JUSTICE GURDEV SINGH\n\nPresent:-     Mr. Suvir Sehgal, Addl.A.G., Punjab\n              for the appellants.\n\n              Mr. Gurminder Singh, Advocate\n              for respondents.\n                    ---\n\nORDER:\n<\/pre>\n<p>1.            This appeal has been preferred against order of<\/p>\n<p>learned Single Judge, holding the appellants guilty of contempt<\/p>\n<p>under Section 12 of the Contempt of Courts Act, 1971 (for short,<\/p>\n<p>&#8220;the Act&#8221;).\n<\/p>\n<p>2.            The   respondents     were   employed     as   Punjab<\/p>\n<p>Agriculture Service Class-II officers in the Statistical Wing of the<\/p>\n<p>Agricultural Department.     They filed C.W.P. No.5290 of 1996,<\/p>\n<p>claiming pay scale equal to officers working in equivalent posts in<\/p>\n<p>Administrative Wing. The said claim was upheld vide judgment<\/p>\n<p>dated 7.1.1997. The respondents then filed contempt petition on<\/p>\n<p>10.8.1998, alleging that order dated 7.1.1997 was willfully<\/p>\n<p>disobeyed. Plea of the respondents was accepted and vide order<br \/>\n<span class=\"hidden_text\"> CACP No.2 of 2002                                                    2<\/span><\/p>\n<p>dated 18.10.2001. The appellants were held guilty of contempt<\/p>\n<p>and fine of Rs.2,000\/- each was imposed.\n<\/p>\n<p>3.         This appeal came up for hearing on 15.9.1998 and<\/p>\n<p>following order was passed:-\n<\/p>\n<blockquote><p>                  &#8220;We are prima facie of the view that the appellants<br \/>\n           have not committed any contempt of court. We say so<br \/>\n           because the directions given in CWP No.5290 of 1996 did<br \/>\n           not explicitly contain a direction that the order in Saravjit&#8217;s<br \/>\n           case should be applicable in the petitioner&#8217;s case as well.<br \/>\n           Saravjit&#8217;s case is CWP No.11697 of 1995 decided on May<br \/>\n           6, 1995.\n<\/p><\/blockquote>\n<blockquote><p>                  Therefore, the petitioner has the option of either<br \/>\n           filing a CM in CWP No.5290 of 1996 to seek a direction in<br \/>\n           accordance with Saravjit&#8217;s case or filing a representation<br \/>\n           before the department.\n<\/p><\/blockquote>\n<blockquote><p>                  The petitioner is allowed to file a representation<br \/>\n           within two weeks which shall be decided within one month,<br \/>\n           meanwhile, the case is adjourned to 30.10.2008.&#8221;\n<\/p><\/blockquote>\n<p>4.         In pursuance of the above order, order dated<\/p>\n<p>31.10.2008 was passed by the State, which was against the<\/p>\n<p>respondents. The matter was again considered on 28.11.2008<\/p>\n<p>and following order was passed:-\n<\/p>\n<blockquote><p>                  &#8220;Under the orders dated September 15, 2008, the<br \/>\n           writ petitioners, who were working in the Administrative<br \/>\n           Wing of the Agricultural Department, had been allowed to<br \/>\n           file a representation within two weeks and this was to be<br \/>\n           decided within one month.         The writ petitioners filed<br \/>\n           representation within the prescribed period whereupon the<br \/>\n           Financial Commissioner Development, Punjab passed the<br \/>\n           order dated October 31, 2008 rejecting the representation<br \/>\n           of the writ petitioners.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> CACP No.2 of 2002                                                 3<\/span><\/p>\n<blockquote><p>                  The rejection of the representation means that equal<br \/>\n            pay for equal work is being denied to the writ petitioners<br \/>\n            and parity of pay between the writ petitioners and the<br \/>\n            officers belonging to Class-II of the Administrative Wing<br \/>\n            has not been accepted.\n<\/p><\/blockquote>\n<blockquote><p>                  When the original Writ Petition No.5590 of 2006<br \/>\n            (Statistical Wing) was decided but there was no explicit<br \/>\n            direction that the case of the writ petitioners would be<br \/>\n            covered by Saravjit&#8217;s case which had been decided earlier.\n<\/p><\/blockquote>\n<blockquote><p>                  In view of the above, the appellants seek more time<br \/>\n            to re-consider the whole issue and to pass a fresh order by<br \/>\n            reviewing their order dated October 31, 2008.\n<\/p><\/blockquote>\n<blockquote><p>                  Adjourned to January 14, 2009.\n<\/p><\/blockquote>\n<blockquote><p>                  Copy of the order be given dasti under the<br \/>\n            signatures of Special Secretary of this Court.&#8221;\n<\/p><\/blockquote>\n<p>5.          Thereafter, order dated 19.2.2009 has been passed in<\/p>\n<p>favour of the respondents.\n<\/p>\n<p>6.          Learned counsel for the parties state that nothing<\/p>\n<p>survives and the impugned order may be quashed.<\/p>\n<p>7.
