Sasidharan, J.<\/p>\n<p>1. The order of acquittal of the respondent, who was<br \/>\naccused in S.T.251\/1995 on the file of the Judicial<br \/>\nMagistrate of the First Class, Erattupetta, is challenged<br \/>\nin this appeal by the appellant, who was the defacto<br \/>\ncomplainant in the above case. According to the<br \/>\nappellant, respondent issued Exhibit-P1 cheque for an<br \/>\namount of Rs. 19,000\/- drawn on Syndicate Bank, M.G. Road<br \/>\nBranch, Ernakulam and he presented the cheque for<br \/>\nencashment through the State Bank of Travancore,<br \/>\nPlassanal Branch. The cheque was dishonoured by saying<br \/>\nthat there was no sufficient amount in the account of the<br \/>\nrespondent for honouring the cheque. Appellant issued<br \/>\nnotice on 1-4-1992 to the respondent informing him of the<br \/>\ndishonour of the cheque and demanding payment of the<br \/>\namount covered by the cheque. Exhibit-P7 postal<br \/>\nacknowledgement card would show that notice was received<br \/>\nby the respondent on 15-4-1992. Since the amount covered<br \/>\nby the cheque was not paid by the respondent, complaint<br \/>\nwas filed by the appellant alleging that the respondent<br \/>\ncommitted the offence under Section 138 of the Negotiable<br \/>\nInstruments Act. The trial Court, after taking evidence,<br \/>\nfound that the respondent discharged his liability under<br \/>\nthe cheque even before he lawyer notice was issued to<br \/>\nhim and hence the respondent did not commit the offence<br \/>\npunishable under Section 138 of the Negotiable<br \/>\nInstruments Act. Respondent was hence acquitted by the<br \/>\ntrial Court.\n<\/p>\n<p>2. In this appeal the appellant says that<br \/>\nthe finding by the trial Court that under Exhibit-D3<br \/>\nagreement dated 11-3-1992 the respondent discharged his<br \/>\nliability even before the notice was issued to the<br \/>\nrespondent is incorrect.\n<\/p>\n<p>3. The appellant gave evidence in the trial<br \/>\nCourt as P.W.1. He said about the fact that Exhibit-P1<br \/>\ncheque issued by the respondent was dishonoured by the<br \/>\nbank for the reason that there was no sufficient amount<br \/>\non the account of the respondent. P.W.2 is the Bank<br \/>\nManager who said that on the date on which Exhibit-P1<br \/>\ncame to the bank for encashment there was only an amount<br \/>\nof Rs. 121.30 in the account of the respondent and that<br \/>\nthe cheque was dishonoured for the reason that there was<br \/>\nno sufficient amount in the account of the respondent.\n<\/p>\n<p>4. Accused was examined as D.W.1 and his<br \/>\ncontention is that he is a Share Broker having licence<br \/>\nfrom the Stock Exchange and that the appellant entrusted<br \/>\n400 share certificates with him and when the appellant<br \/>\ndemanded back the share certificates those certificates<br \/>\nwere with the Stock Exchange and hence he issued<br \/>\nExhibit-P1 cheque to the appellant for an amount of<br \/>\nRs. 19,000\/-. He would contend that he did not execute<br \/>\nExhibit-P9 agreement. The non-production of Exhibit-P9<br \/>\nalong with the complaint is also pointed out by the<br \/>\nrespondent to show that Exhibit-P9 is not a genuine<br \/>\ndocument.\n<\/p>\n<p>5. D.W.2 is the attestor to Exhibit-D3<br \/>\nproved by the respondent when he was examined in the<br \/>\ntrial Court. What is stated in Exhibit-D3 is that the<br \/>\nappellant received from the respondent 400 shares on<br \/>\n11-3-1992. Mention is made in Exhibit-D3 regarding the<br \/>\ncheque that was issued by the respondent and the<br \/>\nagreement was that since the cheque had been sent for<br \/>\ncollection it would be given to the respondent as and<br \/>\nwhen it was returned to him. There is also statement in<br \/>\nExhibit-D3 that all the dealings between the appellant<br \/>\nand the respondent in connection with the share<br \/>\ncertificates came to an end.\n<\/p>\n<p>6. The learned counsel appearing for the<br \/>\nappellant would say that Exhibit-D3 is not a genuine<br \/>\ndocument and on the basis of that document it cannot be<br \/>\nsaid that the amount covered by the cheque had already<br \/>\nbeen paid by the respondent. The decision on the<br \/>\nquestion whether the share certificates had been given<br \/>\nback to the appellant and there was agreement that the<br \/>\ncheque Exhibit-P1 would be given back when the cheque was<br \/>\nreturned from the bank, depends mainly on the finding on<br \/>\nthe question whether Exhibit-D3 is a genuine document.<br \/>\nThe trial Court said that Exhibit-D3 was given by the<br \/>\nappellant to the respondent and it was on the basis of<br \/>\nthe statements in Exhibit-D3 that it was found that the<br \/>\nliability was discharged by the respondent even prior to<br \/>\nthe issuance of notice by the appellant. On going<br \/>\nthrough the evidence of D.W.2 it is seen that he speaks<br \/>\nabout the issuance of Exhibit-D3 receipt by the<br \/>\nappellant. According to him, he was present when that<br \/>\ndocument was executed and he put his signature in that<br \/>\ndocument as an attestor. According to the learned<br \/>\ncounsel appearing for the appellant, the evidence of<br \/>\nD.W.2 cannot be believed, because D.W.1 said that the<br \/>\nreceipt was returned and handed over to the appellant in<br \/>\nBlue Moon Hotel whereas D.W.2 said that it was in the<br \/>\nrestaurant in the above hotel that receipt was handed<br \/>\nover to the appellant. It is true that D.W.1 says that<br \/>\nreceipt was written and handed over to the appellant in<br \/>\nthe Reception of Blue Moon Hotel. D.W.2 says that the<br \/>\nreceipt was signed by the appellant and was handed over<br \/>\nto the respondent in Blue Moon Restaurant. Even if there<br \/>\nare some minor contradictions in the versions of D.Ws.1<br \/>\nand 2 regarding the place where the receipt was written<br \/>\nand given to the respondent both of them say that it took<br \/>\nplace in Blue Moon Hotel. There is no material<br \/>\ncontradiction in the versions of D.Ws.1 and 2 to show<br \/>\nthat their version regarding the issuance of Exhibit-D3<br \/>\nreceipt cannot be believed. On going through the<br \/>\njudgment of the trial Court also it is seen that<br \/>\nsufficient reason is given by the learned Magistrate for<br \/>\nholding that Exhibit-D3 was actually given by the<br \/>\nappellant to the respondent. The finding by the trial<br \/>\nCourt that the respondent discharged his liability even<br \/>\nbefore sending the lawyer notice is on the basis of legal<br \/>\nevidence. The conclusion arrived at by the learned<br \/>\nMagistrate that the respondent did not commit the offence<br \/>\npunishable under Section 138 of the Negotiable<br \/>\nInstruments Act is correct.\n<\/p>\n<p>There is no merit in this appeal.
