He therefore submitted<br \/>\n\tthat the petitioners have already approached concerned authorities<br \/>\n\tvide communication dated 7\/5\/2011, in addition thereto one more<br \/>\n\tdetailed representation be preferred and in such an event the Court<br \/>\n\tmay direct the authorities to decide the same in accordance with<br \/>\n\tlaw.\n<\/p>\n<p>Shri<br \/>\n\tSanjanwala also requests that let there be some time limit<br \/>\n\tprescribed to the authorities for deciding the same.\n<\/p>\n<p>This<br \/>\n\tCourt is of the view that the authorities, if vested with discretion<br \/>\n\tto grant permission of such development, cannot evince any inaction<br \/>\n\tby not responding to the request for permission. Though the<br \/>\n\tpermission is purely discretionary, and such request for permission<br \/>\n\tis considered strictly in accordance with the provision of GDCR,<br \/>\n\thence the petitioners are at liberty to make additional request by<br \/>\n\tway of another representation in continuation of their earlier<br \/>\n\trepresentation dated 7\/5\/2011 for seeking appropriate permission,<br \/>\n\tand if such representation is made within a week from today same<br \/>\n\tshall be decided within three weeks thereafter. In view of this,<br \/>\n\tShri Sanjanwala seeks permission to withdraw this petition at this<br \/>\n\tstage.  The permission as sought for is granted. Petition stands<br \/>\n\tdisposed of.  However, this order may not be construed as an opinion<br \/>\n\tof the Court on the challenge made by the petitioners in this<br \/>\n\tpetition.\n<\/p>\n<p>This<br \/>\n\torder is passed ex-parte, keeping in view the established principle<br \/>\n\tof law that the authority vested with discretionary power has to<br \/>\n\trespond to the request calling upon it to exercise the same, and<br \/>\n\tthis order therefore in any way be treated as an impediment, then,<br \/>\n\tit is open for the respondent authorities to approach this Court<br \/>\n\twith an appropriate application for modification and \/ or revocation<br \/>\n\tof the same.
