M.A.Siddiqui,J.\n\n             Shri Sanjay Patel , Adv. for petitioners.\n\n             Shri Akshay       Namdeo,   PL      for   respondent\n             no.1\/State.\n\n             Shri Siddharth Datt, Adv. for respondent no.2.\n\n        ORDER RESERVED ON 28\/03\/2011.\n\n        ORDER PASSED ON           30\/03\/2011.\n\n                           ORDER\n<\/pre>\n<p>(1)     This petition under Section 482 of Cr.P.C. has been<\/p>\n<p>        filed by the petitioners to invoke the extra ordinary<\/p>\n<p>        powers of this Court to quash the proceedings in<\/p>\n<p>        Criminal Case No. 1234\/06 pending in the Court of<\/p>\n<p>        JMFC, Bhopal against the petitioners for the offence<\/p>\n<p>        under Section 498-A IPC and Sections 3\/4 of Dowry<\/p>\n<p>        Prohibition Act. This petition has been filed after<\/p>\n<p>        framing of the charges.\n<\/p>\n<p>(2)     Undisputedly, this is the second petition under<\/p>\n<p>        Section     482   of   Cr.P.C.   First     M.Cr.C.    No.<\/p>\n<p>        11035\/2006 was dismissed by this Court on<\/p>\n<p>        26.03.08.\n<\/p>\n<p><span class=\"hidden_text\">                               -2-<\/span><\/p>\n<p>(3)     Learned counsel for petitioners submits that<\/p>\n<p>      petitioners are the members of joint hindu family.<\/p>\n<p>      Petitioner no.1 was married to respondent no.2 Smt.<\/p>\n<p>      Tanu Sharma on 20.04.03. It is alleged that from<\/p>\n<p>      the very beginning she started fighting with her<\/p>\n<p>      mother-in-law Smt. Shakuntala Sharma (now dead)<\/p>\n<p>      for   residing    separately,    for   which     she   was<\/p>\n<p>      accommodated and family was shifted to E\/1, Arera<\/p>\n<p>      Colony, Bhopal, still respondent no.2 was not<\/p>\n<p>      satisfied and she started raising disputes and<\/p>\n<p>      thereafter left the matrimonial house and started<\/p>\n<p>      living at Chhatarpur, she pressurized petitioner<\/p>\n<p>      no.1\/husband to live at Chhatarpur.              Petitioner<\/p>\n<p>      no.2 is the elder brother of petitioner no.1 (Jeth of<\/p>\n<p>      respondent no.2), and petitioner no.3 is the wife of<\/p>\n<p>      petitioner no.2 (Jethani of respondent no.2) and<\/p>\n<p>      petitioner no.4 is sister-in-law (Nand of respondent<\/p>\n<p>      no.2), all were living separately.     Respondent no.2<\/p>\n<p>      lodged the report and case under Sections 498-A<\/p>\n<p>      IPC and Sections 3\/4 of Dowry Prohibition Act was<\/p>\n<p>      registered against the petitioners which is pending<\/p>\n<p>      consideration in the Court of JMFC, Bhopal. In the<\/p>\n<p>      meanwhile,       respondent     no.2   entered     into   a<br \/>\n<span class=\"hidden_text\">                                 -3-<\/span><\/p>\n<p>      compromise      and      the    matrimonial   matter   was<\/p>\n<p>      settled.\n<\/p>\n<p>(4)   Learned counsel for petitioners submits that in the<\/p>\n<p>      matrimonial case, respondent no.2 was examined<\/p>\n<p>      on 15.01.09 in which she asserted that there was<\/p>\n<p>      no chance of any joint living so she has filed joint<\/p>\n<p>      application for divorce in which she has also<\/p>\n<p>      narrated that no dispute remains there and all<\/p>\n<p>      disputes have been settled out of Court, and in<\/p>\n<p>      future nobody will take any action against each<\/p>\n<p>      other. Learned counsel for petitioners submits that<\/p>\n<p>      from the statement of respondent no.2 it should be<\/p>\n<p>      drawn that this matter of 498-A IPC and sections<\/p>\n<p>      3\/4 of Dowry Prohibition Act has also been settled<\/p>\n<p>      as such the proceedings may be quashed.<\/p>\n<p>(5)   Learned counsel for respondent no.2 objects, he has<\/p>\n<p>      submitted that the matter of matrimonial dispute<\/p>\n<p>      was settled and for future it was agreed that no<\/p>\n<p>      action will be taken, but the FIR was lodged in this<\/p>\n<p>      case in March, 2004, and had there been some<\/p>\n<p>      compromise in this matter, then it would have been<\/p>\n<p>      agreed     separately,     the    compromise     was   for<\/p>\n<p>      matrimonial case only. Counsel for respondent no.2<\/p>\n<p>      submits that earlier petition under Section 482<br \/>\n<span class=\"hidden_text\">                             -4-<\/span><\/p>\n<p>      Cr.P.C. has been dismissed so new petition is<\/p>\n<p>      barred because learned counsel for the applicants<\/p>\n<p>      did not take any care to revive that petition.<\/p>\n<p>(6)   Learned counsel for petitioners has placed reliance<\/p>\n<p>      on a decision of Apex Court in <a href=\"\/doc\/1892287\/\">Ruchi Agarwal vs.<\/p>\n<p>      Amit Kumar Agrawal and others<\/a> 2005 SCC (Cri.)<\/p>\n<p>      719 in which it has been held that if there is some<\/p>\n<p>      compromise in writing and subsequently if any<\/p>\n<p>      party disputes the compromise, then it cannot be<\/p>\n<p>      permitted and in such a case the proceedings<\/p>\n<p>      should be quashed and the same have been<\/p>\n<p>      quashed by Hon&#8217;ble Apex Court.\n<\/p>\n<p>      Learned counsel for respondent no.2 submits that<\/p>\n<p>the above case law does not apply to the facts of the<\/p>\n<p>instant case.   Here, no compromise took place for the<\/p>\n<p>criminal case referred above.\n<\/p>\n<p>      I do agree with the submission raised by learned<\/p>\n<p>counsel for respondent no.2 that no compromise took<\/p>\n<p>place between the parties regarding the present case.<\/p>\n<p>(7)   Learned counsel has further placed reliance on a<\/p>\n<p>      decision of Single Bench of this Court in <a href=\"\/doc\/41807050\/\">Sanjay<\/p>\n<p>      Anand vs. State of M.P.<\/a> 2006 (1) MPWN Note No.<\/p>\n<p>      98 in which it has been held that a criminal case<\/p>\n<p>      under S.498-A IPC and Ss.3\/4 of Dowry Prohibition<br \/>\n<span class=\"hidden_text\">                               -5-<\/span><\/p>\n<p>      Act, 1961, though not compoundable, but this<\/p>\n<p>      Court can quash FIR, complaint and proceedings in<\/p>\n<p>      interest of justice.\n<\/p>\n<p>      There is no dispute with the aforesaid case law, but<\/p>\n<p>in the case in hand, no compromise took place between<\/p>\n<p>the parties.\n<\/p>\n<p>(8)   Learned    counsel     for    petitioners    submits    that<\/p>\n<p>according to case law of B.S.Joshi and others vs. State<\/p>\n<p>of Haryana and another (2003) 4 SCC 675, the<\/p>\n<p>proceedings may be quashed.\n<\/p>\n<p>(9)   It cannot be disputed that by invoking the extra<\/p>\n<p>ordinary    powers    under        Section   482   Cr.P.C.,   the<\/p>\n<p>proceedings in non-compoundable case under Section<\/p>\n<p>498-A IPC can be quashed, but for that there should be<\/p>\n<p>some specific compromise between the parties. Here in<\/p>\n<p>the case in hand, learned counsel for petitioners want<\/p>\n<p>that from the compromise entered in the matrimonial<\/p>\n<p>case, it should be drawn that this matter has also been<\/p>\n<p>compromised, but that is not true. For every case, there<\/p>\n<p>should be specific compromise. Since respondent no.2 is<\/p>\n<p>categorically objecting for any compromise in this case,<\/p>\n<p>so the proceedings in aforesaid Criminal Case No.<\/p>\n<p>1234\/06 cannot be quashed.\n<\/p>\n<p><span class=\"hidden_text\">                             -6-<\/span><\/p>\n<p>(10)   So, looking to the above circumstances of the case, I<\/p>\n<p>find no ground to invoke the extra ordinary jurisdiction of<\/p>\n<p>this Court under S.482 Cr.P.C.
