The Court was pleased to direct the respondents, its<br \/>\nofficers and\/or subordinates that they shall not dispossess the<br \/>\npetitioner till the decision in the matter, either for the allotment<br \/>\nof land on permanent basis or for extension of lease period of land,<br \/>\nis taken.\n<\/p>\n<p>2.2\tThe<br \/>\nlearned advocate for the petitioner invited attention of the Court to<br \/>\na Revision Application filed before the Deputy Secretary (Appeals),<br \/>\nwho passed an order dated 10th May 2000 and remanded the<br \/>\nmatter to the Collector, who decided the matter only on 10\/16-6-2004<br \/>\nand fixed the amount to be paid by the petitioner at Rs.6,250\/- i.e.<br \/>\n2\u00bd  times of Rs.2,500\/-.  The learned advocate submitted that<br \/>\nthe petitioner is asked to pay this amount because, in the year 1987,<br \/>\nhis application was rejected, while application of one Ratansinh was<br \/>\nallowed and he was granted land at Rs.80\/- per square meter.  It was<br \/>\nthis order of rejection of petitioner&#8217;s application and grant of<br \/>\nother person&#8217;s &#8211; Ratansinh application, was the subject matter<br \/>\nof Special Civil Application No. 2305 of 1988.\n<\/p>\n<p>2.3\tThe<br \/>\nlearned advocate for the petitioner submitted that the authorities<br \/>\nought to have decided the amount payable by the petitioner taking<br \/>\ninto consideration that order and taking into consideration the fact<br \/>\nthat the application of the petitioner is that of the year 1987.\n<\/p>\n<p>3.0\tThe<br \/>\nmatter requires consideration.  Rule.\n<\/p>\n<p>3.1\tInterim<br \/>\nrelief in terms of Para 8(C).  The Interim relief is<br \/>\ngranted on a condition that the petitioner shall continue to pay the<br \/>\namount, which he is paying as on date.\n<\/p>\n<p>3.2\tIt<br \/>\nis further clarified that pendency of this petition shall not<br \/>\npreclude the authorities from deciding the matter afresh and deciding<br \/>\nthe amount payable by the petitioner on the basis of his application<br \/>\nmade in the year 1987.\n<\/p>\n<p>3.3\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[<br \/>\nRavi R.
