Justice R.BASANT\n\n Dated :13\/08\/2007\n\n O R D E R\n                           R.BASANT, J.\n                        ----------------------\n                        B.A.No.4976 of 2007\n                    ----------------------------------------\n              Dated this the 13th day of August 2007\n\n\n                               O R D E R\n<\/pre>\n<p>      Application for anticipatory bail.               The petitioner is the<\/p>\n<p>second accused. The crime is registered under Section 420 read<\/p>\n<p>with 34 I.P.C.      The first accused is the son of the second<\/p>\n<p>accused.    The petitioner\/second accused had earlier filed a<\/p>\n<p>complaint under Section 138 of the Negotiable Instruments Act<\/p>\n<p>against the de facto complainant herein.                   As a counter blast<\/p>\n<p>against the said proceedings initiated by the second respondent,<\/p>\n<p>the de facto complainant, the accused in that case, has allegedly<\/p>\n<p>filed a private complaint before the learned Magistrate. That has<\/p>\n<p>been referred to the police under Section 156(3) Cr.P.C for<\/p>\n<p>investigation. Crime has been registered. Investigation is in<\/p>\n<p>progress. The petitioner\/second accused apprehends imminent<\/p>\n<p>arrest. The first accused, that is the son of the petitioner, is not<\/p>\n<p>available in India now.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that<\/p>\n<p>the proceedings initiated is nothing but transparent abuse of the<\/p>\n<p><span class=\"hidden_text\">B.A.No.4976\/07                  2<\/span><\/p>\n<p>process of the court. Merely because the petitioner had initiated<\/p>\n<p>the   proceedings     under  Section   138  of   the   Negotiable<\/p>\n<p>Instruments Act, the present complaint has been filed against<\/p>\n<p>not only the petitioner but also his son employed abroad. It is<\/p>\n<p>prayed that anticipatory bail may be granted to the petitioner.<\/p>\n<p>      3.    The learned Public Prosecutor does not oppose the<\/p>\n<p>said prayer and in the circumstances to which I have made brief<\/p>\n<p>reference already, I am satisfied that directions under Section<\/p>\n<p>438 Cr.P.C can be issued in favour of the petitioner.<\/p>\n<p>      4.    In the result, this petition is allowed.    Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p>      i)    Petitioner  shall  surrender   before    the  learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 20\/8\/2007.<\/p>\n<p>      ii)   He shall be released on regular bail on condition that<\/p>\n<p>he executes a bond for Rs.25,000\/-(Rupees twenty five thousand<\/p>\n<p>only) with two solvent sureties each for the like sum to the<\/p>\n<p>satisfaction of the learned Magistrate.\n<\/p>\n<p>      iii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p><span class=\"hidden_text\">B.A.No.4976\/07                   3<\/span><\/p>\n<p>and 12 noon on 21\/08\/2007 and 22\/08\/2007 and thereafter on all<\/p>\n<p>Mondays and Fridays between 10 a.m and 12 noon for a period<\/p>\n<p>of one month and subsequently as and when directed by the<\/p>\n<p>investigating officer in writing to do so.\n<\/p>\n<p>      (iv) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioner and deal with him in accordance with law,<\/p>\n<p>as if these directions were not issued at all.<\/p>\n<p>      (v)   If he were arrested prior to 20\/8\/2007, he shall be<\/p>\n<p>released from custody on his executing a bond for Rs.25,000\/-<\/p>\n<p>(Rupees twenty five thousand only) without any sureties,<\/p>\n<p>undertaking to appear before the learned Magistrate on<\/p>\n<p>27\/7\/2007.\n<\/p>\n<p>      Hand over copy of this order to the learned counsel for the<\/p>\n<p>petitioner.<\/p>\n<pre>\n\n\n\n                                             (R.BASANT, JUDGE)\njsr\n\n                 \/\/ True Copy\/\/      PA to Judge\n\n<span class=\"hidden_text\">B.A.No.4976\/07    4<\/span>\n\n<span class=\"hidden_text\">B.A.No.4976\/07    5<\/span>\n\n       R.BASANT, J.\n\n\n\n\n         CRL.M.CNo.\n\n\n\n\n            ORDER\n\n\n\n\n21ST DAY OF MAY2007\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sivadasan vs State Of Kerala on 13 August, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 4976 of 2007() 1.
