He submitted that he is said to<br \/>\n\thave abetted, and, thereafter, as he was not available, trial could<br \/>\n\tnot proceed against him and other co-accused have been acquitted by<br \/>\n\tthe learned Sessions Court , Sabarkantha camp at Idar, which is<br \/>\n\tproduced. He has referred to the discretion with regard to testimony<br \/>\n\tof the victim and her mother and submitted that therefore, present<br \/>\n\tapplication may be allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Ms.Mini Nair resisted the present application.\n<\/p>\n<p>\tHaving<br \/>\n\theard Mr.R.J.Goswami, learned advocate for the applicant and Ms.Mini<br \/>\n\tNair, learned APP for respondent State and having considered the<br \/>\n\tnature of offence, manner in which, it is alleged to have been<br \/>\n\tcommitted, role attributed as well as the judgment in Sessions Case<br \/>\n\tNo.128 of 2009, the Court is of the opinion that the present<br \/>\n\tapplication deserves to be allowed as now the charge sheet has been<br \/>\n\tfiled.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.63\/2009 at Idar<br \/>\n\tPolice Station, Dist.Sabarkantha on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 PM, till<br \/>\ntrial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
