DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with First Information Report registered as<br \/>\n\tII-C.R. No.116\/2010 with Vadodara Police Station, Vadodara (Rural)<br \/>\n\tfor the offences punishable under Section 17 of Narcotic Drugs and<br \/>\n\tPsychotropic Substance Act, 1985.\n<\/p>\n<p>It<br \/>\n\tis submitted that in view of the decision in the case of E.<br \/>\n\tMichael Raj Vs. Intelligence Officer, Narcotic Control Bureau<br \/>\n\treported in (2008) 5 SCC 161 whereby the Supreme Court<br \/>\n\tconsidered certain criterion about determination of small or<br \/>\n\tcommercial quantities in relation to the Narcotic Drugs or<br \/>\n\tPsychotropic substances in a mixture when one or more neutral<br \/>\n\tsubstances and relevance of weight of offending drug in the mixture.<br \/>\n\t It is held that as per the Central Government notification, the<br \/>\n\tquantity is to be considered when punishment is to be passed, on<br \/>\n\tcontent of the offending drug in the mixture and not on the weight<br \/>\n\tof the mixture as such.\n<\/p>\n<p>Considering<br \/>\n\tthe above, it is submitted that out of the total quantity of 850<br \/>\n\tgrams of opium, the content of morphine at the most would be 13.44<br \/>\n\tmg and as per the notification of the Central Government, Item No.92<br \/>\n\tis about opium which prescribes 25 grams as small quantity and 2.5<br \/>\n\tKgs as commercial quantity and Item No.77 morphine prescribes 5 gms<br \/>\n\tas small quantity and 250 grams as commercial quantity.\n<\/p>\n<p>In<br \/>\n\tview of the above and the FSL Report, the applicant deserves bail<br \/>\n\tsince punishment prescribed under the Act would not exceed more than<br \/>\n\t10 years and fine upto Rs.1,00,000\/= in any case.\n<\/p>\n<p>Considering<br \/>\n\tall the above facts, papers submitted alongwith the complaint and<br \/>\n\tthe decision of the Trial Court, I am of the opinion that the case<br \/>\n\tof the applicant, prima-facie is based on the above decision of the<br \/>\n\tApex Court in E. Michael Raj (supra), by imposing<br \/>\n\tsuitable conditions, he is ordered to be enlarged on bail.\n<\/p>\n<p>Having<br \/>\n\theard learned Counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the applicant, by imposing suitable<br \/>\n\tconditions, I deem it just and proper to enlarge the applicant on<br \/>\n\tbail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as II-C.R. No.116\/2010 with<br \/>\n\tVadodara Police Station, Vadodara (Rural), on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one surety of the like<br \/>\n\tamount to the satisfaction of the Trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n\tnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender passport, if any, to the lower court within a week;\n<\/p>\n<p>d)<br \/>\n\tnot leave the State of Gujarat without prior permission of the<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>e)<br \/>\n\tmark presence at the concerned Police Station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\n\tOfficer and also to the Court at the time of execution of the bond<br \/>\n\tand shall not change the residence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
