The Report does not<br \/>\ngive proper details of the things. It simply says that wide publicity<br \/>\nwas given and private security agencies operating in the State were<br \/>\ninvited to submit the required data and information. He also submits<br \/>\nthat various private security agencies supplied the requisite<br \/>\ninformation and the State Government has identified and nominated<br \/>\nOfficers, not below the rank of Deputy Superintendent of Police, etc.<br \/>\nIt is also stated in the Report that the said Nodal Officers have<br \/>\nduly started verifying the antecedents of the persons retained by the<br \/>\nprivate security agencies and lastly that the Private Security<br \/>\nAgencies (Regulation) Act, 2005 has come into operation with effect<br \/>\nfrom 15th March, 2006.\n<\/p>\n<p>2.\t\tAgreeing<br \/>\nwith Honourable Mr.Justice. Jayant Patel, I would further say that<br \/>\nthe State Government on one side is issuing Circulars and<br \/>\nNotifications that what would be the minimum salary\/wages to be paid<br \/>\nto an unskilled labour or an employee, but, at the same time, has not<br \/>\ntaken care to look into the work and working of these security<br \/>\nagencies, which are recovering Rs.1,150\/- per security guard from the<br \/>\nOfficial Liquidator and after deducting a sum of Rs.250\/- from the<br \/>\nsaid amount, are paying Rs.900\/- only to such security guard. I have<br \/>\ncome across the statements of the security agencies wherein they have<br \/>\nsaid that to pay a sum of Rs.1,800\/- to a security guard, they are<br \/>\ntaking sixteen hours&#8217; duty from such person, are charging a sum of<br \/>\nRs.2,300\/- from the Official Liquidator and after deducting a sum of<br \/>\nRs.250\/- per salary or Rs.500\/- from the total payment, they are<br \/>\npaying Rs.1,800\/- to the security guard. According to the<br \/>\nNotifications, at least a sum of Rs.91\/- per day or Rs.2,700\/- and<br \/>\nodds per month is to be paid to an unskilled labour. If anything less<br \/>\nis paid by any  entrepreneur<br \/>\nor the person working with the Government, then, such person can be<br \/>\nexposed to criminal action, but, no actions are being taken by the<br \/>\nState Government even when it is brought to their notice that the<br \/>\nNotifications\/Circulars issued by the State Government are flouted<br \/>\nday and night. Even otherwise, sixteen hours&#8217; duty cannot be taken<br \/>\nfrom an employee. If a person is required to work for eight hours a<br \/>\nday, then, he cannot be asked to work for more than eight hours and<br \/>\nin case, he works for more than eight hours, then, he is required to<br \/>\nbe paid overtime. From the Report filed by the State Government, it<br \/>\ndoesn&#8217;t appear that all these aspects have been taken into<br \/>\nconsideration or that they have made any Rules or Regulations or,<br \/>\nwithin the sweep of the Minimum Wages Act they have covered the<br \/>\nsecurity<br \/>\nagency also. Put up on 27th April, 2006. In the<br \/>\nmeanwhile, the State Government shall look into the details and<br \/>\nsubmit its additional report.\n<\/p>\n<p>3.\t\tIt<br \/>\nis also to be noted that many times, reports are made to the Court<br \/>\neither through the purchaser of the property of the Company under<br \/>\nliquidation or through the Official Liquidator or through the<br \/>\nsecurity agency, that certain articles have been removed<br \/>\nsurreptitiously or theft has been<br \/>\ncommitted, in such cases, when reports are made to the Police,<br \/>\nunfortunately, the Police personnel or the concerned Inspector do not<br \/>\ntake appropriate action in the matter. In a case where the security<br \/>\nagency deploys the security guards and despite that, theft is<br \/>\ncommitted, then, an action in accordance with law has to be taken by<br \/>\nthe State Government, through its Home Department\/Police services.<br \/>\nThey cannot be allowed to say that as the matter is pending in the<br \/>\nCourt, they would sit idle and would not take any action.
