Sathasivam\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<\/p>\n<p>P. Sathasivam, J.\n<\/p>\n<p>1)\tThe plaintiffs who succeeded before the<br \/>\ntrial Court, lower appellate Court and<br \/>\nlost their suit before the High Court<br \/>\nfiled the above appeal.\n<\/p>\n<p>2)\tBrief facts required for the disposal<br \/>\nof this appeal are as follows:<br \/>\nAccording to the plaintiffs-appellants,<br \/>\nthey were in possession of the suit land<br \/>\nfor more than 40 years.  The suit was<br \/>\nfiled in 1989 for declaration of title on<br \/>\nthe ground of adverse possession and for<br \/>\ninjunction.  The trial Court decreed the<br \/>\nsuit and the appeal filed by the<br \/>\ndefendants was dismissed by the first<br \/>\nappellate Court.  When the second appeal<br \/>\nwas filed before the High Court, the High<br \/>\nCourt, after finding that there is no<br \/>\nevidence, remanded the matter to the trial<br \/>\nCourt for taking further evidence.  The<br \/>\nsaid order of the High Court was<br \/>\nchallenged before this Court by way of<br \/>\nC.A. No. 1348 of 1999.  By judgment dated<br \/>\n8.3.1999, this Court, after recording a<br \/>\nfinding that the High Court was in error<br \/>\nand not justified in sending the matter<br \/>\nback to cure any lacuna in the evidence,<br \/>\nset aside the order, restored Second<br \/>\nAppeal No. 304 of 1992 to the file of the<br \/>\nHigh Court and directed it to dispose of<br \/>\nthe same afresh on the available evidence.\n<\/p>\n<p>3)\tPursuant to the said direction, the<br \/>\nHigh Court formulated two substantial<br \/>\nquestions of law which are as under:\n<\/p>\n<p>1.\tWhether the suit was barred in view<br \/>\nof the provisions of Section 163(3)<br \/>\nof the H.P. Land Revenue Act, 1953?\n<\/p>\n<p>2.\tWhether the suit of the plaintiff, in<br \/>\nthe facts of the case that on 2nd<br \/>\nApril, 1970, an order of ejectment<br \/>\nwas passed ordering the ejectment of<br \/>\nthe plaintiff under Section 163 of<br \/>\nthe H.P. Land Revenue Act, 1954, can<br \/>\nbe said to be within the period of<br \/>\nlimitation?<\/p>\n<p>While considering the first question, the<br \/>\nHigh Court concluded that inasmuch as an<br \/>\norder of ejectment of the plaintiffs from<br \/>\nthe land in dispute under Section 163 of<br \/>\nthe H.P. Land Revenue Act, 1953 was passed<br \/>\non 2.4.1970 by the Settlement Officer, the<br \/>\nsuit having been filed about 19 years<br \/>\nafter such order is barred by limitation.<br \/>\nAfter arriving at such conclusion on<br \/>\nquestion No.1, the High Court, without<br \/>\ngoing into the second question or<br \/>\nadverting to the case of the plaintiffs<br \/>\ni.e., adverse possession, by order dated<br \/>\n04.01.2000, allowed the second appeal, set<br \/>\naside the judgments and decrees passed by<br \/>\nthe trial Court as well as by the lower<br \/>\nappellate Court and dismissed the suit of<br \/>\nthe plaintiffs as being time barred.<br \/>\nChallenging the said order, the plaintiffs<br \/>\nhave filed the present appeal.\n<\/p>\n<p>4)\tHeard Mr. Himinder Lal, learned counsel<br \/>\nappearing for the appellants and Mr. Vivek<br \/>\nSingh Attri, learned counsel appearing for<br \/>\nthe respondents.\n<\/p>\n<p>5)\tWe have already extracted the first<br \/>\nsubstantial question of law which relates<br \/>\nto limitation.  The High Court proceeded<br \/>\nthe said issue on the ground that though<br \/>\nthe order of ejectment of the plaintiffs<br \/>\nfrom the land in dispute came to be passed<br \/>\nby the Settlement Officer on 2.4.1970<br \/>\nhowever, the plaintiffs filed the Suit No.<br \/>\n41 of 1989 only on 23.2.1989 before the<br \/>\nSenior sub-Judge, Mandi which was barred<br \/>\nby limitation.  The High Court, in<br \/>\narriving at such a conclusion, relied on<br \/>\nSection 163 of the H.P. Land Revenue<br \/>\n(Amendment) Act No.15 of 1989.  Learned<br \/>\ncounsel for the respondents herein pointed<br \/>\nout that the order said to have been<br \/>\npassed on 2.4.1970 by the Settlement<br \/>\nOfficer was not communicated to them.  It<br \/>\nis also their claim that they were not<br \/>\nissued notice or afforded an opportunity<br \/>\nto put forth their case before making an<br \/>\nentry\/passing an order by the Settlement<br \/>\nOfficer.  In fact, neither before the<br \/>\nCourts below nor before the High Court,<br \/>\nthe proceedings dated 2.4.1970 was<br \/>\nproduced by the defendants.  In fact,<br \/>\nthere is no specific plea in the written<br \/>\nstatement as to the limitation and no<br \/>\nissue was framed by the trial Court and no<br \/>\npoint was determined by the lower<br \/>\nappellate Court.  We verify the defence<br \/>\nstated in the written statement, issues<br \/>\nframed by the trial Court and the points<br \/>\ndetermined by the lower appellate Court.<br \/>\nThere is no such plea and issue as to the<br \/>\nlimitation.  Though it would be open to<br \/>\nthe parties to the suit to raise the plea<br \/>\nof limitation before the High Court as<br \/>\npointed out earlier, the defendants have<br \/>\nnot taken any effort to place the alleged<br \/>\nproceedings dated 2.4.1970 of the<br \/>\nSettlement Officer.  It is not clear how<br \/>\nthe High Court arrived at a specific<br \/>\nconclusion that suit filed by the<br \/>\nplaintiffs was barred by limitation.  Even<br \/>\naccording to the defendants, the entire<br \/>\nrecords relating to the said proceedings<br \/>\nwere lost.  We have already referred to<br \/>\nthe fact that such issue was not raised<br \/>\nand argued before the Courts below.  On<br \/>\nthe other hand, the plaintiffs<br \/>\nconcentrated that they are entitled to<br \/>\ndecree in respect of the suit property<br \/>\nbased on the continuous and uninterrupted<br \/>\npossession for over a period of 40 years,<br \/>\nthat too, to the knowledge of the<br \/>\ndefendants.  In view of the assertion of<br \/>\nthe plaintiffs that they were neither<br \/>\nheard nor afforded an opportunity in the<br \/>\nalleged proceedings dated 2.4.1970, the<br \/>\nonus is on the defendants\/Department to<br \/>\nplace those relevant record to show that<br \/>\nthere was valid order by the competent<br \/>\nauthority.  Admittedly, such record was<br \/>\nnot called for and no material was placed<br \/>\nbefore the Courts below including the High<br \/>\nCourt.  On the other hand, based on the<br \/>\nacceptable oral and documentary evidence<br \/>\nregarding the claim of adverse possession,<br \/>\nthe trial Court decreed the suit which was<br \/>\naffirmed by the lower Court.  Inasmuch as<br \/>\nthe High Court dismissed the suit only on<br \/>\nthe ground of limitation and not gone into<br \/>\nthe claim of adverse possession by<br \/>\nplaintiffs, in view of our conclusion and<br \/>\ndisagreement with the High Courts<br \/>\ndecision, we have no other option except<br \/>\nto remand the matter once again to the<br \/>\nHigh Court for disposal of the second<br \/>\nappeal afresh in respect of other issue<br \/>\ni.e., adverse possession.\n<\/p>\n<p>6)\tUnder these circumstances, the judgment<br \/>\nand decree dated 4.1.2000 passed by the<br \/>\nHigh Court of Himachal Pradesh in R.S.A.<br \/>\nNo. 304 of 1992 is set aside and the<br \/>\nmatter is remitted to the High Court to<br \/>\ndecide the issue relating to adverse<br \/>\npossession.  However, it is made clear<br \/>\nthat except the finding relating to<br \/>\nlimitation, we have not expressed any<br \/>\nopinion on the conclusion of the courts<br \/>\nbelow relating to the other issues; hence<br \/>\nit is for the High Court to decide the<br \/>\nsame on merits one way or the other with<br \/>\nthe available materials.  Inasmuch as the<br \/>\nplaintiffs suit is of the year 1989 and<br \/>\neven the RSA is of the year 1992, we<br \/>\nrequest the High Court to dispose of the<br \/>\nmatter within a period of four months from<br \/>\nthe date of receipt of this judgment.\n<\/p>\n<p>7)\tThe appeal is allowed to the extent<br \/>\nmentioned above.
