By the impugned order, the<br \/>\n\tpetitioner came to be removed from the post of Sarpanch of village<br \/>\n\tJamar. The petitioner has also challenged order dated 14.5.2008<br \/>\n\tpassed by DDO, Surendranagar upholding the order passed by the TDO.\n<\/p>\n<p>It<br \/>\n\tis not in dispute that the petitioner is an elected Sarpanch of<br \/>\n\tvillage Jamar. He was elected on 20.1.2007. At that time, the<br \/>\n\tpetitioner had only two children. It was also not in dispute that<br \/>\n\tthird child was born to the wife of the petitioner on 7.8.2007. In<br \/>\n\tview of the amended provisions of Section 30 of the Gujarat<br \/>\n\tPanchayats Act(\u00fdSthe Act\u00fd\u00fd for short), TDO was of the opinion that<br \/>\n\tpetitioner had, by virtue of birth of third child, incurred<br \/>\n\tdisqualification. A show cause notice was therefore, issued to him<br \/>\n\ton 4.3.2008 calling upon him why he should not be removed from the<br \/>\n\tposition of Sarpanch. The petitioner opposed the notice. TDO<br \/>\n\thowever, by  his impugned order dated 4.4.2008 ordered his removal.<br \/>\n\tAs noted, his appeal came to be dismissed by DDO by order dated<br \/>\n\t14.5.2008.\n<\/p>\n<p>In<br \/>\n\tview of the undisputed fact that the petitioner has three children,<br \/>\n\this removal pursuant to amended provision of Section 30 of the Act<br \/>\n\tcannot be found fault with. Section 30 of the Act provides for<br \/>\n\tdisqualification as per Gujarat Local Authorities Laws(Amendment)<br \/>\n\tAct, 2005. Clause (m) of Sub-section(1) of Section 30 has been added<br \/>\n\tin following terms :\n<\/p>\n<p>\u00fdS4.\n<\/p>\n<p>\tAmendment of section 30 of Guj. 18 of 1993. &#8211; In the Gujarat<br \/>\n\tPanchayats Act, 1993 (Guj.18 of 1993), in Section 30, in<br \/>\n\tsub-section(1), after clause(l), the following clause (m) shall be<br \/>\n\tinserted, namely,<\/p>\n<p>\u00fdS(m)<br \/>\n\thas more than two children:\n<\/p>\n<p>Provided<br \/>\n\tthat a person having more than two children on the date of<br \/>\n\tcommencement of the Gujarat Local Authorities Laws(Amendment) Act,<br \/>\n\t2005(Guj. 17 of 2005) (hereinafter in this clause referred to as<br \/>\n\t\u00fdSthe date of such commencement\u00fd\u00fd), shall not be disqualified<br \/>\n\tunder this clause so long as the number of children he had on the<br \/>\n\tdate of such commencement does not increase:\n<\/p>\n<p>Provided<br \/>\n\tfurther that a child or more than one child born in a single<br \/>\n\tdelivery within the period of one year from the date of such<br \/>\n\tcommencement shall not be taken into consideration for the purpose<br \/>\n\tof disqualification under this clause.\n<\/p>\n<p>Explanation.-\n<\/p>\n<p>\tFor the purpose of this clause,-\n<\/p>\n<p>(i)<br \/>\n\twhere a couple has only one child on or after the date of such<br \/>\n\tcommencement any number of children born out of single subsequent<br \/>\n\tdelivery shall be deemed to be one entity;\n<\/p>\n<p>(ii)<br \/>\n\t&#8216;child&#8217; does not include an adopted child or children.\u00fd\u00fd<\/p>\n<p>It<br \/>\n\tcan thus be seen that any person who has more than two children<br \/>\n\twould be disqualified to hold the post of Sarpanch. Further proviso<br \/>\n\tto the said amendment of Section 4 of the Amending Act also provides<br \/>\n\tfor a cool period of only one year from the date of commencement of<br \/>\n\tGujarat Local Authorities Laws(Amendment) Act, 2005. Admittedly, the<br \/>\n\tthird child was born a year after the said commencement.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the petitioner however, strenuously urged that<br \/>\n\tinitiation of the proceedings were beyond the period of limitation<br \/>\n\tprescribed. He relied on provisions contained in Section 57 of the<br \/>\n\tAct and urged that as per provision of Sub-section(2) of Section 57<br \/>\n\tof the Act, no action of disqualification can be initiated after six<br \/>\n\tmonths of incurring of such disqualification.\n<\/p>\n<p>Quite<br \/>\n\tapart from my inability to agree with the suggestion of the learned<br \/>\n\tcounsel regarding interpretation of Sub-section(2) of Section 57 of<br \/>\n\tthe Act, which question need not be gone into in the present<br \/>\n\tpetition, I am of the opinion that Section 57 has no application in<br \/>\n\tthe present case.\n<\/p>\n<p>Sub-Section(1)<br \/>\n\tof Section 57 pertains to removal of Sarpanch on account of several<br \/>\n\treasons such as misconduct or disgraceful conduct or abuse of the<br \/>\n\tpower or persistent default in performance of the duties.<br \/>\n\tSub-section(2) of the Act pertains to disqualification by the<br \/>\n\tCompetent Authority after following procedure laid down under<br \/>\n\tSub-section(1) of Section 57.\n<\/p>\n<p>In<br \/>\n\tthe present case, as per Section 30 of the Act, the petitioner has<br \/>\n\tbeen rendered disqualified to hold any elected post of Sarpanch on<br \/>\n\taccount of newly added clause(m) of Sub-section(1) of Section 30. As<br \/>\n\tper Section 32 of the Act, if any member of Panchayat incurs<br \/>\n\tdisqualification during the term for which he was elected, he is<br \/>\n\trendered disabled from continuing to be a member. It is under this<br \/>\n\tprovision that TDO ordered his removal.\n<\/p>\n<p>I<br \/>\n\tdo not find  that action was beyond the period of limitation.\n<\/p>\n<p>In<br \/>\n\tthe result, I  see no merits in the petition. The petition is<br \/>\n\tdismissed.
