Advocate \n\n                                                               \t\t\t\t  \t       \nO R D E R\n<\/pre>\n<p>\t\tThis writ petition is filed to call for the records on the file of the Director of Technical Education in his proceedings Memo No.16390\/D5\/97, dated 16.12.97 and quash the same and direct the respondents to regularise the service of the applicant with effect from the date of initial appointment with all monetary and service benefits and with regular periodical increments and other benefits.\n<\/p>\n<p>\t\t2.  Learned counsel for the petitioner submits that the petitioner\/watchman is seeking promotion to the post of Junior Assistant.   In this regard, the petitioner has made a representation and the same has been negatived by the Additional Director of Technical Education  in the impugned proceedings stating that his case will be considered at the time of his turn.  According to the petitioner, he is entitled to be considered for promotion taking into consideration his service from the date of appointment in terms of Government Order, which has come into operation subsequently.\n<\/p>\n<p>\t\t3.    In view of the changed circumstances and subsequent events, the petitioner is given liberty to make a representation to the first respondent to consider his claim in terms of the subsequent Government Order that may be applicable in respect of the petitioner&#8217;s claim.  Such representation as and when made, shall be considered and disposed of on merits by the first respondent  within three months from the date of such representation.
