WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     These appeals  by special leave arise from the judgment<br \/>\nof the\tDivision Bench\tof the\tAllahabad High\tcourt, dated<br \/>\nFebruary 18,  1991 in  Criminal Appeal Nos. 1026 and 1121 of<br \/>\n1978.\n<\/p>\n<p>     The prosecution  case is  that on\tMarch 6, 1977, while<br \/>\nthe deceased  Sukhuwa and  his sons  and his younger brother<br \/>\nwere returning\tfrom the Holi festival and reached the house<br \/>\nof the\taccused, suddenly  all the  three accused armed with<br \/>\nlathis attacked\t the deceased on the head and other parts of<br \/>\nthe body.  When the  sons and brother of the deceased raised<br \/>\nalarm, all  of them ran away. The deceased had fallen on the<br \/>\nground. He  was taken  on a  cot his  house. Thereafter,  he<br \/>\nbreathed his last. F.I.R came to be filed on the same day at<br \/>\nabout  10.30  p.m.  Investigation  started  and\t the  doctor<br \/>\nM.M.S.A. Khan,\twho conducted  the post-mortem\ton March  8.<br \/>\n1977, opined  that the\tinjuries were  sufficient  to  cause<br \/>\ndeath in  the ordinary course of nature. The Autopsy Surgeon<br \/>\nfound the following ante-mortem injuries :-\n<\/p>\n<blockquote><p>     &#8220;1. Lacerated  wound 2&#8243; x 1&#8221; x bone<br \/>\n     deep present  over the left side of<br \/>\n     forehead. Left eye-bro and outer of<br \/>\n     left eye bones underneath.\n<\/p><\/blockquote>\n<blockquote><p>     2. Lacerated  wound 1\/4&#8243;  x 1\/4&#8243;  x<br \/>\n     bone   deep   present   over   left<br \/>\n     zygmatic  bone,   bone   underneath<br \/>\n     fractured.\n<\/p><\/blockquote>\n<blockquote><p>     3.\t Abraded   contusion  2&#8242;   x  1&#8243;<br \/>\n     present 1&#8243; below the injury no.1.\n<\/p><\/blockquote>\n<blockquote><p>     4. Lacerated  wound 1&#8243;  x 1\/4&#8243; bone<br \/>\n     deep present over the middle of the<br \/>\n     chin, bone underneath fracture.\n<\/p><\/blockquote>\n<blockquote><p>     5. Abraided  contusion 2&#8243;\tx 1-1\/4&#8243;<br \/>\n     present over  the posterior  aspect<br \/>\n     of lower  third of\t right\tforearm,<br \/>\n     bones underneath fractured.&#8221;<\/p><\/blockquote>\n<p>     The question,  therefore, is whether all of them shared<br \/>\ncommon intention  to cause  death of  the  deceased  or\t the<br \/>\noffence was  one under\tsection 304, part II as found by the<br \/>\nHigh Court ? The sessions Judge after recording the evidence<br \/>\nand on the nature of the evidence that the offence is one of<br \/>\nmurder punishable  under section  302 I.P.C. and accordingly<br \/>\nthe respondents\t came to be convicted under section 302 read<br \/>\nwith section  34  I.P.C\t   and\twere  sentenced\t to  undergo<br \/>\nimprisonment for  life. On  appeal, the\t High\tcourt  while<br \/>\naccepting the evidence of the direct witnesses, the sons and<br \/>\nbrother of  the deceased,  PWs.1 to  3,\t and  accepting\t the<br \/>\nevidence of  the doctor\t came to  the  conclusion  that\t the<br \/>\nprosecution has proved the case beyond reasonable doubt, but<br \/>\nsuddenly jumped\t to the\t conclusion that  the accused has no<br \/>\nintention to kill the deceased.\n<\/p>\n<p>     Learned amicus  curiae for the respondent has contended<br \/>\nthat the  accused had  no motive  and intention\t to kill the<br \/>\ndeceased. We  find no force in the contention. The motive is<br \/>\nlicked up  in the  heart of the accused and therefore, it is<br \/>\nto be  adjudged from  the circumstances available on record.<br \/>\nWhether the  accused have intended to cause death also is an<br \/>\ninferential fact  drawn from  the circumstances. It is seen,<br \/>\nas accepted  by the High Court at page 20 of the paper book,<br \/>\nthat the  deceased and\twitnesses were unarmed and when they<br \/>\nwere returning from the Holi festival and reached the stated<br \/>\nplace, all  of a  sudden the  accused in  concert armed with<br \/>\nlathis attacked the deceased and caused injuries on the head<br \/>\nand other  vital parts of the body, as noted above. The mere<br \/>\nfact that  extensive damage  has  not  been  caused  to\t the<br \/>\ndeceased does  not establish  that the offence is not one of<br \/>\nunder punishable  under section\t 302. All  the accused armed<br \/>\nwith lathis  lay in  weight. The  High\tCourt,\t  therefore,<br \/>\ncommitted manifest  error in  converting  the  offence\tfrom<br \/>\nmurder\tto   culpable  homicide\t  not  amounting  to  murder<br \/>\npunishable under section 302 part II, I.P.C.\n<\/p>\n<p>     The appeals  are accordingly  allowed. The\t judgment of<br \/>\nthe High  Court converting the offence stands set aside. The<br \/>\naccused stand  convicted for  an offence  under section\t 302<br \/>\nread with  section 34  I.P.C.  and  they  are  sentenced  to<br \/>\nundergo imprisonment for life.\tThey shall be directed to be<br \/>\ntaken into custody forthwith to undergo the sentence.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of U.P vs Lakhan &amp; Ors on 11 April, 1997 Bench: K.
