Justice ANTONY DOMINIC\n\n Dated :07\/02\/2011\n\n O R D E R\n                    ANTONY DOMINIC, J.\n                       -------------------------\n                  W.P (C) No. 1152 of 2010\n                      --------------------------\n              Dated this the 7th February, 2011\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner approached this Court challenging Ext.P3,<\/p>\n<p>a notice issued by the 1st respondent requiring the<\/p>\n<p>petitioner to vacate from the premises in respect of which<\/p>\n<p>Ext.R1 (a) licence has been granted to him.         It is stated<\/p>\n<p>that    a building with eight rooms was given to the<\/p>\n<p>petitioner on license, a copy of which is produced as<\/p>\n<p>Ext.R1 (a). This licence was for a period of two years and<\/p>\n<p>the period has expired on 18.6.2009.            In view of the<\/p>\n<p>expiry of the period, petitioner was issued notice dated<\/p>\n<p>15.6.2009 asking him to vacate from the premises. At that<\/p>\n<p>stage, petitioner applied to the 1st respondent requesting<\/p>\n<p>to extend the period of licence.\n<\/p>\n<p>      2.    The counter affidavit shows that a meeting of<\/p>\n<p>the 1st respondent considered this request of the petitioner<\/p>\n<p>and it was decided not to extend the licence and to invite<\/p>\n<p>fresh tender\/auction. In pursuance to the above, Ext.P3<\/p>\n<p>notice dated 1.1.2010 was issued calling upon the<\/p>\n<p>W.P (C) No.1152 of 2010<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>petitioner to vacate from the premises.       It is in these<\/p>\n<p>circumstances, this writ petition is filed and       on the<\/p>\n<p>strength of an interim order obtained from this Court,<\/p>\n<p>petitioner is continuing occupation of the premises.<\/p>\n<p>      3.   Admittedly, the period of license has expired.<\/p>\n<p>Therefore, the petitioner can have no right whatsoever to<\/p>\n<p>insist on continuance of his occupation of the premises.<\/p>\n<p>The fact that license fee has been paid to the period<\/p>\n<p>subsequent    to   18.6.2009  ,when    the   license  period<\/p>\n<p>expired,also will not give rise to any legal right for the<\/p>\n<p>petitioner to contend that licence has been renewed.<\/p>\n<p>Therefore, the petitioner will have to surrender vacant<\/p>\n<p>possession    of the premises and respondents are free to<\/p>\n<p>conduct fresh tender\/auction as they deem it appropriate.<\/p>\n<p>      4.   In that view, Ext.P3 cannot be faulted for on any<\/p>\n<p>ground.\n<\/p>\n<p>      5.   Be that as it may, the fact remains that the<\/p>\n<p>petitioner has invested considerable amount and is now<\/p>\n<p>operating the resort for tourism purposes.        Therefore,<\/p>\n<p>immediate eviction of the petitioner, is of no benefit to the<\/p>\n<p>respondents also. Therefore, I feel that the interest of the<\/p>\n<p>W.P (C) No.1152 of 2010<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>respondents will not be prejudiced if the petitioner is<\/p>\n<p>permitted to continue the occupation of the premises till a<\/p>\n<p>fresh license is granted to anybody by conducting fresh<\/p>\n<p>auction\/tender.    However, taking note of the submission<\/p>\n<p>made by the learned Government Pleader that amounts are<\/p>\n<p>due from the petitioner, it is clarified that       continued<\/p>\n<p>occupation can only be allowed if the petitioner clears the<\/p>\n<p>entire arrears that are due.\n<\/p>\n<p>      6.   Therefore I dispose of this writ petition with the<\/p>\n<p>following directions.\n<\/p>\n<p>      Challenge against Ext.P3 is repelled and it is directed<\/p>\n<p>that respondents are free to conduct fresh tender\/auction<\/p>\n<p>for granting licence in respect of the premises in question.<\/p>\n<p>Petitioner will be permitted to continue to occupy the<\/p>\n<p>premises till licence is granted to anybodyelse subject to<\/p>\n<p>condition that the arrears if any shall be cleared and future<\/p>\n<p>licence fee at the applicable rate shall be paid without any<\/p>\n<p>default.\n<\/p>\n<p>                                             Sd\/-<\/p>\n<pre>\n                                 ANTONY DOMINIC\n                                          JUDGE\nma\n                 \/True copy\/    P.A to Judge\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mathew.M.S.
