Petitioners are the real brothers of R-1. They<br \/>\nare involved in a dispute regarding division of the<br \/>\nestate left by their mother one Madhu Rekha Sarin. They<br \/>\nfirst sought the intervention of some family elders to<br \/>\nresolve it but failed. Meanwhile, they are said to have<br \/>\nexecuted an agreement on 28.9.1999 for referring their<br \/>\ndisputes to the arbitration of two relatives which,<br \/>\nthough referred, could not be taken to the logical end.\n<\/p>\n<p>2. Petitioners thereafter filed AA 662\/99 for<br \/>\nappointment of a retired Judge as an arbitrator on the<br \/>\nbasis of one document dated 28.9.1999, claimed by them<br \/>\nto be the arbitration agreement. Their sister (R-1)<br \/>\ncontested this and disputed that this document did not<br \/>\namount to an arbitration agreement. The designated<br \/>\nauthority (Ld.Single Judge) on this passed order dated<br \/>\n20.10.2000 framing some issues in the matter on taking<br \/>\nthe view that existence of arbitration agreement was<br \/>\ndisputed.\n<\/p>\n<p>3. Petitioners filed a review petition (RA<br \/>\n44\/2000) against this on the plea that the Authority<br \/>\ncould not embark upon a judicial enquiry on the<br \/>\nexistence or otherwise of the arbitration agreement in<br \/>\nthe face of Supreme Court judgments in  <a href=\"\/doc\/1752565\/\">Konkan Railway<br \/>\nCorporation Ltd. v. Mehul Construction Company<\/a> ,  Nimet Resources Inc. v. S.R. Steel ,  <a href=\"\/doc\/1885814\/\">Malaysian Airlines Systems v. Stic Travels<\/a><br \/>\n(2000) 7 SCALE 724,  <a href=\"\/doc\/1604568\/\">Wellington Associates Limited v.<br \/>\nKirti Mehta  and  Konkan Railway<br \/>\nConstruction Ltd.<\/a> v. Rani Construction Pvt. Ltd.<br \/>\n2002 (1) SCALE 465. But this writ petition was<br \/>\ndismissed by order dated 9.10.2001 on the ground that<br \/>\npetitioners had not disclosed any &#8220;new and important<br \/>\nmatter&#8221;, as contemplated by Order 47 Rule 1 CPC.\n<\/p>\n<p>4. Petitioners challenge this and praying for<br \/>\nquashing of the impugned orders dated 20.10.2000 and<br \/>\n9.10.2001 passed by the Designated Authority and for<br \/>\nappointment of a retired Judge as an arbitrator. Their<br \/>\ncase is that these ran counter to the terms of Supreme<br \/>\nCourt judgments in  Konkan Railway Corporation and other<br \/>\ncited cases above. Their counsel Dr. Singhvi argued that<br \/>\nthe Designated Authority was only exercising an<br \/>\nadministrative power and not any adjudicatory power<br \/>\nwhile appointing an arbitrator and, therefore, could not<br \/>\nexamine the terms of any document to find out whether it<br \/>\namounted to an arbitration agreement or not. He also<br \/>\ncontended that the Authority had fallen in error by<br \/>\ndeclining to review its first order which contravened<br \/>\nthe terms of Supreme Court judgment amounting to an<br \/>\napparent error on the face of record.\n<\/p>\n<p>5. It is no more res integra that the order passed<br \/>\nby the Designated Authority under Section 8\/11 of the<br \/>\nArbitration &amp; Conciliation Act 1996 was an<br \/>\nadministrative order and not an adjudicatory one and<br \/>\nthat the Authority was not competent to entertain or<br \/>\ndecide any contentious issue between the parties in<br \/>\nthis. That being so, it becomes unnecessary to quote<br \/>\nextensively from the judgments cited at the bar to prove<br \/>\nthe obvious. However, it should suffice to quote from<br \/>\none of these judgments in  <a href=\"\/doc\/900646\/\">Konkan Railway Construction<br \/>\nLtd. v. Rani Construction Pvt. Ltd<\/a>:-\n<\/p>\n<p>  &#8220;There is nothing in Section 11 that<br \/>\nrequires the party other than the party making the<br \/>\nrequest to be noticed. It does not contemplate a<br \/>\nresponse from that other party. It dies not<br \/>\ncontemplate a decision by the Chief Justice or his<br \/>\ndesignate on any controversy that the other party<br \/>\nmay raise, even in regard to its failure to appoint<br \/>\nan arbitrator within the period of thirty days.<br \/>\nThat the Chief Justice or his designate has to make<br \/>\nthe nomination of an arbitrator only if the period<br \/>\nthe thirty days is over does not lead to the<br \/>\nconclusion that the decision to nominate is<br \/>\nadjudicatory.&#8221;\n<\/p>\n<p>6. Even so, the approach adopted by the Authority<br \/>\nat the relevant time could not be held to be wholly<br \/>\nunjustified as the legal position was in the flux at the<br \/>\nrelevant time. Therefore, adopting a via media to the<br \/>\nmutual satisfaction of the parties, we deem it<br \/>\nappropriate to dispose of this petition by the following<br \/>\norder:-\n<\/p>\n<p>  &#8220;Designated Authority is requested to<br \/>\nreconsider petitioners&#8217; AA No.662\/99 in the light<br \/>\nof the judgments of Supreme Court in  <a href=\"\/doc\/202973\/\">Konkan<br \/>\nRailways Corporation Ltd. v. Rani Construction<br \/>\nPvt. Ltd. and  Wellington Associates Ltd.<\/a> v.<br \/>\nKirti Mehta and any other judgment on the subject<br \/>\nmatter and pass appropriate orders for appointment<br \/>\nor otherwise of an arbitrator within one month from<br \/>\nthe date of first appearance of the parties<br \/>\ndisregarding the two impugned orders dated<br \/>\n20.10.2000 and 9.10.2001.&#8221;\n<\/p>\n<p>7.
