PUBLIC PROSECUTOR for Respondent(s) :\n2, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nMr.Prabhav Mehta, learned Advocate for the applicants and<br \/>\nMs.C.M.Shah, learned APP for respondent no.2 &#8211; State.\n<\/p>\n<p>2.\t\tPresent<br \/>\npetition is filed by the applicants,<br \/>\nto<br \/>\nquash the complaint being FIR dated 12.11.2010 being M.Case No.7 of<br \/>\n2010 registered with Chanasma Police Station for the offence<br \/>\npunishable under sections 363, 366, 380 and 114 of the Indian Peal<br \/>\nCode.  Respondent no.1-original complainant has filed the above<br \/>\ncomplaint alleging that his daughter (applicant no.2) got married<br \/>\nwith applicant no.1 against the will of parents.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by Mr.Mehta, learned Advocate for the applicants that<br \/>\nmarriage had taken place between applicant no.1 and applicant no.2.<br \/>\nWhen marriage took place both were major. It is also stated that both<br \/>\nare staying as husband and wife. It is also stated that as applicant<br \/>\nno.2 (daughter of respondent no.1 &#8211; original complainant) got<br \/>\nmarried against the will<br \/>\nof parents, false complaint is filed and therefore, it is requested<br \/>\nto allow present application.\n<\/p>\n<p>4.\t\tIt<br \/>\nis pertinent to note that at present applicant nos.1 and 2 are major<br \/>\nand even marriage certificate is also placed on record to show that<br \/>\nmarriage of applicants took place and at present they both are<br \/>\nstaying as husband and wife.\n<\/p>\n<p>5.\t\tReliance<br \/>\nis placed on a decision of the Apex Court reported in  (2000)<br \/>\n10 SCC 10 in the case of Fazle Gaffer Khan and Others v\/s. State of<br \/>\nW.B. and Another<br \/>\nwherein proceedings arising out of complaint for the offence under<br \/>\nsection 366 of IPC has been quashed. It has been held by the Apex<br \/>\nCourt in para 3 of the said judgment as under :-\n<\/p>\n<p>&#8220;3.\tThe<br \/>\nappellant faces criminal proceedings on a charge under section 366 of<br \/>\nIPC on the allegation that he kidnapped a minor girl. On the basis of<br \/>\nthe first information report(FIRT) the police took up the<br \/>\ninvestigation and submitted a final form. A protest petition being<br \/>\nfiled by the complainant, the Magistrate treated it as a complaint<br \/>\nand took cognizance. The accused moved the High Court under section<br \/>\n482 CrPC for quashing of the proceedings. The High Court having<br \/>\nrefused to quash the proceedings, the present appeal has been filed<br \/>\nin this Court. An affidavit of the girl has been filed clearly<br \/>\nstating therein that she was married to the appellant accused. In<br \/>\nview of such affidavit, the Court had issued notice pursuant to which<br \/>\nthe State entered appearance, but the complainant did not make any<br \/>\nappearance. In the light of the said affidavit of the girl admitting<br \/>\nthe marriage between her and the present appellant and the statement<br \/>\nmade by Ms.Indira Jaising, learned Senior Counsel appearing for the<br \/>\nappellant that a child has been born, we think it in the interest of<br \/>\njustice to quash the<br \/>\ncriminal proceedings. We, therefore, allow this appeal and direct<br \/>\nthat the criminal proceedings be quashed.&#8221;\n<\/p>\n<p>6.\t\tApplying<br \/>\nthe above ratio to the facts of the present case, as the victim who<br \/>\nis major has stated that she married to applicant no.1 and they are<br \/>\nstaying together as husband and wife under one roof, I am of the<br \/>\nopinion that no useful purpose would be served by permitting the<br \/>\ncriminal proceedings pending against the applicants to continue as it<br \/>\nwould be abuse of process of the Court. Hence, the complaint in<br \/>\nquestion is required to be quashed.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of above,  complaint being FIR dated 12.11.2010 being M.Case<br \/>\nNo.7 of 2010 registered with Chanasma Police Station and proceedings<br \/>\nthereunder are quashed.
