KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\n     The appeal\t is directed  against the judgment and order<br \/>\nof the\tPunjab and Haryana High Court in Criminal Appeal No.<br \/>\n242 DB\/88.  The High  Court confirmed  the conviction of the<br \/>\nappellants under  Section 148  and Sections 324, 325 and 302<br \/>\nI.P.C. all  read with  Section 149  I.P.C. recorded  by\t the<br \/>\nSessions Court. Ambala in Sessions Case No. 22\/87.\n<\/p>\n<p>     The appellants  on the  one hand and the two deceased &#8211;<br \/>\nBachittar Singh\t and Bachan  Singh on  the other  hand\twere<br \/>\ndistant collaterals  and they  had `baras&#8217;  situated side by<br \/>\nside on\t the outskirts\tof their  village  near\t the  common<br \/>\nboundary of  two `baras&#8217;  there was  a `kikar&#8217;\ttree  and  a<br \/>\ndispute was  going on  between them  since long\t as  regards<br \/>\nownership of that tree. On June 5, 1987, at about 6.00 p.m.,<br \/>\nappellant No.5 &#8211; Swaran Kaur was seen by Bachittar singh and<br \/>\nBachan\t singh standing\t near that kikar tree. they also saw<br \/>\nAvtar Singh &#8211; appellant No. 4 cutting branches of that tree.<br \/>\nSo, Bachittar Singh and Bachan Singh went to that `bara&#8217; and<br \/>\nprotested against Avtar Singh cutting the branches. That led<br \/>\nto an  exchange of  hot words  and  abuses  followed  by  an<br \/>\nassault on  Bachittar Singh  and Bachan\t Singh. According to<br \/>\nthe prosecution case, seeing this assault on Bachittar singh<br \/>\nand Bachan  Singh, Labh Singh &#8211; PW 17 and Pala Singh &#8211; PW 18<br \/>\nwent to\t their rescue  but they were also assaulted by Avtar<br \/>\nSingh, Ram  Singh &#8211; appellant No. 1, Didar singh &#8211; appellant<br \/>\nNo. 2 and Piara Singh &#8211; appellant No. 3 who had also by that<br \/>\ntime reached  that place  armed with weapons. As a result of<br \/>\nthat assault,  Bachittar Singh\tand Bachan  Singh lost their<br \/>\nlives and Labh Singh and Bachan Sing received some injuries.\n<\/p>\n<p>     In\t order\tto  prove  its\tcase,  the  prosecution\t had<br \/>\nexamined three eye-witnesses, Labh Singh &#8211; pw 17, Pala Singh\n<\/p>\n<p>&#8211; PW  18 and  Kirpal Singh  &#8211; 19.  The trial  court believed<br \/>\ntheir evidence\tand convicted  all the\tfive appellants. The<br \/>\nHigh  Court  accepting\tevidence    of\tthose  eye-witnesses<br \/>\nconfirmed the conviction  of all the appellants.\n<\/p>\n<p>     Mr. Tulsi,\t learned senior\t counsel for the appellants,<br \/>\nsubmitted that\tthe High  Court has  failed to consider that<br \/>\nthe eye-witnesses  have not  correctly stated  the manner in<br \/>\nwhich the incident had started and also failed to appreciate<br \/>\nthat Didar  Singh &#8211;  appellant No. 4 was falsely implicated.<br \/>\nHe also\t submitted that\t the defence  version that appellant<br \/>\nNo. 1,\t4 and  5 had  acted in\tself-defence  while  causing<br \/>\ninjuries to  Bachittar Singh,  Bachan Singh,  Labh singh and<br \/>\nPala singh,  was more probable than the version given by the<br \/>\neye witnesses.\tOn the\tother hand,  learned counsel for the<br \/>\nrespondent &#8211;  State submitted  that  looking  to  the  large<br \/>\nnumber of  injuries received  by Bachittar  Singh and Bachan<br \/>\nSingh, the  plea  of  self-defenceurged\t by  the  appellants<br \/>\ncannot be believed  and was, therefore, rightly\t rejected by<br \/>\nthe High  Court. He also submitted that the evidence of Labh<br \/>\nSingh and Pala Singh is also corroborated by the evidence of<br \/>\nan independent-witnesse\t PW 19,\t Kirpal singh  and therefore<br \/>\nthe High  Court was  right in  accepting their\tevidence and<br \/>\nconfirming the conviction of appellants.\n<\/p>\n<p>     We have  carefully gone  through the  evidence  of\t the<br \/>\nthree eye-witnesses.  All of  them have\t stated that  seeing<br \/>\nappellant No.  5 &#8211;  Swaran Kaur standing near the Kikar tree<br \/>\nand Avtar  Singh &#8211;  appellant No. 4 cutting branches of that<br \/>\ntree. Bachittar\t Singh and  Bachan Singh  had  gone  to\t the<br \/>\n`bara&#8217; and  seeing an  assault on  them Labh  Singh and Pala<br \/>\nSingh had  rushed to  that place.  Though their\t evidence is<br \/>\nconsistent, it\tis quite  vague as  regards the\t assault  on<br \/>\nBachittar Singh\t and Bachan  singh. There were nine injuries<br \/>\non the\tbody of\t Bachittar singh  but the eye-witnesses have<br \/>\nnot explained  how those  nine injuries\t were caused to him.<br \/>\nThey have only vaguely stated that Piara Singh and Ram Singh<br \/>\nassaulted their\t father with  `sotis&#8217; and  therefore he\t had<br \/>\nfallen\tdown.\tBoth  Labh   Singh  and\t  Pala\tSingh  stand<br \/>\ncontradicted by\t their police  statements, wherein  they had<br \/>\nstated that  they had  not seen Avtar Singh cutting branches<br \/>\nof the\ttree. Their  version before  the court was that they<br \/>\nhad  heard  noise  of  cutting\tbranches  of  a\t tree.\tThis<br \/>\nimprovement made  by  the  witnesses  was  not\twithout\t any<br \/>\npurpose. No  cut branches  were\t noticed  at  the  place  of<br \/>\noccurrence. There  is neither mention of it in the site plan<br \/>\nnor any\t cut wood  was seized  by  the\tpolice.\t Both  these<br \/>\ninfirmities  in\t  their\t evidence  create  a  serious  doubt<br \/>\nregarding the  reason why  and the  manner in which they had<br \/>\ngone to that `bara&#8217;. The evidence also discloses that during<br \/>\nthis very  incident Avtar  Singh had received three injuries<br \/>\nand Swaran  kaur had  also received  two blows. According to<br \/>\nthe eye-witnesses,  none from  their side  had\tcarried\t any<br \/>\nweapon. An  attempt was\t made by Labh singh before the court<br \/>\nto explain  the injury on the hand of Swaran Kaur by stating<br \/>\nthat Avtar  Singh had  aimed a\tblow  at  him,\tbut  he\t had<br \/>\nretreated with\tthe result  that it  fell on Swaran Kaur. He<br \/>\nthen stated  that by  that hands  of Ram  singh and then had<br \/>\ngiven  some   blows  to\t Avtar\tSingh.\tThis  was  again  an<br \/>\nimprovement made  by him  as he\t had not  so stated  in\t his<br \/>\npolice\tstatement.  We\tfine  that  the\t eye-witnesses\thave<br \/>\nneither given the correct account regarding how the incident<br \/>\nstarted nor  explained\tsatisfactorily\tinjuries  caused  to<br \/>\nappellant Nos. 4 and 5.\n<\/p>\n<p>     We also  find that\t appellant No.\t2 Didar Singh was in<br \/>\nall  probability  falsely  involved  by\t the  eye-witnesses.<br \/>\nAccording to them. Didar Singh had run to that `bara&#8217; with a<br \/>\n`Gandasa&#8217; in  his hand\tand given one blow with it to Bachan<br \/>\nSingh.\t`Gandasa&#8217;  is  a  sharp\t edged\tweapon.\t No.  injury<br \/>\npossible by  a sharp edged weapon was found on the person of<br \/>\nBachan Singh.\n<\/p>\n<p>     All these\tinfirmities in the evidence create a serious<br \/>\ndoubt  regarding  the  manner  in  which  the  incident\t had<br \/>\nhappened.  Appellant  Nos.1,4  and  5  have  admitted  their<br \/>\npersence at the seen of the offence. They have explained why<br \/>\nSwaran kaur  had gone to their `bara&#8217; and how and under what<br \/>\ncircumstances they had gone there and caused injuries to the<br \/>\nother side. What they have said appears to be more probable.<br \/>\nFor all\t these reasons,\t conviction of the appellants cannot<br \/>\nbe sustained.\n<\/p>\n<p>     We,  therefore,   allow  this  appeal,  set  aside\t the<br \/>\njudgment  and  order  of  the  High  Court  and\t acquit\t the<br \/>\nappellants of  all the\tcharges levelled against them.
