No. 1900 of 2010\n                         ------------------------------------------\n                     Dated this the 3rd day of February, 2011\n\n                                    JUDGMENT\n<\/pre>\n<p>Ramachandra Menon, J.\n<\/p>\n<p>              The appellants are the unsuccessful writ petitioners who<\/p>\n<p>approached this Court seeking to set aside Ext.P3 select list and also to<\/p>\n<p>declare that the selection process for appointment from among persons<\/p>\n<p>registered in the Employment Exchange should be on the basis of their<\/p>\n<p>seniority of registration in the Employment Exchange.<\/p>\n<p>              2.  The appellants are stated as having registered with the<\/p>\n<p>Employment Exchange, Palakkad and Ext.P1 is a copy of the registration<\/p>\n<p>card issued to one of them. By virtue of their registration, in connection with<\/p>\n<p>the process of selection to the post of Part Time Menials, call letters were<\/p>\n<p>issued to the appellants as borne by Ext.P2.                 The requisite number of<\/p>\n<p>candidates were sponsored by the Employment Exchange, based on which<\/p>\n<p>the selection was conducted by the requisitioning authority and Ext.P3 select<\/p>\n<p>list of 41 persons was published; whereby the appellants\/petitioners<\/p>\n<p>happened to be left out which made them to approach this Court by filing the<\/p>\n<p>writ petition.\n<\/p>\n<p>              3. The learned counsel for the appellants submits that Ext.P3<\/p>\n<p>W.A. No.1900 of 2010\n<\/p>\n<p>                                     &#8211; 2 &#8211;\n<\/p>\n<p>select list has been prepared in an unscientific manner without any<\/p>\n<p>regard to the seniority in the matter of registration in the Employment<\/p>\n<p>Exchange which ought not to have been pursued as a basis in the<\/p>\n<p>process of selection and appointment by the governmental authorities .<\/p>\n<p>It is also stated that by virtue of the course adopted by the concerned<\/p>\n<p>respondents the appellants who happened to be seniors in the matter of<\/p>\n<p>registration in the Employment Exchange have been left out while their<\/p>\n<p>juniors have been given appointment.\n<\/p>\n<p>             4.    The contention of the appellants\/petitioners was<\/p>\n<p>considered by the learned Single Judge and interference was declined,<\/p>\n<p>holding that no vested right under any specific provision of law has<\/p>\n<p>been pointed out in support of their contention, which in turn is the<\/p>\n<p>subject matter of challenge in this writ appeal.<\/p>\n<p>             5.   Going by the nature of the contentions, it is to be<\/p>\n<p>primarily noted that the appellants who were seeking to quash Ext.P3<\/p>\n<p>select list  have not chosen to implead the parties who have been<\/p>\n<p>selected as per in Ext.P3 and the proceedings are to fail on this score<\/p>\n<p>alone.\n<\/p>\n<p>             6. With regard to the merit of the contentions, there is<\/p>\n<p>nothing wrong on the part of the requisitioning authority in having<\/p>\n<p>subjected the credentials of the persons sponsored from the<\/p>\n<p>W.A. No.1900 of 2010\n<\/p>\n<p>                                &#8211; 3 &#8211;\n<\/p>\n<p>Employment Exchange       to scrutiny before appointing the eligible<\/p>\n<p>persons.    None of the grounds raised in support of the writ petition as<\/p>\n<p>well as the writ appeal does serve any purpose.
