Jain, learned counsel with Shri A.D. Mishra,<br \/>\n           learned counsel for the appellant is heard on the question<br \/>\n           of admission.<\/p>\n<p>                   This is an appeal against the award dated 29.1.2010<br \/>\n           passed by the learned Claims Tribunal, Katni in Claim Case<br \/>\n           No.267\/2008 whereby the tribunal has awarded a sum of<br \/>\n           Rs.15,000\/- as compensation to the claimant-appellant.\n<\/p>\n<p>                   The appeal is for enhancement of the award, as<br \/>\n           according to the learned counsel for the appellant, a very<br \/>\n           meager sum has been awarded towards compensation<br \/>\n           though the claimant received grievous injuries on several<br \/>\n           parts of his body and there was a fracture on the right<br \/>\n           knee.\n<\/p>\n<p>                   After marshalling of the evidence the tribunal has<br \/>\n           come to the conclusion in para-11 of the award that no<br \/>\n           evidence was adduced in regard to the permanent<br \/>\n           disability. The appellant ought to have filed the X-ray<br \/>\n           report, disability certificate and the doctor who treated the<br \/>\n           appellant and assessed the disability ought to have been<br \/>\n           examined. In absence of the evidence as such, the<br \/>\n           disability is not found proved.\n<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p>                                           M.A. No. 2057\/2010<\/p>\n<p>       The Apex Court in Rajesh Kumar vs. Yaduvir and<br \/>\nothers, (2008) 7 SCC 305 has held that the disability<br \/>\ncannot be proved and the disability certificate is not<br \/>\nadmissible in evidence unless the doctor who has treated<br \/>\nthe injured and given the disability certificate is examined<br \/>\nbefore the Court and states as to on what basis the said<br \/>\nopinion with regard to disability is tendered.\n<\/p>\n<p>       In the present case, the tribunal has awarded a sum<br \/>\nof Rs.15,000\/- to the claimant as compensation. Keeping in<br \/>\nview the fact that the appellant has failed to prove any<br \/>\ndisability   in   the   accident,   the   sum    awarded   as<br \/>\ncompensation by the tribunal towards the grievous hurts is<br \/>\nproper.\n<\/p>\n<p>       In view of the aforesaid, I do not find any case for<br \/>\ninterference with the award passed by the tribunal. The<br \/>\nappeal is accordingly dismissed.\n<\/p>\n<p>                                    (R.K.
