Advocate\n\nHon'ble Shri Kant Tripathi,J.\n<\/pre>\n<p>Heard learned counsel for the applicant and the learned AGA<br \/>\nand perused the record.\n<\/p>\n<p>This is an application under section 482 of the Code of Criminal<br \/>\nProcedure for quashing the order dated 08.04.2008 passed by<br \/>\nthe IV-Additional Sessions Judge, Kanpur Dehat in Criminal<br \/>\nRevision No. 35 of 2004 (Ram Kumar Gupta v State of U.P.)<br \/>\nwhereby the Additional Sessions Judge dismissed the applicant&#8217;s<br \/>\nrevision and confirmed the order dated 25.02.2008 passed by the<br \/>\nChief Judicial Magistrate, Kanpur Dehat in Case Crime No. 13 of<br \/>\n2008 (State v Ram Milan &amp; others), under sections 364, 302, 201<br \/>\nand 120-B IPC, P.S. Kakvan, District Kanpur Dehat.<br \/>\nIt appears that the Chief Judicial Magistrate dismissed the<br \/>\napplicant&#8217;s application for release of his vehicle UP 74-B\/2216 on<br \/>\nthe ground that the vehicle was used for the commission of the<br \/>\noffences, under the aforesaid sections. The learned Additional<br \/>\nSessions Judge dismissed the revision on the ground that no<br \/>\ncase for interference was made out.\n<\/p>\n<p>It was not disputed before me that the applicant is the registered<br \/>\nowner of the aforesaid vehicle.\n<\/p>\n<p>The learned counsel for the applicant submitted that the<br \/>\naforesaid vehicle was no doubt, as per the allegations made in<br \/>\nthe charge sheet, involved in committing the aforesaid offences<br \/>\nbut the applicant is neither an accused nor he was in any way<br \/>\ninvolved in the commission of the offences. In fact the aforesaid<br \/>\nvehicle was being driven by the applicant&#8217;s driver and the<br \/>\napplicant had no knowledge that the vehicle was used by him for<br \/>\ncommitting the aforesaid offences.\n<\/p>\n<p>It was next submitted that in view of the principles of law<br \/>\npropounded in the case of Sunderbhai Ambalal Desai v State<br \/>\nof Gujrat [2003 AIR Supreme Court 638] it was not proper on<br \/>\nthe part of the courts below to refuse the handing over of the<br \/>\nvehicle in favour of the applicant. It was not desirable to keep the<br \/>\nvehicle at the Police Station. Atmost the courts below would have<br \/>\nasked for adequate security for ensuring the production of the<br \/>\nvehicle as and when required. Instead of doing so, the courts<br \/>\nbelow rejected the release application on altogether unwarranted<br \/>\n        grounds.\n<\/p>\n<p>       In the case of Sunderbhai Ambalal Desai (supra), the Apex<br \/>\n       Court has dealt with the similar matter and propounded the<br \/>\n       following principles of law:\n<\/p>\n<p>&#8220;The powers under S. 451 CrPC should be exercised<br \/>\nexpeditiously and judiciously. It would serve various<br \/>\npurposes, namely :-\n<\/p>\n<blockquote><p>    1. Owner of the article would not suffer because of<br \/>\n    its remaining unused or by its<br \/>\n    misappropriation.\n<\/p><\/blockquote>\n<blockquote><p>               2. Court or the police would not be required<br \/>\n                  to keep the article in safe custody.\n<\/p><\/blockquote>\n<blockquote><p>               3. If the proper panchanama before<br \/>\n                  handing over possession of article is<br \/>\n                  prepared, that can be used in evidence<br \/>\n                  instead of its production before the Court<br \/>\n                  during the trial. If necessary, evidence<br \/>\n                  could also be recorded describing the<br \/>\n                  nature of the property in detail; and\n<\/p><\/blockquote>\n<blockquote><p>                  4. The jurisdiction of the Court to record<br \/>\n                  evidence should be exercised promptly<br \/>\n                  so that there may not be further chance<br \/>\n                  of tampering with the articles.\n<\/p><\/blockquote>\n<blockquote><p>                 The Supreme Court further observed:<br \/>\n                 &#8230;&#8230;&#8230;\n<\/p><\/blockquote>\n<blockquote><p>      In our view, whatever be the situation, it is of no use to<br \/>\n      keep such seized vehicles at the police stations for a long<br \/>\n      period. It is for the Magistrate to pass appropriate orders<br \/>\n      immediately by taking appropriate bond and guarantee as<br \/>\n      well as security for return of the said vehicles, if required<br \/>\n      at any point of time. This can be done pending hearing of<br \/>\n      applications for return of such vehicles.<br \/>\n       It was also observed:\n<\/p><\/blockquote>\n<blockquote><p>      &#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>      &#8220;We hope and trust that the concerned Magistrate would<br \/>\n      take immediate action for seeing that powers under section<br \/>\n      451 Cr.PC are properly and promptly exercised and articles<br \/>\n      are not kept for a long time at the police station, in any<br \/>\n      case, for not more than fifteen days to one month. This<br \/>\n      object can also be achieved if there is proper supervision<br \/>\n      by the Registry of the concerned High Court in seeing that<br \/>\n      the rules framed by the High Court in seeing that the rules<br \/>\n      framed by the High Court with regard to such articles are<br \/>\n      implemented properly. &#8221;\n<\/p><\/blockquote>\n<p> Keeping in view the aforesaid principles and also the fact that the<br \/>\napplicant is the registered owner of the vehicle and is not an<br \/>\naccused in the case, I consider it just and expedient to direct the<br \/>\nconcerned Magistrate to release the aforesaid vehicle in favour of<br \/>\nthe applicant.\n<\/p>\n<p>The petition is allowed and the impugned order dated<br \/>\n08.04.2008 (annexure 5) and 25.02.2008 (annexure) are<br \/>\nquashed.
