KOSHY, Ag.C.J. &amp;\n                        V.GIRI, J.\n        -------------------------\n             W.P.(c).NO.1278 of 2009\n        -------------------------\n          Dated this the 23rd day of January, 2009.\n\n\n                       JUDGMENT\n<\/pre>\n<p>Koshy, Ag.C.J.\n<\/p>\n<\/p>\n<p>        It    is      submitted        by     counsel  for<\/p>\n<p>respondents 6 to 8 as well as respondents 3<\/p>\n<p>and 4 that they are not causing any problems.<\/p>\n<p>The  allegations        are     denied.       It   is also<\/p>\n<p>submitted that a portion of the puramboke land<\/p>\n<p>was encroached upon by the petitioner and<\/p>\n<p>Ext.R6(a)    mahazar        has     been      produced  by<\/p>\n<p>respondents 6 to 8 along with the counter<\/p>\n<p>affidavit.\n<\/p>\n<p>        2. It is submitted by the learned<\/p>\n<p>counsel for the petitioner that another writ<\/p>\n<p>petition    has     been      filed      regarding    that<\/p>\n<p>portion.   In the circumstances, before getting<\/p>\n<p>the  question     of     encroachment        decided,  the<\/p>\n<p>petitioner    will        not     make       any    further<\/p>\n<p>construction     in    the    disputed       portion.  The<\/p>\n<p>W.P.(c).NO.1278\/09<\/p>\n<p>                          :: 2 ::\n<\/p>\n<p>\npetitioner has to approach the appropriate<\/p>\n<p>court or local authority to resolve the<\/p>\n<p>dispute of encroachment.          Protection should<\/p>\n<p>be given to the petitioner and his wife and<\/p>\n<p>children     as   well     as    the    workers     and<\/p>\n<p>sufficient and effective protection should<\/p>\n<p>be given to the petitioner to run the hotel.<\/p>\n<p>         Writ    petition      is  disposed     of   as<\/p>\n<p>above.\n<\/p>\n<\/p>\n<p>                                        Sd\/-\n<\/p>\n<p>                                   (J.B.
