The respondent  sublet\nthe  plot to the appellant on a still higher rent.   In\t all\nthe  three  deeds of lease it was recited  that\t the  lessee\nmight  construct  buildings  on\t the  land  after  obtaining\nsanction  of the appropriate authority but on the  dates  of\nall the three leases the plot was assessed for\tagricultural\npurposes  under\t the Bombay Land Revenue  Code,\t 1879.\t The\nappellant obtained sanction of the Collector for  conversion\nof  user  of  the land to  non-agricultural  purposes.\t The\nappellant  thereafter applied to the court for\tfixation  of\nstandard  rent of the plot under 's.11 of the Bombay  Rents,\nHotel  and  Lodging  Houses Rates Control  Act,\t 1947.\t The\n'respondent  contended that the land when granted  in  lease\nbeing agriculture I, the provisions of the Act did not apply\nthereto.  The question which arose for decision was  whether\nthe  plot  of  land was 'Premises'  within  the\t meaning  of\ns.5(8)of the Act.\nHeld,  that the material date for ascertaining\twhether\t the\nplot  is 'premises' is the date of letting and not the\tdate\nof  the\t application for fixing the standard rent.   In\t the\npresent\t case the plot in dispute could not be\tregarded  as\n'premises'  under s. 5(8) of the Bombay Act on the  date  of\nletting\t and the application for fixation of  standard\trent\nwas not maintainable.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CIVIL APPELLATE JURISDICTION: Civil Appeal No. 356 of 58.<br \/>\nAppeal\tby special leave from the judgment and\torder  dated<br \/>\nJanuary 21, 1955, of the Bombay High Court in Civil Revision<br \/>\nApplication No. 813 of 1953.\n<\/p>\n<p>S. August 9. The judgment of the Court was delivered by<br \/>\nSHAH,  J.-Pot  No. 68 Town Planning Scheme  No.\t 1  Jamalpur<br \/>\nAhmedabad,  part  of  survey  No.  405\tMouje  Rajpur-Hirpur<br \/>\nadmeasuring approximately 38 Gunthas was owned by, Bai Jekor<br \/>\nand  her  two sisters.\tBy a lease dated October  15,  1934,<br \/>\nthis  plot  of land was granted in lease by  the  owners  in<br \/>\nperpetuity to Gajjar Ramanlal Gordhandas and his brother  at<br \/>\nannual\trental\tof Rs.558. The\tlesseesGajjars-sublet  by  a<br \/>\nlease dated February 7, 1946, the plot also in perpetuity to<br \/>\nNarsaji\t Chenaji  Marwadihereinafter  referred\tto  as\t the<br \/>\nrespondent-at an annual rental of Rs. 1,425.  The respondent<br \/>\nby  deed dated April 25, 1947, sublet the plot to  Subhadra-<br \/>\nhereinafter  referred  to  as the  appellant&#8211;it  an  annual<br \/>\nrental\tof  Rs.\t 2,225.\t In all these three  deeds,  it\t was<br \/>\nrecited that the lessees may construct buildings on the land<br \/>\nand for obtaining sanction in that behalf, the lessors shall<br \/>\nmake  applications to the Collector or any  other  authority<br \/>\nfor that purpose.  The plot on the dates of the three leases<br \/>\nwas  assessed for agricultural purposes.  Under\t the  Bombay<br \/>\nLand Revenue Code V of 1879, land assessed for\tagricultural<br \/>\npurposes  may  be  used\t for  non-agricultural\tpurpose\t  if<br \/>\npermission in that behalf is granted by the Collector.\t The<br \/>\nappellant  applied for permission for conversion of user  of<br \/>\nthe land to non-agricultural purposes, and the Collector  of<br \/>\nAhmedabad  by  order  dated November  11,  1949,  sanctioned<br \/>\nconversion  of\tthe  user.   Thereafter,  the  appellant  by<br \/>\napplication dated October 27, 1950, applied to the Court  of<br \/>\nSmall  Causes., Ahmedabad for fixation of standard  rent  of<br \/>\nthe plot under s. 11 of the Bombay Rents, Hotel and  Lodging<br \/>\nHouses Rates, Control Act 57 of 1947-hereinafter referred to<br \/>\nas  the\t Act.  The respondent contended that the  land\twhen<br \/>\ngranted\t in  lease  being agricultural,\t the  provisions  of<br \/>\nBombay\tAct did not apply thereto ;ad the  application,\t was<br \/>\nnot maintainable.  The<br \/>\n<span class=\"hidden_text\">100<\/span><br \/>\nCourt\tof  Small  Causes  upheld  the\tcontention  of\t the<br \/>\nrespondent  and dismissed the application.  This  order\t was<br \/>\nconfirmed  in appeal to the District Court at Ahmedabad\t and<br \/>\nin a revision application to the High Court of Judicature at<br \/>\nBombay.\t The, appellant has, with special leave, appealed to<br \/>\nthis court against the order of the High Court.<br \/>\nIt  is common ground that till November 11, 1949,  the\tplot<br \/>\nwas assessed for agricultural purposes under the Bombay Land<br \/>\nRevenue\t Code.\tIn the year 1947, the plot  was\t undoubtedly<br \/>\nlying  fallow,\tbut on that account, the user  of  the\tland<br \/>\ncannot be deemed to be altered.\t User of the land could only<br \/>\nbe altered by the order of the Collector granted under s. 65<br \/>\nof  the Bombay Land Revenue Code.  Section 11 of the  Bombay<br \/>\nAct  57 of 1947 enables a competent court  upon\t application<br \/>\nmade  to  it for that purpose to fix standard  rent  of\t any<br \/>\npremises.  But s.11 is in Part 11 of the Act and by s. 6 cl.<br \/>\n(1),  it is provided that in areas specified in\t Schedule  I<br \/>\nPart  II applies to premises let for  residence,  education,<br \/>\nbusiness,  trade or storage.  There is no dispute that\tPart<br \/>\nII  applied to the area in which the plot is situate  ;\t but<br \/>\nbefore\tthe  appellant\tcould maintain\tan  application\t for<br \/>\nfixation of standard rent under s. 11, she had to  establish<br \/>\nthat  the  plot\t of land leased was  &#8220;premises&#8221;\t within\t the<br \/>\nmeaning\t of  s.\t 5 (8) of the Act and that it  was  let\t for<br \/>\nresidence,  education, business, trade or storage.  For\t the<br \/>\npurposes  of  this  appeal, it is  unnecessary\tto  consider<br \/>\nwhether the plot was let for residence, education, business,<br \/>\ntrade or storage.  The expression &#8220;,premises&#8221; is defined  by<br \/>\ns. 5 (8) and the material part of the definition is :\n<\/p>\n<blockquote><p>\t      &#8220;In   this  Act,\tunless\tthere  is   anything<br \/>\n\t      repugnant to the subject or context  x x x x<br \/>\n\t      (8)   &#8220;&#8216;premises&#8221; means-\n<\/p><\/blockquote>\n<blockquote><p>\t       (a) any land not being used for\tagricultural<br \/>\n\t      purposes,<br \/>\n<span class=\"hidden_text\">\t      101<\/span>\n<\/p><\/blockquote>\n<blockquote><p>\t      (b)   any\t building or part of a building\t let<br \/>\n\t      separately   (other  than\t a  farm   building)<br \/>\n\t      including-\n<\/p><\/blockquote>\n<blockquote><p>\t      (i)   the\t garden, grounds, garages  and\tout-<br \/>\n\t      houses if any, appurtenant to such building or<br \/>\n\t      part of a building,\n<\/p><\/blockquote>\n<blockquote><p>\t      (ii)  any furniture I supplied by the landlord<br \/>\n\t      for  use\tin  such  building  or\tpart  of   a<br \/>\n\t      building,\n<\/p><\/blockquote>\n<blockquote><p>\t      (iii) any fittings affixed to such building or<br \/>\n\t      part  of\ta building for the  more  beneficial<br \/>\n\t      enjoyment thereof.\n<\/p><\/blockquote>\n<blockquote><p>\t      x\t      x\t      x\t      x<br \/>\nReading\t s. 5 sub-cl. (8) with s. 6(1), it is manifest\tthat<br \/>\nPart If of the Act can apply in areas specified in Sch.\t  II<br \/>\nto lands (not being used for agricultural purposes) let\t for<br \/>\nresidence,  education,\tbusiness,  trade  or  storage.\t The<br \/>\nmaterial   date\t for  ascertaining  whether  the   plot\t  is<br \/>\n&#8220;&#8216;premises&#8221; for purposes of s. 6 is the date of letting\t and<br \/>\nnot  the  date\ton which the  application  for\tfixation  of<br \/>\nstandard  rent\tis made by the tenant or the  landlord.\t  We<br \/>\nagree with the High Court that the plot in dispute could not<br \/>\nbe  regarded as &#8220;premises&#8221; inviting the application of\tPart<br \/>\nII of the Act.\tThe application filed by the appellant under<br \/>\ns.  11\tfor  fixation of standard  rent\t was  therefore\t not<br \/>\nmaintainable,<br \/>\nThe appeal fails and is dismissed with costs.\n<\/p><\/blockquote>\n<p>Appeal dismissed.\n<\/p>\n<p><span class=\"hidden_text\">102<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mst.
