Application No.524 of 2011 whereby the<br \/>\n\trespondent-accused was granted regular bail in connection with the<br \/>\n\toffence registered before the &#8220;C&#8221; Division Police<br \/>\n\tStation, Dist:Bhavnagar being I-CR-NO-62 of 2011 for the offence<br \/>\n\tpunishable under Sections 406, 409, 120(B) and 201 of the Indian<br \/>\n\tPenal Code, the applicant has preferred the present Criminal<br \/>\n\tMisc.Application for cancellation of regular bail granted to the<br \/>\n\trespondent-accused.\n<\/p>\n<p>The<br \/>\n\tfacts leading to the filing of the complaint is that the State of<br \/>\n\tGujarat under the scheme of &#8220;Sarva Shiksha Abhiyan&#8221; for<br \/>\n\t8th<br \/>\n\tStandard beneficiary students and under the scheme of &#8220;EDN&#8221;<br \/>\n\tfor 9th<br \/>\n\tto 12th<br \/>\n\tstandard beneficiary students has decided to distribute the study<br \/>\n\tbooks and for that from the year 2006 to 2011 study book of each<br \/>\n\tsubjects of Rs.22,93,466\/- had been allotted to the<br \/>\n\tGovernment\/Granted schools of Bhavnagar District from Gandhinagar<br \/>\n\tSchool Study Books Organization (Gandhinagar Shala Pathya Pustak<br \/>\n\tMandal). It is alleged in the F.I.R. that from the year 2004 to the<br \/>\n\tdate of offence revealed, the accused persons with the connivance of<br \/>\n\teach other and by way of hatching a conpiracy with a view to cause<br \/>\n\tfinancial damage to the beneficiary students and their parents by<br \/>\n\tnot distributing the study books amongst them and with a view to get<br \/>\n\tthe financial benefit had sold away the study books illegally<br \/>\n\tinstead of distributing them to the beneficiary students under the<br \/>\n\tscheme an thereby caused a huge amount of loss to the students and<br \/>\n\ttheir parents.\n<\/p>\n<p>\tUpon<br \/>\n\tF.I.R. being filed, accused came to be arrested and having completed<br \/>\n\tthe remand period sent to judicial custody, and thereafter, an<br \/>\n\tapplication for regular bail was preferred. After hearing both the<br \/>\n\tparties, the learned judge was pleased to grant the regular bail to<br \/>\n\tthe respondent accused.\n<\/p>\n<p>\tLearned<br \/>\n\tAdditional Public Prosecutor Ms.Mini Nayar vehemently submitted that<br \/>\n\tthe accused persons by way of hatching a consiracy with the<br \/>\n\tconnivance of each other were found selling study books which were<br \/>\n\tactually allotted for distribution of beneficiary of students under<br \/>\n\tthe Scheme of &#8220;Sarva Shiksha Abhiyan&#8221; for 8th<br \/>\n\tstandard under the scheme of &#8220;EDN&#8221; for 9th to<br \/>\n\t12th Standard students and by not doing so caused<br \/>\n\tfinancial damage to the students as well as their parents.\n<\/p>\n<p>\tShe<br \/>\n\thas further stated that all the accused persons have been involved<br \/>\n\tin a serious offence and the amount of damage runs into crores of<br \/>\n\trupees. Hence, looking to the gravity and seriousness of the<br \/>\n\toffence, bail ought not to have been granted to the accused persons.\n<\/p>\n<p>\tI<br \/>\n\thave perused the copy of F.I.R. at Page No.11 and also perused the<br \/>\n\tletter dated 01.07.2011 written by Dr.Kamlesh Parmar and H.A.Jhala,<br \/>\n\tOfficials of Gujarat Rajyashala Pathya Pushtak Mandal. Referring the<br \/>\n\tsame, it appears that according to the F.I.R., incident had been<br \/>\n\toccurred at any time prior to 28.06.2011 and referring the above<br \/>\n\tletter dated 01.07.2011, it appears that as the news regarding the<br \/>\n\tabove referred incident published in the newspapers, the said letter<br \/>\n\thas been written by said Dr.Kamlesh Parmar and H.A.Jhala to the<br \/>\n\tPolice Inspector, &#8220;C&#8221; Division Police Station,<br \/>\n\tBhavnagar.\n<\/p>\n<p>\tIt<br \/>\n\tappears that up to date, complaint which was required to be filed by<br \/>\n\tthe State has not been filed. It further appears that while filing<br \/>\n\tthe F.I.R., the data, which was easily available with the applicant,<br \/>\n\tappears to have not been furnished to the Investigating Officer.<br \/>\n\tMoreover, it is pertinent to note that since the charge-sheet has<br \/>\n\talready been filed on 26.09.2011, the investigation appears to have<br \/>\n\tbeen over.\n<\/p>\n<p>\tI<br \/>\n\thave gone through the order below Exh.1 dated 03.08.2011, passed by<br \/>\n\tAdditional Sessions Judge, Bhavnagar. Referring the same, it appears<br \/>\n\tthat no irrelevant fact has been considered. The learned Trial Judge<br \/>\n\tin fact, has discussed all the relevant facts while releasing the<br \/>\n\trespondent-original accused on bail and hence, there appears no<br \/>\n\tsubstance in this application.\n<\/p>\n<p>\tMoreover,<br \/>\n\tfor cancellation of bail, conduct subsequent to release on bail and<br \/>\n\tthe supervening circumstances are relevant to be looked into. To me<br \/>\n\tthere appears no overwhelming circumstance which demands<br \/>\n\tcancellation of the bail order passed by the trial court.\n<\/p>\n<p>\tOn<br \/>\n\tbehalf of the applicant, nothing has been indicated to show that the<br \/>\n\trespondent-accused has, in any manner, misused the liberty granted<br \/>\n\tto him. In the circumstances, no case is made out for cancellation<br \/>\n\tof the regular bail granted to the respondent-accused.
