In these two writ pe\ufb01\ufb01onsviieojntxnon i1uestions:&#8217;i)f fact and<br \/>\nlaw are raised. Hence,  toeether and are<\/p>\n<p>disposed of by this  . iv <\/p>\n<p>2. J..l..I.<\/p>\n<p>~&#8221;f&#8221;i&#8217;i.f&#8221;-\u00ab   the writ titions are assed<br \/>\nii at  <\/p>\n<p>i  _ separately,&#8217;  nature of the allegations made and the nature of<\/p>\n<p>  held is similar, hence it is felt appropriate to dispose of<\/p>\n<p> _ itheseicases together.\n<\/p>\n<p>&#8221; ii.&#8217; The facts ieatiing to these writ petitions, stated in nutsheii<\/p>\n<p>A are, that the petitioner in W.P.No.12061\/2006 and the<\/p>\n<p>8\/<\/p>\n<p>w.p.1:2oe1\/eooe C\/w<br \/>\nW.P.12062\/2006<br \/>\n<span class=\"hidden_text\">3<\/span><\/p>\n<p>&#8216;petitioner in W.P. No.12062\/ 2006 were elected as Members of<\/p>\n<p>the Taluk Panchayath, Belgaurn for a period of 5  the<\/p>\n<p>eleetious 1; -..d_ 9. ztnizizeesi 0:1. 316012905,  &#8216;;oi\u00e9e:&#8221;a-.1<\/p>\n<p>the &#8220;i&#8217;aIuKa&#8217; Panchayath was heid or;    goon. i&#8217;<\/p>\n<p>The Executive Officer of theV.eTa_iults&#8221;<br \/>\nmembers of the Taluka  iniiltilieiimeeting.\n<\/p>\n<p>The Executive ,.    and<br \/>\nUpadhyaksha and other  the Adhyaksha<\/p>\n<p>of the Taluka   proceedings of the<\/p>\n<p>(pe\ufb01tiouer   _i&#8217;:2Qf6~3..:]&#8217;tf2GO6) interrupted the proceedings<\/p>\n<p>and raised&#8217; the issu&#8217;e ofiuiiiiication of the area into Maharastra<\/p>\n<p> Siiizorfzii-:settleniei1tv&#8212;-e1&#8243;&#8221;the border dispute between Karnataka<\/p>\n<p>   for a long time and proposed a resolution for<\/p>\n<p>siibiiiissiorif petition to the Central Government and the<\/p>\n<p> Suprezneelclhoiurt in this matter. At this stage. &#8220;the Executive<\/p>\n<p><span class=\"hidden_text\">0<\/span><br \/>\nI<br \/>\n&#8220;B<br \/>\n<span class=\"hidden_text\">3<\/span><br \/>\n\u00a7<br \/>\nlie<br \/>\n1-O-\n<\/p>\n<p>J3.\n<\/p>\n<p>Fr<\/p>\n<p>-1<\/p>\n<p> permit the proposal to be tabieci for discussion as the subject<\/p>\n<p>did not come within the powers, functions and jurisdiction of<\/p>\n<p>L<\/p>\n<p>W<\/p>\n<p>W.P.12061\/2006 C\/w<br \/>\nW.P.1206&#8217;2\/2006<\/p>\n<p><span class=\"hidden_text\">4<\/span><\/p>\n<p>the Taluka Panchayath and that such a resolution will be<\/p>\n<p>illegal. He also informed that as the matter was  the<\/p>\n<p>Adhysksha permits.-:d the discusisn on t}1ect&#8217;*rf&#8217;s&#8217;r:&#8217;;V&#8217;n3r. <\/p>\n<p>the Member (petitioner in P.i\\io.1i;{&#8220;61.j 26.&#8217; 5),.&#8217; &#8216;ch &#8216;r=esu!_teci<\/p>\n<p>in serious protest from they o_ther&#8221;&#8221;members;'&#8221;&#8216;i~    ;<\/p>\n<p>pandemoniurn as the members  _shouet.inj; &#8216;slogans for and<br \/>\nagainst the proposal {\u00a74espite?&#8221;i.ei1&#8217;ottsV_  byuuthe Executive<br \/>\nO\ufb01icer to restore peace     of the<\/p>\n<p>meeting in a dtscip1iued::__ma1uier;~ it'&#8221;Was___Viiot possible as there<\/p>\n<p>was utter   E\ufb02izyrts ms-Me by Le E..ecI&#8230;.l.=&#8217;..<\/p>\n<p>O\ufb01iner tciicnunvhsce &#8220;*0 M&#8221;&#8221;&#8216;&#8221;&#8221;&#8221;&#8221;*&#8221;- &#8220;t m discuss u.|.t.= borin-<\/p>\n<p>issue wefe in vain&#8217; &#8216; . *}&#8221;\\tsav\u00ab1esuit, the Executive C&#8217;J\ufb02&#8221;icer alo&#8217; ngwith<\/p>\n<p>the O\ufb01icers  the On the same day, the Executive<\/p>\n<p> =  narrssted A&#8217;the&#8230;..s,b&#8217;ove incident  submitted a report<\/p>\n<p>V.V,da.:teti~. _ to the Chief Executive O\ufb02icer, Zilla<\/p>\n<p> A copy of the said report is produceri by<\/p>\n<p>&#8216; i the  at Annexure-D.\n<\/p>\n<p>   *   on the report of the Executive O\ufb02icer of the Taluka<\/p>\n<p> lifahchayath, the Chief Executive Oi\ufb01cer of the Zilla Panchayath,<\/p>\n<p> Belgaum, wrote to the State Government addressing a letter to<\/p>\n<p>!\\E&#8217;}.\/<\/p>\n<p>W.P.12061\/2006 C\/w<br \/>\nW.P.12062\/2006<br \/>\n<span class=\"hidden_text\">5<\/span><\/p>\n<p>the Private Secretary to the Minister for Rural development and<br \/>\nPanchayat Raj and Minor irrigation Annexure-E bIinging.&#8217;4&#8217;te.V_the<\/p>\n<p>nn\ufb01nn n<br \/>\n.IuI.\\IInIl.r\\l&#8217; \\Jl I-IL<\/p>\n<p>&#8216;oy me&#8221; Execu\ufb01ve Gn&#8221;&#8216;icer. The show cause<\/p>\n<p>notice further Jnadep it eiear if no statement written or oral<\/p>\n<p> &#8216;~ wag   will he proceeded with, treating that<\/p>\n<p>  not have any explanation to offer and action<\/p>\n<p>wouldibe  in accordance with the provisions contain&#8217; ed<\/p>\n<p>&#8216;pundef eeiaio\ufb01 136 of the Act.\n<\/p>\n<p>   The petitioners submitted their written explanation on<\/p>\n<p>   .,1&#8242;?\u00a7.06.2006, but they did not appear for personal hearing \ufb01xed<\/p>\n<p> on 29.05.2006 at 3.00 p.m. In the written reply submitted, the<\/p>\n<p>la.&#8221;\n<\/p>\n<p>&#8216;K\/Y<\/p>\n<p>W.P.12061\/2006 C\/w<br \/>\nw.P. 1206212006<br \/>\n<span class=\"hidden_text\">6<\/span><\/p>\n<p>petitioners asserted that their action seeking permission to have<\/p>\n<p>a discussion and to pass a resolution in the hueetisig&#8217;&#8230;o\u00a3._tJ1_..<\/p>\n<p>11}&#8217;lIJ&#8217;ITQ+ -in 1- A rnnffan .\n<\/p>\n<p>suaunua a u.uCu.n.ua._y mu: I-LI. um. u.uaI.u.-T  w <\/p>\n<p>of o ffi\u00e9i&#8217; dispute between  and iviafnarasiitraawas weii\u00bb , <\/p>\n<p>witnm&#8217;  the power and junsd&#8217; iction ofithe f!&#8217;ai1?i1-ti:1,.F5:ancha3fiath&#8217;Va3,nd<\/p>\n<p>the Executive Officer was wrong  insisting thatV&#8217;i&#8217;  ;<\/p>\n<p>table the proposal and have discussion on   to pass a<br \/>\nresolu\ufb01on in that rega1t:i__sh.o1\ufb02_d  :b_e.::given.  petitioners<br \/>\ndenied that they had  _ They also<\/p>\n<p>contended  on1y&#8221;\u00a3e)\u20acencising._.their light of freedom<\/p>\n<p>nt&#8217; spmnh n&#8230;.:1 1. was their 5&#8242;-gt-&#8230; and due; m ewmss the whee<br \/>\n&#8216;f &#8216;uu::L&#8217; people Wh&#8217;  &#8216;   rnembers of the Taiuka<\/p>\n<p>Panchayath. \u00ab It  by the petitioners that under<\/p>\n<p>Rule 3_(rn) ofthe  Panchayat Raj (Business) Rules,<\/p>\n<p>   in the opinion of the Adhyaksha is<\/p>\n<p>neceissary to the notice of the Panchayat, could be<\/p>\n<p>brouight eeriseihe Talulca Panchayat and permission could be<\/p>\n<p>&#8216;agivenuto discnss the same in the discretion of the Adhyaksha.<\/p>\n<p>   -The State Government has considered the matter in the<\/p>\n<p> &#8221;  of the defence taken by the petitioners and other relevant<\/p>\n<p>&#8221; V materials. It  referred to the provisions mtn\ufb01ned 1.1_11der<\/p>\n<p>in, ,<br \/>\n&#8220;U\/<\/p>\n<p>W.P.12061\/2006 C\/W<br \/>\nW.P.12062\/2006<br \/>\n<span class=\"hidden_text\">7<\/span><\/p>\n<p>Section 141(2)(i] (wrongly referred as 141(1)(i) in the impugned<br \/>\norder) which prescribes the procedure for conduct of &#8216;meetings of<\/p>\n<p>the Taluka Pahchayat, The 3.5.2.111. p1&#8217;ovLgicI_1 gta_-g    ;. A4 <\/p>\n<p>&#8216;No proposition shall be disagssed  .o&#8217;r&#8221;difLargV_<br \/>\nmeeting unfess it has beef; entercti&#8217;<br \/>\nw.wem&#8217;r&#8221; 5 &#8230;. &#8230;m-,&#8230; _ or .%e.:vof:&#8217;a  L<br \/>\nmeeting_. in the w\ufb01ttenV&#8217;nf-{quest  A &#8221; V<br \/>\nmember may propose anyfesoiagtion  with or<br \/>\nincidental to&#8217; the:&#8217;sub\ufb01\u00e9t:ts  :n\u00a2:.;a3d in Vhhm\u00e9 list of<br \/>\nbusiness. The   any urgent<\/p>\n<p>or&#8221;can_o&#8217;e;! afty resoluthion&#8217; &#8220;within six months after I<\/p>\n<p>;iassingVVVti-iemevcf  in? accordance with clause (In).<\/p>\n<p>in&#8217;: vnzwnhar :1 nine 3&#8242;: . _<br \/>\n&#8230;&#8230;.{_, ..&#8217;&#8230;&#8230;&#8230;&#8230;&#8230;.. .. 3&#8230;&#8230; 1&#8230;&#8230; &#8230;&#8230;&#8230;&#8230;. &#8230;\u00a3&#8230;.. -&#8230;<\/p>\n<p>   the meeting and be guided by the majority<br \/>\n A of cafes Qivenfor or against the proposal&#8217;.<\/p>\n<p>.   s  Referring to the above provision, the State Government<\/p>\n<p>  has found that the subject matter pertaining to border diopute<\/p>\n<p>  -between Kanlataka and Malinarashtra was not on the agenda of<\/p>\n<p>5 lulu: an 11917 1&#8242; _ 11_,m wgm _1_1__<\/p>\n<p>o was-an-swan. 4 an-u.o\\v-In-4-wt-J V-an-an-In at ur-<\/p>\n<p>fhp nt\ufb02innrw rns-5-H 0<br \/>\n&#8220;A4 \/<\/p>\n<p>WZV<\/p>\n<p>W.P. 1 2061\/2006 C\/w<br \/>\nW.P. 1206212006<\/p>\n<p><span class=\"hidden_text\">8<\/span><\/p>\n<p>notices for discussion of the said subject at the meeting. It was therefore held that the<\/p>\n<p>&#8216;._bordt%.te. dtg\ufb01ttm did not legitimately constitute the duty or<\/p>\n<p>_-s;_1t:=t1-1___I._, -1&#8242; t___ ___lu__a _s_a_I:I_-h.r.a._\\,r._t.. t- he d.1\u00a7.1\u00a3&#8217;-!.&#8217;.-.&#8217;3S&#8230;d. aw&#8230;<br \/>\nr\u00b0so1vtm&#8217; &#8216;&#8221;&#8216;d a.a&#8221;&#8221; it &#8216;ms *'&#8221;&#8216;t t4&#8242;:&#8217;r&#8217; f&#8217;t1ne'&#8221;&#8216;n of the &#8216;i'&#8221;&#8221;t1ka<\/p>\n<p>0&#8217; hi-ianchayath the articuiation of the same before the Taiuka<\/p>\n<p>Panchayath was against public interest and for extraneous<br \/>\nI<\/p>\n<p>W<\/p>\n<p>W.P.12061\/2006 C\/W<br \/>\nW.P.12062\/2006<\/p>\n<p><span class=\"hidden_text\">9<\/span><\/p>\n<p>purposes alien to the duties and functions of the Taluka<\/p>\n<p>Panchayath.\n<\/p>\n<p>8. Based on the above \ufb01ndings. the State <\/p>\n<p>to the conclusion that the pctitioners&lt;WereAgu&#039;i1ty_,;ojf it &#039;<\/p>\n<p>alleged against them which entaiied  <\/p>\n<p>son ,tia_n provided u_nder  ofthe  &quot;iSeeoIdi11gly;&#039;i&#039;<\/p>\n<p>the Panchayath and of     iss<br \/>\nvitiated the atn&#039;m_sphei&#039;e&quot;&#039; &#039;   xfiunctioning and<br \/>\ndevelopmentgoff the divisive activity<br \/>\ncreating   of the panchayath on<br \/>\n were ordered to be removed from<\/p>\n<p>the post&#039; i   Adhyaksha of the Taluka<\/p>\n<p>_ Paneaghayth  ..inin1ediate e\ufb01ect. T Aggrieved by the same, the<\/p>\n<p>&quot; 1- o u<br \/>\npresent L at . e.1&#8230;ons &#8230;.=-m ..L-d<\/p>\n<p>9..W  V\ufb01lounsel appearing for the petitioner contends<\/p>\n<p> \u00ab:was no fair and reasonable opportunity given to the<\/p>\n<p> 3.00 p.m., the petitioners were under the &#8216;<\/p>\n<p>I!&#8217;<\/p>\n<p>ve th .ir s v. The Adhyaksha is to be the execu\ufb01vehead of &#8216;<\/p>\n<p>the Tale&#8221; Panch vet. and he is required to convene,\u00ab~~preside* <\/p>\n<p>conduct u1ee&#8221;&#8216;&#8221;g* of the .alu.. &#8211; s._&#8230;_,.yat. _I:Ie&#8221;&#8216;is &#8216;I&#8217;\u00a7q~ui1ed&#8211;  <\/p>\n<p>discharge all duties i1npos&#8217;d &#8220;&#8221;61 exercise_ .;.&#8217;.1 .__.the,fpowe:&#8217;s <\/p>\n<p>conferred on him under the Act and-Atize  &#8220;He &#8216;~<\/p>\n<p>required to exercise over all sup:e&#8217;Ivision&#8221;&#8216;<br \/>\nexecutive administratioyrof if-&#8216;anchayat. }He has the<br \/>\npower to accord. sanction&#8217;uIiitoi  Rs.25,000\/- in a<br \/>\nyear for the  of relief to those who<\/p>\n<p>me affected ._.y   in the Taluk.\n<\/p>\n<p>19. &#8216;i&#8217;here&#8217; is &#8220;he, in the Act or the Rules which<br \/>\n its members, or its Adhyaksha to<\/p>\n<p>any  regarding transferring any portion of the<\/p>\n<p>.  xthye S&#8221;&#8216;te comhg within the jurisdiction of that<\/p>\n<p>H &#8216;F5anchayath in favour &#8216;f the &#8220;eigh.,cu..&#8217;&#8230;g State. In fact<\/p>\n<p>  with the powers, functions and duties of the<\/p>\n<p>this subject is quite alien and not in  manner connected<\/p>\n<p>i &#8220;&#8216;._iP&#8217;a;1chayath. The duties, powers, functions as referred to under<\/p>\n<p>-*:Sections 145 to 149 of the Act do not either directly or indirectly<\/p>\n<p>sugg_st that the members of the Taluka Panchayath can have a<\/p>\n<p>2-\n<\/p>\n<p>11.4 \/<\/p>\n<p>&#8216;UV<\/p>\n<p>w.1=. 12061\/2006 C\/w<br \/>\nw.P.12oe2\/2006<\/p>\n<p><span class=\"hidden_text\">18<\/span><\/p>\n<p>discussion of this nature in the panchayath. The subject does<\/p>\n<p>not deal with the administration, the development  tineother<\/p>\n<p>m1\u00a3I.t&#8230;d. w..&#8211;1f&#8230;.. m..e-.s1.z&#8217;es pertaining t&#8230; the Ts-.lu..e<br \/>\n&#8216;i&#8217;h&#8217;r-for&#8217; it &#8216;s &#8216; ery clear that th&#8217; pe&#8221;t1o&#8217;ers had u*&#8221;d b&#8217;3ro_n&#8221;\u00bb<\/p>\n<p>their power, jurisdiction and   &#8216;iventtuing&#8217; ha i<\/p>\n<p>discussion on the subject and the petitioneIseV1irere&#8217;_v  ;<\/p>\n<p>error in forcing the discussion on _subV_iiectA_uini&#8217;:the:\u00a7meeting of<\/p>\n<p>the Taluka Panchayath; f   c.\n<\/p>\n<p>20. The next \u00e9questioiiiii   it he considered is<br \/>\nwhether     of the petitioners<br \/>\ncan be     to misconduct for<br \/>\nwhich,  taken.
