Balakrishnan, J.\n<\/p>\n<p>The appellants herein  have challenged their conviction and<br \/>\nsentence under Section 302 read\t  with Section 149, I.P.C. and also under<br \/>\nSections 147 and 148, I.P.C.\t    These appellants, along with four others,<br \/>\nwere tried by the Court of Sessions Judge, Guna, Madhya Pradesh<br \/>\nalleging that they had caused the death of one Halkiya.\t      On 13.3.1984,<br \/>\nat about \ud83d\ude2f clock while PW-1 Hari Singh, nephew of deceased Halkiya<br \/>\nwas working in his field, PW-2 Harnam Singh came<br \/>\nand told that his uncle Halkiya was lying injured near the field of Udham<br \/>\nSingh.\t PW-1 rushed to the place and saw Halkiya lying injured.  On the<br \/>\nway he had   informed Patel Pritam Singh( PW-6) and also Chowkidar<br \/>\nMunni Lal (PW-5).     Brother of PW-1 brought a bullock cart   to   take  the<br \/>\ninjured\t  Halkiya to hospital,\t but on the way Halkiya died and the bullock<br \/>\ncart was diverted to the police station, which was about 8 Kms. away from<br \/>\nthe place of incident.\tPW-1 lodged the F.I. statement before the Station<br \/>\nOfficer.  According to\tPW-1,  injured Halkiya\thad  told PW-1 that he was<br \/>\nassaulted by nine persons.\tThe names of all these persons were given<br \/>\nby PW-1 in the F.I. statement.\n<\/p>\n<p>On the basis of statement given by PW-1, a case was registered<br \/>\nagainst these  nine persons and\t   the\t body of Halkiya was\tsent for<br \/>\npost-mortem examination.    PW-4 conducted the post-mortem<br \/>\nexamination and found that there was an incise wound on the right side of<br \/>\nthe skull of  the deceased,   possibly caused by a hard and blunt object.<br \/>\nThere were two other incised wounds,  alleged to have been caused by<br \/>\nhard and sharp cutting object on the right hand.   In  addition,   there were<br \/>\n8 contusions on the various parts of the body.\tThe Doctor was of the<br \/>\nopinion that after sustaining these injuries,  Halkiya must have been alive<br \/>\nfor 2-4 hours.\n<\/p>\n<p>The initial investigation was conducted by the Chief Inspector<br \/>\nNarayan Prasad Srivastava and thereafter by R.B.Dubey.\tHe prepared<br \/>\nthe site plan and obtained some blood-stained sand from the scene of<br \/>\noccurrence.  He interrogated the accused persons and on 14.3.1984, one<br \/>\nfarsa  from accused Meharban Singh and one bamboo stick each from<br \/>\naccused Jagannath Singh\t and   Bhiya Lal   were recovered.\n<\/p>\n<p>Though two eyewitnesses were examined in this case, their<br \/>\nevidence was not believed by the Sessions Court.  The appellants were<br \/>\nfound guilty mainly on the evidence of PW-1 Hari Singh, PW-2 Harnam<br \/>\nSingh and PW-3 Kalyan Singh.  These three witnesses deposed that<br \/>\nwhen they saw deceased Halkiya, he was alive and gave statement to<br \/>\nthem that he was attacked by these appellants.\tThe counsel for the<br \/>\nappellants contended before us that the\t  statement given by these<br \/>\nwitnesses could not have been relied upon   by the Sessions Court as well<br \/>\nas High Court,\t as the deceased Halkiya was not in a fit condition to give<br \/>\nthe statement.\t     PW-1 Hari Singh gave the evidence to the effect that<br \/>\nwhen he reached the place of incident and found that Halkiya was lying<br \/>\ninjured in the pathway leading from Rusia to Aron, he enquired as to who<br \/>\nhad assaulted and then Halkiya told the names of all the persons.  PW-1<br \/>\nalso deposed that he had gone to PW-5 Munni Lal and PW-6 Pritam Singh<br \/>\non his way to the place of incident.  He further stated that PW-5 Munni Lal<br \/>\nreached the place of incident and the condition of Halkiya was bad and he<br \/>\ncould give only the names of four persons and then his brother Kallu<br \/>\nreached there with the bullock cart and the  injured was taken to  Aron.\n<\/p>\n<p>PW-2 Harnam Singh deposed that on the date of incident at about<br \/>\n7 oclock in the morning he went to the house of Patel Hartoom Singh to<br \/>\nget a loan application.\t While he was coming back, he saw Halkiya lying<br \/>\non the pathway near the field of Udham Singh.  He went near the injured<br \/>\nHalkiya who told him that nine persons including these appellants had<br \/>\nattacked him with lathis and farsas.  PW-3 also deposed\t that  Halkiya<br \/>\ngave out   the names of persons who had\t attacked him.\tThe Sessions<br \/>\nCourt as well as the High Court mainly relied on the evidence of PW-2<br \/>\nHarnam Singh, who had seen the injured in the first instance. According to<br \/>\nPW-2 Harnam Singh, the injured Halkiya disclosed the names of<br \/>\nMeharban Singh, Halke Bhaya, Bhagwat Singh, Bhayalal, Jagannath,<br \/>\nUdham Singh and Ram Swaroop.  The High Court, after careful<br \/>\nconsideration of the evidence on record,  came to the conclusion that<br \/>\nthese appellants had caused injuries to the deceased Halkiya.\n<\/p>\n<p>The main argument advanced by the appellants counsel  is that the<br \/>\ndeceased might not have\t given the names of assailants and taking into<br \/>\nconsideration the serious nature of the injury caused to his skull,  the<br \/>\ndeceased must have been either dead or unconscious,  and that  there is<br \/>\nno evidence to show that the deceased was in a fit state of mind to give<br \/>\nthe dying declaration.\tIt was argued that the evidence of PW-1 to 3<br \/>\nshould\tnot  have been accepted by the Court.  It was also pointed out by<br \/>\nthe appellants\tcounsel that PW-5 and PW-6, who were present at the<br \/>\ntime when injured was taken in the bullock cart,  failed to support the<br \/>\nprosecution and this fact also would show that the dying declaration was<br \/>\nfalse and unreliable.\n<\/p>\n<p>It is important to note that the witnesses not only  reached the place<br \/>\nof incident  but  also\ttook steps to take the deceased\t  in a bullock cart to<br \/>\nthe nearby hospital and this  shows that deceased Halkiya must have<br \/>\nbeen alive at that time.  While the injured was being taken in the bullock<br \/>\ncart, on the way he died and thereafter the dead body was directly taken<br \/>\nto the Police Station.\t There,\t the First Information Report was lodged and<br \/>\nin the FIR, it is mentioned that dead body of Halkiya was in the Police<br \/>\nStation.  The evidence of PW1 to PW3, coupled with the medical evidence<br \/>\nand other surrounding circumstances convincingly proved that the dying<br \/>\ndeclaration given by the deceased, must have been true and the Sessions<br \/>\nCourt as well as the  High Court was very careful in accepting this dying<br \/>\ndeclaration and wherever there was any doubt as to the involvement  of<br \/>\nsome of the accused,   the court granted the benefit thereof  and acquitted<br \/>\nthose accused.\t  The names of the appellants were disclosed by the<br \/>\ndeceased to three witnesses  who gave their evidence before the court<\/p>\n<p>and the two courts accepted that  evidence and did not find any infirmity or<br \/>\nmiscarriage of justice in this case.
