Justice M.SASIDHARAN NAMBIAR\n\n Dated :19\/01\/2007\n\n O R D E R\n                  M.SASIDHARAN NAMBIAR,J.\n\n               ===========================\n\n              W.P.(C)  NO. 21118   OF 2006\n\n               ===========================\n\n\n\n       Dated this the 19th day January of 2007\n\n\n\n                           JUDGMENT\n<\/pre>\n<p>     Petitioner   is         plaintiff   and   respondents<\/p>\n<p>defendants   in   O.S.27\/04,   on   the   file   of   Munsiff<\/p>\n<p>Court,  Adoor.    Petitioner  is  the  daughter  of  first<\/p>\n<p>respondent.   Plaint   schedule   property,   was   part   of<\/p>\n<p>the   property,   which   originally   belonged   to   first<\/p>\n<p>respondent   and   his   deceased   wife.     Subsequent   to<\/p>\n<p>her   death   on   24.7.02,   as   per   registered   partition<\/p>\n<p>deed   No.608\/02   the   properties   were   divided   and   the<\/p>\n<p>western   portion   was   allotted   to   first   respondent<\/p>\n<p>and   eastern   portion   to     petitioner.     As   per   the<\/p>\n<p>partition   deed,   the   property   allotted   to   the<\/p>\n<p>petitioner   is   having   an   extent   of   1.83   Ares.\n<\/p>\n<p>Petitioner   instituted   the   suit   for   fixation   of   the<\/p>\n<p>western   boundary   which   separate   the   property   of<\/p>\n<p>first   respondent   from   her   property.     Respondents   2<\/p>\n<p>and 3 were impleaded as a subsequent assignees from<\/p>\n<p>first   respondent.        A   Commission   was   appointed.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C)21118\/06                         2<\/span><\/p>\n<p>Commissioner   submitted   a   report   and   plan.     As   per<\/p>\n<p>the   report   and   plan,     plaint   schedule   property<\/p>\n<p>allotted to  petitioner is having only an extent of<\/p>\n<p>1.64   Ares.     There   is     a   building   encroaching   upon<\/p>\n<p>the   said   property.   Petitioner   therefore   filed<\/p>\n<p>I.A.2048\/05,   an   application   under   Order   VI   Rule   17<\/p>\n<p>of Code of Civil Procedure to amend the plaint.  It<\/p>\n<p>was   opposed   by   respondents   contending   that   the<\/p>\n<p>building   is   aged   more   than   20   years   and   the   claim<\/p>\n<p>for  its  demolition  is  barred  by  time  and  therefore<\/p>\n<p>the plaint cannot be allowed to be amended.   Under<\/p>\n<p>Ext.P3         order         learned         Munsiff         dismissed         the<\/p>\n<p>application.     It   is   challenged   in   this   petition<\/p>\n<p>filed   under   Article   227   of   the   Constitution   of<\/p>\n<p>India.\n<\/p>\n<p>      2.         Learned   counsel   appearing   for   the<\/p>\n<p>petitioner and respondents were heard.\n<\/p>\n<p>      3.         Though   learned   counsel   appearing   for<\/p>\n<p>respondents   argued   that,   as   the   building   is   aged<\/p>\n<p>more   than   20   years   petitioner   is   not   entitled   to<\/p>\n<p>get a decree for demolition of the building on the<\/p>\n<p>ground   that       the   claim   is   barred   by   limitation,<\/p>\n<p>that   question   is   to   be   decided   in   the   suit   and<\/p>\n<p><span class=\"hidden_text\">W.P.(C)21118\/06                   3<\/span><\/p>\n<p>respondents   are   entitled   to   take   up   the   contention<\/p>\n<p>in   the   additional   written   statement   to   be   filed.\n<\/p>\n<p>Eventhough   it   was   argued   that   the   building   is   in<\/p>\n<p>the   property   allotted   to     first   respondent,   under<\/p>\n<p>the   partition   deed   and   therefore   petitioner   has   no<\/p>\n<p>right   over   the     land   where   the   building   stands<\/p>\n<p>that   is   also   a   question   to   be   decided   in   the   suit<\/p>\n<p>and   not   in   an   application   for   amendment   of   the<\/p>\n<p>plaint.  Moreover, the plaint schedule property and<\/p>\n<p>the   eastern   property   were   owned   by   petitioner   and<\/p>\n<p>first   respondent   till   it   was   divided   in   2002,   as<\/p>\n<p>per partition deed 608\/02. If so the plea of bar of<\/p>\n<p>limitation   may   not   lie.   In   such   circumstance,<\/p>\n<p>Ext.P3   order   is   quashed.             I.A.2048\/05   stands<\/p>\n<p>allowed.     Petitioner   is   permitted   to   amend   the<\/p>\n<p>plaint  as  sought  for.
