{"id":76918,"date":"2011-08-17T00:00:00","date_gmt":"2011-08-16T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/mantu-mandal-vs-the-state-of-bihar-on-17-august-2011"},"modified":"2019-03-14T12:00:11","modified_gmt":"2019-03-14T06:30:11","slug":"mantu-mandal-vs-the-state-of-bihar-on-17-august-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/mantu-mandal-vs-the-state-of-bihar-on-17-august-2011","title":{"rendered":"Mantu Mandal vs The State Of Bihar on 17 August, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Mantu Mandal vs The State Of Bihar on 17 August, 2011<\/div>\n<pre>                       IN THE HIGH COURT OF JUDICATURE AT PATNA\n                            Criminal Miscellaneous No.2815 of 2011\n                                          Mantu Mandal\n                                               Versus\n                                      The State Of Bihar\n                                   ----------------------------------\n<\/pre>\n<p>5       17-08-2011               Heard learned counsel for the petitioner as well as<\/p>\n<p>                     learned Additional Public Prosecutor for the state.<\/p>\n<p>                                 Petitioner is in jail custody since 28.07.2010 in a<\/p>\n<p>                     case initially registered under Section-307 &amp; other minor<\/p>\n<p>                     sections of the Indian Penal Code but subsequently, section-<\/p>\n<p>                     302 of the Indian Penal Code was also added.<\/p>\n<p>                                 Allegedly, the petitioner and other accused put the<\/p>\n<p>                     informant in boiling water as a result of which, he sustained<\/p>\n<p>                     burn injuries on his whole body and subsequently, died in<\/p>\n<p>                     course of his treatment.\n<\/p>\n<p>                                 The fardbeyan of the informant is amounting to his<\/p>\n<p>                     dying declaration. The injury report as well as postmortem<\/p>\n<p>                     report of the informant corroborates the allegation.<\/p>\n<p>                                 Regard being had to the facts and circumstances of<\/p>\n<p>                     the case as well as submission of the parties, I am not inclined<\/p>\n<p>                     to release the petitioner on bail. Accordingly, his prayer for bail<\/p>\n<p>                     in connection with Parbatta P.S.
