Roy 'Raman' A.P.P.\n                 For the Informant         :       Mr. Sujit Kumar Singh, Adv.\n                                              ------------\n\n2.   29.7.2011                   Heard learned counsel for the petitioner and the\n\n                    State.\n\n<\/pre>\n<p>                                 The petitioner seeks bail in a case instituted for<\/p>\n<p>                    the offence under Sections 341, 323, 302 and 504\/34 of the<\/p>\n<p>                    Indian Penal Code.\n<\/p>\n<p>                                Considering that there is no direct material against<\/p>\n<p>                   the petitioner of having killed the deceased as also only one<\/p>\n<p>                   injury was found on the neck of the deceased in the post<\/p>\n<p>                   mortem examined report, let the petitioner above named, be<\/p>\n<p>                   released on bail on furnishing bail bond of Rs. 5,000\/- (Five<\/p>\n<p>                   thousand) with two sureties of the like amount each or any other<\/p>\n<p>                   surety to be fixed by the court concerned to the satisfaction of<\/p>\n<p>                   Chief Judicial Magistrate, Samastipur, in connection with Mehsi<\/p>\n<p>                   P.S. Case No. 40 of 2010 subject to the following conditions: (i)<\/p>\n<p>                   That one of the bailors will be a close relative of the petitioner,<\/p>\n<p>                   who will give an affidavit giving genealogy as to how he is<\/p>\n<p>                   related with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                   information to the court about any change in the address of the<\/p>\n<p>                   petitioner. (ii) That the affidavit shall clearly state that the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        petitioner is not an accused in any other case and, if he is, he<\/p>\n<p>        shall not be released on bail. (iii) That the bailor shall also state<\/p>\n<p>        on affidavit that he will inform the court concerned if the<\/p>\n<p>        petitioner is implicated in any other case of similar nature after<\/p>\n<p>        his release in the present case and thereafter the court below<\/p>\n<p>        will be at liberty to initiate the proceeding for cancellation of bail<\/p>\n<p>        on the ground of misuse. (iv) That the petitioner will give an<\/p>\n<p>        undertaking that he will receive the police papers on the given<\/p>\n<p>        date and be present on date fixed for charge and if he fails to<\/p>\n<p>        do so on two given dates and delays the trial in any manner, his<\/p>\n<p>        bail will be liable to be cancelled for reasons of misuse.
