PRAKASH TATIA, J.\n<\/pre>\n<p>Mr. Rakesh Arora, for the petitioners.<\/p>\n<p>     Heard learned counsel for the petitioner.<\/p>\n<p>     The    petitioner is aggrieved against the order dated<\/p>\n<p>4.2.2009 by which his prayer for summoning the Will was<\/p>\n<p>denied by the trial court.\n<\/p>\n<p>     It appears from the facts of the case that petition for<\/p>\n<p>obtaining the succession certificate was submitted in the<\/p>\n<p>trial court in the year 1996. The petitioner became party in<\/p>\n<p>the said proceedings on the basis of the Will in his favour.<\/p>\n<p>After closure of the evidence of the applicant, the petitioner<\/p>\n<p>submitted application for summoning of the Will from the<\/p>\n<p>Police as the will in question was taken in custody by the<\/p>\n<p>Police in a case registered as back as in the year 1999.<\/p>\n<p>Apparently, the application is delayed as that was the<\/p>\n<p>foundational document of the petitioner, which should have<br \/>\n                                                             SBCWP No.1607\/2009<br \/>\n                                                     Mahi Ram Vs. Maniram &amp; Ors.\n<\/p>\n<p><span class=\"hidden_text\">                                             2<\/span><br \/>\n              been filed along with the application for becoming party or<\/p>\n<p>              copy of which should have been filed .<\/p>\n<p>                   In the facts and circumstances of the case, I do not<\/p>\n<p>              find any reason to interfere in the impugned order.
