Justice R.BASANT\n\n Dated :01\/10\/2007\n\n O R D E R\n                               R.BASANT, J\n                        ------------------------------------\n                        B.A.No.5712 of 2007\n                       -------------------------------------\n               Dated this the 1st day of October, 2007\n\n                                    ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioners are accused 1, 3 &amp;<\/p>\n<p>4. The gist of the allegations against them is that when the police<\/p>\n<p>party, led by the Circle Inspector of Police, reached the spot, they<\/p>\n<p>were found engaging themselves &#8211; 9 named persons including the<\/p>\n<p>petitioners and 21 others, in the conduct of illicit removal of sand<\/p>\n<p>belonging to the local authority.           On seeing the police party, the<\/p>\n<p>accused ran away.     Only some of them could be apprehended.                  9<\/p>\n<p>persons including the petitioners are                named in the F.I.R.     The<\/p>\n<p>petitioners could not be arrested at the scene.               Investigation is in<\/p>\n<p>progress. The petitioners apprehend imminent arrest.<\/p>\n<p>      2.    The learned counsel for the petitioners submits that the<\/p>\n<p>allegations are totally false.      The 1st accused was engaged in the<\/p>\n<p>activity of shrimp farming in his own property. He was engaged in<\/p>\n<p>such activity for a long period of time. It was from his own property<\/p>\n<p>that he was undertaking the operation. Bunds were being constructed<\/p>\n<p>to prevent the escape of shrimps from his farm to the river. It was in<\/p>\n<p>the course of such attempt that the police came to the scene and<\/p>\n<p>raised unnecessary and vexatious allegations against the petitioners.<\/p>\n<p><span class=\"hidden_text\">B.A.No.5712 of 2007                  2<\/span><\/p>\n<p>In these circumstances, the petitioners may be granted anticipatory<\/p>\n<p>bail, it is prayed.\n<\/p>\n<p>       3.     The learned Public Prosecutor     opposes the application.<\/p>\n<p>The learned Public Prosecutor           submits that all the available<\/p>\n<p>indications suggest that the petitioners were involved continuously in<\/p>\n<p>the activity of illicit removal of sand belonging to the local authority.<\/p>\n<p>At the moment and with the available inputs, there is absolutely<\/p>\n<p>nothing to assume that the petitioners were not indulging in the<\/p>\n<p>objectionable activity of removal of sand belonging to the local<\/p>\n<p>authority. In these circumstances, the petitioners may not be granted<\/p>\n<p>anticipatory bail, it is prayed.\n<\/p>\n<p>       4.     I have considered all the relevant circumstances.        A<\/p>\n<p>detailed discussion on the acceptability of the allegations and the<\/p>\n<p>credibility of the data collected is not necessary now. Suffice it to say<\/p>\n<p>that on a total evaluation of all the relevant circumstances, I find no<\/p>\n<p>features in this case which justify the invocation of the extraordinary<\/p>\n<p>equitable discretion under Section 438 Cr.P.C. This, I agree with the<\/p>\n<p>learned Public Prosecutor, is a fit case where the petitioners must<\/p>\n<p>appear before the learned Magistrate and seek regular bail in the<\/p>\n<p>ordinary course.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.5712 of 2007                 3<\/span><\/p>\n<p>      5.   This bail application is, in these circumstances, dismissed,<\/p>\n<p>but with the specific observation that if the petitioners appear before<\/p>\n<p>the learned Magistrate and apply for regular bail after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously.\n<\/p>\n<\/p>\n<p>                                                  (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court S.
