As per the &#8220;case<\/p>\n<p>on 10.2.1995 and 11.2.1996, the line agents  en<\/p>\n<p>cash of Rs. 245.000\/~ by the end of:1~1*11, tFe1\u00a2ruaIy! In<br \/>\nthe intervening night 01:&#8217;.-1   at about 2<br \/>\na.m. or so, it   heard the lmoclcing<br \/>\nsound of   nvhen they enquired, who<br \/>\nit was,  -lxeply. It is alleged that, a\ufb01er some<br \/>\ntime, &#8216;ohtside, asked P.Ws.1 and 10 to<\/p>\n<p>open :the_\u00a71oo:t; eved-en feresm, they forcibly entered the o\ufb01oe,<\/p>\n<p> .   jxoyvder  eyes of the persons in the o\ufb01ce and<\/p>\n<p>  robbed not only the cash but also a<\/p>\n<p>Watch 10 and also other artickes &#8212;- MI). 4 to 22, 25,<\/p>\n<p>  25, 27  Went away. After hearing the cries of the inmates of<\/p>\n<p>  [&#8216;&#8221;\u00a31_;e on arrival of the other peopic, noticing serious<\/p>\n<p>V&#8217; injiixxies on RN. 1 and aiso injuries on P.W.10, they are taken to<\/p>\n<p>.4 the hospital and thereafter, P.W.1 lodges the complaint to the<\/p>\n<p>poiioe about the incident. The investigation  p,<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>statements of various Witnesses are recorded, the accused are<\/p>\n<p>arrested on various dates and certain recoveries are  to<\/p>\n<p>have been made \u00a300333 them on their voluntary  <\/p>\n<p>completion of the investigation, charge sheet    <\/p>\n<p>10 accused.\n<\/p>\n<p>3. It is to be noted   &#8216;viiaratgs accused<br \/>\nNo.1 is concerned, is sp\ufb01mp  {sued to 13\u00a2 Vsbsconcling.<\/p>\n<p>Be that as it may.\n<\/p>\n<p>4Q  of the charges, as the<br \/>\naccused denied  claimed to be tried, they are<\/p>\n<p>tried  &#8216;Sessiens .I&#8217;\u00a70.v48\/ 1996. In all 12 witnesses have<\/p>\n<p> . Atbectibgt am?&#8217; }&#8217;;;3e\u20ac1\u00ab_hy  and Exs.P.1 to 21 and 54.03.<\/p>\n<p> 1..\n<\/p>\n<p>A V   the evidence on record rather lack of<\/p>\n<p>&#8216;.evisde1:tce,t  trial Court has given bene\ufb01t of doubt to the<\/p>\n<p>    acquitted them. This judgment of acquittal is<\/p>\n<p> K  in the present appeal.\n<\/p>\n<p>5&#8243;&#8216;<\/p>\n<p>6. Sri HM. Nawaz, the learned Additional <\/p>\n<p>Prosecutor taking us through the e:u1:ire evidegiiee <\/p>\n<p>that, the appreciation of evidence by__the._1ean1ed  &#8216; x&#8217; <\/p>\n<p>is illegal and contrary to the evidence.  $L11)A1I1&lt;i&#039;fTic\u00a5i::V[j:\u00a7t1\u00a7i12~d.}&amp;S<\/p>\n<p>accused No.8 was former empi.oye.e of    he L&#039;<\/p>\n<p>Was known to the Witnesses    and they<br \/>\nhave positiveiy identi\ufb01ed  of the culprit. It<br \/>\nis further contended thet   of accused No.8,<br \/>\nthe mic: of    light and they have<br \/>\nbeen  certain Iecoveries of<br \/>\nthe AV _&#039; including cash and<br \/>\nwrist watehef recovered. This recovery of the<\/p>\n<p>articles  aaceused on their volunta;ry statement clearly<\/p>\n<p>ddeon\ufb01ects\u00bb-.&quot;the&#039;m with  crime in question and as such, g;ivm&#039; g<\/p>\n<p>&quot;&#039;hein;\ufb01t&#8211; iiay the ma} Court is tmjusti\ufb01ed. It is also<\/p>\n<p>  trial Court has made much fuss about non<\/p>\n<p>  &#039;pm\u00e9uc\ufb02oe\u00e9 of the documents like employment of the witnesses<\/p>\n<p>   dediibt their credibility. On these among other gvounds, it is<\/p>\n<p> .,._&quot;V&amp;:&quot;Codx{11ten&lt;ied that the impugned judgment of acquittal being not<\/p>\n<p>u only illegal but perverse is liable to be set aside.<\/p>\n<p>i it   is rather  for these witnesses to see the<\/p>\n<p>  of accused NO.8 and identify him later<\/p>\n<p> by the? accused before entering the premises and as such,<br \/>\n  V&#039; there was no light. It cannot be forgotten that the<br \/>\n .._Wineident has taken piace at 2 am. and the witnesses &#8212; P.Ws. 1,<\/p>\n<p> and 10 themselves admitted that they were in deep slumbers.<\/p>\n<p>possibility of P.W.1 and 10 identifying him. No doubt.-\ufb02ee trial<br \/>\nCourt has rejected the evidence of the other<br \/>\nincluding P.Ws. I to 10 on the ground<br \/>\npertaining to their employment ha\u00a7\u00a5e~&#039;a,!.so  &#039; f<br \/>\nbut we do not agree with so far as rejectienjjv<br \/>\nWimesses are concerned only<br \/>\nof certain documents.   for2gotteni&#8211;:t.3_;a\u00a7jf?p.W.1 was<br \/>\nseriousiy injured. So  some injuiies<br \/>\nthough simple in .netuIe.-&quot;&#039;    that at the earliest<br \/>\npoint of    complaint and set<br \/>\nthe inveetieatzioii aejjsuch, the presence of P.Ws. 1<br \/>\nand 10 cannot  However, if we peruse the<\/p>\n<p>evidence of Ws.&#039;    and chronobgical events, in our<\/p>\n<p>in   the prosecution case itself, the electricity was<\/p>\n<p>It is further admitted by P.W.1 that immediately after entexing<\/p>\n<p>5~&lt;~<\/p>\n<p> &#039;Aime xrseitnii 6f.&#039;_the eiiitience states that he could identify the<\/p>\n<p>a\u00a2i\u00a2u\u00a7\u00a2e.s:$\u00a7ee\u00a7#%s \ufb01ygoioe and that is why the ma: Court lightly felt<\/p>\n<p>&#039;i11fereneeV__Athat accused No.8 was known to P.Ws. 1 and 10<br \/>\n   In the absence of any such material and on the face of<br \/>\n jngggimbability of P.Ws. 1 and 10 &quot;seeing the accused and<\/p>\n<p>it iden\ufb01ljring them, the doubt expressed by the trial Court<\/p>\n<p>the premises, the accused who were 15 to 20<br \/>\ntemporariiy blinded P.Ws. 1 and 10 by<br \/>\nin their eyes. If the chilly powder is     &#039; f<br \/>\ncause burning sensation and as sueh,<br \/>\nwitnesses to identify thexeaftet.  it  tot<br \/>\nnoted that, immediately  the chilly<br \/>\npowder, the accused  to  these people with<br \/>\nclubs and as both _these&#039;&quot; it themselves admit<br \/>\nthat then: wfere   and in fact P.W.1<br \/>\nsuggests  Itticenscious. If that is so,<br \/>\nthere W\u00e9is n_pi.&#039;  $1&#039; these Witnesses to speci\ufb01cally<br \/>\niden\ufb01fy   accused No.8, who is said to<\/p>\n<p>be kngawnto ttlerzi &quot;i5&#039;u1thei, it is to be noted that I-&quot;.W. 1 dtming<\/p>\n<p>neeessityuf Zshtiwing employment of accused No.8 so as to draw<\/p>\n<p>regarding the identify of the accused, cannot be said as either<\/p>\n<p><span class=\"hidden_text\">123<\/span><\/p>\n<p>recovery, we \ufb01nd that the trial Court was justi\ufb01etiV:&#8217;i\ufb01L:&#8217;&#8211;<\/p>\n<p>bene\ufb01t of doubt to the accused.\n<\/p>\n<p>12.
