Grievance of the petitioner is that Motor Vehicles Tax<\/p>\n<p>with respect to vehicles owned by them is not received by the 4th<\/p>\n<p>respondent, insisting production of No-objection Certificates<\/p>\n<p>evidencing payment of contributions due to the Motor Transport<\/p>\n<p>Workers Welfare Fund. According to the petitioner it is a trust<\/p>\n<p>engaged in activity for rehabilitation and treatment of people<\/p>\n<p>who are suffering from mental and physical illness, and with<\/p>\n<p>respect to whom there is none to look after. It is also stated that<\/p>\n<p>the petitioner is undertaking food supply to the poor persons<\/p>\n<p>undergoing treatment in Medical College Hospital, and is also<\/p>\n<p>helping people who are physically and mentally ill and<\/p>\n<p>handicapped. For the purpose of carrying out the above said<\/p>\n<p>charitable activities the petitioner is using 3 vehicles owned by<\/p>\n<p>them bearing Regn: No:KL-5\/J-8772, KL-5\/M-6484 and KL-5\/Y-<\/p>\n<p>6257. According to the petitioner the vehicles owned by them<\/p>\n<p>cannot be termed as motor transport undertakings coming<\/p>\n<p>within the provisions of Kerala Motor Transport Workers Welfare<\/p>\n<p>Fund Act and as such they are not liable to pay contributions<\/p>\n<p><span class=\"hidden_text\">W.P.(C).34780\/09-N              2<\/span><\/p>\n<p>with respect to the drivers engaged in those vehicles.         It is<\/p>\n<p>further contended that the drivers who are in charge of the<\/p>\n<p>vehicles are not &#8216;paid employees&#8217; but they are voluntary workers<\/p>\n<p>who are engaged in the activities of the petitioner trust. The<\/p>\n<p>petitioner relies on a decision of this court in Rajesh Vs. Joint<\/p>\n<p>R.T.O. (2009 (2) KLT 615) in support of their contentions.<\/p>\n<p>      2.    However, I am of the opinion that the liability for<\/p>\n<p>payment of contributions to the Motor Transport Workers<\/p>\n<p>Welfare Fund is not an issue arising for consideration in this writ<\/p>\n<p>petition. Since there exist a dispute in relation to that liability I<\/p>\n<p>am of the opinion that a provisional direction can be issued to<\/p>\n<p>the 4th respondent to accept the Motor Vehicle Tax due with<\/p>\n<p>respect to the above vehicles, without prejudice to the rights of<\/p>\n<p>the respondents 2 and 3 to claim and recover contributions if any<\/p>\n<p>due under law. It is pointed out by the petitioner that disputing<\/p>\n<p>such liability the petitioner had filed Ext.P4 before the 2nd<\/p>\n<p>respondent. It is for the respondents 2 and 3 to take a decision<\/p>\n<p>regarding such liability.\n<\/p>\n<p>      3.
