    Counsel  for  the  petitioners\/decree   holders<\/p>\n
submits that in execution of the decree in O.S.No.<\/p>\n
406\/92  on  the  file   of  the  Munsiff’s   Court,<\/p>\n
Nedumangadu vide E.P.No.1\/95, a boundary wall was<\/p>\n
put  up;  that  the   respondents\/judgment  debtors<\/p>\n
raised an objection that the said boundary wall was<\/p>\n
not put up along the I-J line shown in the plan<\/p>\n
(Exhibit  C1(a)  appended   to  the  decree;   that<\/p>\n
thereupon the execution court, on E.A.No.265\/05<\/p>\n
filed by the petitioners\/decree holders, deputed<\/p>\n
Advocate Sri.B.Ramesan Nair as the Commissioner to<\/p>\n
visit the property and submit a report and plan<\/p>\n
with the assistance of Sri.B.Sadasivan, a retired<\/p>\n
Surveyor;  that   accordingly,   the   Commissioner<\/p>\n
visited  the  property  and  submitted  Exhibit  P5<\/p>\n
report and plan to the effect that boundary wall<\/p>\n
was put up in execution, but not on the I-J line;<\/p>\n
that petitioners\/decree holders filed Exhibit P6<\/p>\n
WPC 3747\/07              2<\/span><\/p>\n
objection to Exhibit P5 commission report and plan<\/p>\n
and filed Exhibit P7 application requesting for<\/p>\n
boundary being put up along the I-J line shown in<\/p>\n
Exhibit C1(a) plan appended to the decree in the<\/p>\n
suit, as the boundary wall put up had  already been<\/p>\n
demolished; that again, Advocate Sri.Ramesan Nair<\/p>\n
was appointed as the Commissioner vide Exhibit P7<\/p>\n
(a) order to help the Amin to put up the boundary<\/p>\n
with the help of Sri.Ravikumar, a retired Surveyor;<\/p>\n
that on their inspection, it was found that the<\/p>\n
boundary wall which had been put up earlier was<\/p>\n
precisely on the I-J line and Exhibit P5 report and<\/p>\n
plan submitted by them reporting that the boundary<\/p>\n
is not put up along the I-J line was wrong, but,<\/p>\n
instead of rectifying the wrong report and plan,<\/p>\n
the Commissioner was insisting the petitioners\/<\/p>\n
decree    holders to settle  the  matter with   the<\/p>\n
respondents\/judgment debtors and did not file any<\/p>\n
fresh    commission report  till  now  before   the<\/p>\n
execution court and that the execution court also<\/p>\n
WPC 3747\/07               3<\/span><\/p>\n
is not taking any steps to make any progress to<\/p>\n
have the decree in the suit satisfied and has even<\/p>\n
rejected    E.A.No.434\/06,  filed  to   change  the<\/p>\n
Commissioner and Surveyor, vide Exhibit P9 order.<\/p>\n
     2. Despite service of notice on the judgment<\/p>\n
debtors, who are respondents 1 to 7 herein, they<\/p>\n
have not entered appearance before this Court and<\/p>\n
have not engaged any Lawyer till this date.<\/p>\n
     3. In the circumstances, I direct the court<\/p>\n
below, namely, the Munsiff, Nedumangadu, to see to<\/p>\n
it that the decree in O.S.No.406\/92, sought to be<\/p>\n
got   executed  by  the  petitioners\/decree holders<\/p>\n
filing E.P.No.1\/95, is executed expeditiously and<\/p>\n
the boundary put up as prayed for in the execution<\/p>\n
petition in compliance with Exhibit C1(a) plan<\/p>\n
appended to the decree by deputing an Amin, with<\/p>\n
the assistance of Advocate Commissioner Sri.Ramesan<\/p>\n
Nair and retired Surveyor Sri.Ravikumar, appointed<\/p>\n
vide    Exhibit  P7(a)  order  dated  8.11.2006  on<\/p>\n
E.A.No.363\/06.    The court below shall also probe<\/p>\n
WPC 3747\/07               4<\/span><\/p>\n
into the question as to why the Amin deputed to put<\/p>\n
up the boundary as per the aforesaid order dated<\/p>\n
8.11.2006 has not put up the boundary and submitted<\/p>\n
the report and as to why the Commissioner also did<\/p>\n
not   submit  any  report  and  as  to whether   the<\/p>\n
Commissioner and the Surveyor have withdrawn the<\/p>\n
bata    deposited  pursuant   to  the  order   dated<\/p>\n
8.11.2006.    Counsel  for   the  petitioners\/decree<\/p>\n
holders    expresses  doubt   as  to   whether   the<\/p>\n
Commissioner    will  co-operate,  as   instead  of<\/p>\n
assisting the Amin to execute the decree, he was<\/p>\n
persuading the parties to arrive at a settlement,<\/p>\n
as he happened to file a report probably on having<\/p>\n
been mislead by the Surveyor reporting that the<\/p>\n
boundary put up was not on the I-J line shown in<\/p>\n
Exhibit C1(a) plan appended to the decree.   In the<\/p>\n
event     of  the   Commissioner  Sri.Ramesan   Nair<\/p>\n
expressing any difficulty in executing the decree,<\/p>\n
the court below shall be at liberty to appoint<\/p>\n
another competent Commissioner to execute the work<\/p>\n
WPC 3747\/07               5<\/span><\/p>\n
of assisting the Amin in putting up the boundary<\/p>\n
assisted by a competent retired Surveyor and in<\/p>\n
that event if at all the earlier Commissioner and<\/p>\n
the retired Surveyor appointed vide Exhibit P7(a)<\/p>\n
order, had already received the bata,    they shall<\/p>\n
be  caused  to   re-deposit the  amount   in  court.<\/p>\n
However, executing the decree by deputing another<\/p>\n
Commissioner and retired Surveyor need not await<\/p>\n
re-deposit of the bata if any received by the<\/p>\n
earlier Commissioner and retired Surveyor and the<\/p>\n
petitioners\/decree   holders   shall   deposit   the<\/p>\n
required bata that may be ordered by the execution<\/p>\n
court to expedite the execution. To that extent,<\/p>\n
Exhibit P9 order shall stand set aside.<\/p>\n
     The writ petition is disposed of with the above<\/p>\n
directions.\n<\/p>\n
